An ordinance granting right of way to the Illinois Cen- tral Railroad company, its successors or assigns, to construct a spur railroad track and operate trains• thereon, from the intersection of the north link of its track and Maiden alley, in block 8, town A, in the city of Paducah, McCracken county, Ky., in a northerly direction over and along said alley to Washington street; thence over and across Washington street to the continuation of said alley on the north side of Washinigton street; thence over and I 1 I. Franchise River Front. along said alley in a northerly direction 201 feet; and to construct an additional spur track from said track in said ;alley on the south side of Washington street, over and across Washington street to the property of Weaks Bros., on the north line of Washington street. Be it ordained by the common council of the city of , Paducah, that there is hereby granted to the Illinois Cen- tral Railroad company a corporation created under the . laws of the state of Illinois, and its successors and as- signs, the right of way, so far as said city has the right to,, grant the same, to construct a spur track of standard auge ,and run trains of cars thereon, tjrom rhe intersection sof the north line of its present track and Maiden alley, in block 81 town A, in the city of Paducah, McCracken county, Kentucky, beginning at such point of intersection as may be most practicable, thence over and along said alley in a northerly direction to Washington street; thence over and across Washington street to the continuation of sand alley on the north side of Wa=shington street; thence over and along the western side of said alley in a northerly direc- tion, and not to extend in width more than three and one- half feet from the west line thereof, a disrance of 201 feet from the north line of Washington street, and to construct r• an additional spur from said track in said alley on rhe south side of Washington street to the property of Weaks Bros., on the north line of Washington street, and operate such trains of cars thereover as may be necessary to en- able said company to furnish transportation facilites to persons owning property abutting on said alley along the rigtht of way herein granted. A plat of the right of way herein granted is filed herewith and referred to and made a part of this ordinance. Sec. 2. Be it further ordained that said company shall have the right to construct and maintain along the right of way herein granted the following described 'rail- road track, and upon. said track to operate and run by r REVISED ORDINANCES OF PADUCAH.' 185 I. T steam or other power its locomotives, engines, trains and cars, to -wit: A single railroad track of standard gauge, and from the same construct a spur track or siding in said alley on the south side of Washington street and over and ` across Washington street to the property of Weaks Bros. on the north link of Washington street. j 6 Sec. 3. Said company shall not in the construction of its roadbed and tracks over and along said right of wa_- unttecessarity obstruct the free use and passage over said street or alley,.or the crossings thereof, by persons or ve- hicles; or obstruct the free flow of water along any gutter, 'r sewer or culvert along the same. And where necessary, it } is to construct proper culverts under said tracks for the purpose of proper flow and passage of water. 3 Sec, q. That all points where said railroad track crosses 1 Washington street or sidewalks, said company shall make j such crossings safe and convenient for persons and vehi- cles and keep them in good repair and condition so tang as used fby it. f� i I; Sec. Said railroad bed and tracks to be so con- structed shall conform to the grade of the street and alley • r and crossing of same as now established, or which may p hereafter be established by the city of Paducah. j Sec. 6, The common council of said city shall retain the power and right to prescribe from time to time such rules and regulations as it may consider just and reason- able to regulate the running of trains by such company, i over and along the right of way granted, and to prevent the unnecessary obstrudtien of said street or alley or any crossing of the same by reason thereof; and enforce the observance of the same upon the part of the officers ,agents and employes of said company by the infliction of proper penalties. Said city hereby reserves all and singular the right and power provided for and directed to be reserved by it, by sub -section 35, of section 29, of the Charter' for cities of the third class. 186 REVISED ORDINANCES OF PADUCAH. I. C. Franchise River Front. Refunding Bonds 0 Sec. 7. Said company shall at all times keep in good repair the gravel porrion of said street, alley and cross- ings occupied by its tracks and switches. Sec. 8. Said company shall indemnify and save harm- less the city of Paducah against all damages which may be legally recovered against the said city by any person or corporation on account of said grant of right of way, or by reason of the construction or operation of said rail- road thereof. Sec. 9. This ordinance shall take effect from its pass- age and approval by the mayor. Adopted April 17, 18gg. W. H. PATTERSON, C. C. P. Approved April 2(;, 1899. JAS. M. LANG, Mayor. Refunding N. O. & O. R. R. Bonds. An ordinance providing for the calling for payment of $45,000 of the city of Paducah bonds, dated July 1st, 1883, is - stied for the purpose of refunding bonds theretofore issued' by the city to the New Orleans and Ohio Railroad company. Whereat, heretofore, and on the first day of July, 1883, pursuant to city ordinance duly and regularly adopted on the t6th day of April, 1883, city bonds in the amount of $48,000, hearing interest at the rate of six per centum, were legally issued for the purpose of funding or paying off forty-five l;onds of one thousand dollars each, falling due on said first flay of July, 1883, theretofore issued to the New Orleans and Ohio Railway company, and Whereas, in and by said ordinance of April i6, 1883, and by the terms of said bonds, the right was reserved to the 1.it3, to pay off any or all of said bonds after the expiration of fifteen years—their date—that is to say, at any time on or after the 1st day of July, 1898, by giving notice of intention ft 1
