I—C. Franchise River Front. Section r. Be it ordained by the Common Council of the city of Paducah, that there is hereby granted to the Illinois Central Railroad Company, a corporation created under the laws of the state of Illinois and operating a trunk line of railway in the state of Kentucky, and Through the city of Paducah, the right of way, so far as said city has the right to grant same, to construct a rail- road track and run tra:ns of cars thereon, beginning at the south side of Tennessee street, thence down, over and i. upon Second street to the north side of Clark street, thence by the most practicable line across and over Maiden Alley to Washington street and across and over Washing- ' ton street to First street, thence down, over and along the line of First street to and across Jefferson street, thence - by the most practicable route to and across Trimble se. and any intervening streets, and over all street crossings, in- tersections or alleys in said designated line, to what is e known as the property of the Paducah Union Depot Com- pany and to connect with the tracks of said company, its successors or assigns, or the tracks of the Illinois Central Railroad Company. 'Sec. 2. Be it further ordained that said company, sub- ject to the regulations lie reinafter contained, shall have the right to construct and maintain upon the said streets, crossingsl, intersections and alleys, and within the limits thereof as set forth in the first section of this ordinance, the following described railroad track, and upon said track to operate or run by steam or other power its Iocomotiva engines, trains and cars, namely: Upon all of said streets, crossings, intersection s, alleys and right of way hereon granted, a single railroad track of standard guage, to bo laid in the center of the streets, so fas as practicable, and to construct from its track, spur tracks or sidings into the property, warehouses, manufacturing or mercantile estab- lishments now located or that may hereafter be located up said streets or line,of right of way. Be it further ordained, that the rights and privileges hereinbefore grained are made subject to the f following express conditions, stipulations and regulations, and the same are hereby imposed upon the said company in consideration of tho above grant, namely: First—The said comapny sha!1 not, in the construc- tion of its road bed and track over and along said right of way unnecessarily obstruct the free use and passage over said streets, street crossings or alleys by persons or ve-, hicles, nor obstruct the free flow of water along any gut- ter, sewer or culvert in said city; and where necessary it is to construct proper culverts under said track for the passage and flow of water. Second—That at all points where said railroad tracks may cross any street or alley said company shall make such crossings safe and convenient for the passage of per- sons and vehicles, and keep them in good repair and con- dition so long as used by it. Third—That said railroad bed and track Vong said streets and street and alley crossings shall conform to the grade of said streets, alleys and street and alley crossings, as has been or may hereafter be established by the city of Paducah, except at crossings of Court, Broadway and Jef- ferson streets. The said railroad bed and track shall be so laid at the crossing of Court street that the street will not be raised more than s -ix inches above resent t h grade and t V es a is ed . •,., - a t e crossing of Bradway the street shall be raised not more than three inches above present establish- ed grade, and at the crossing of Jefferson street. the street shall not be raised more than three feet and six in- ches above the present established grade; the approaches to the track at Court, Broadway and Jefferson streets shall be constructed so as not to unnecessarily interfere with the public use of same. It is also distinctly understood that the approach to the crossing of the track between the intersection of First and Jefferson streets and'the'river, . ..I 1180 REVISED ORDINANCES OF PADUCAH. I. C. Franchise River Front. on the east side of the track, shall be so eonstrucred that the street shall be graded to its full width from curb to curb to the river and curve approaches provided to both sides of said street so graded and the approach to the crossing on the .west side of the track at Jefferson street. shall be graded so as, to form no rise or hollow in the street and, so graded to the property lines on both sides of said street on the west side of the track, to the extent made necessary by the approach to said crossing, and between Jefferson st. and Trimble st. said company shall have the right to construct a wooden trestle for irs road bed and track along its right of way and along the right of way herein granted, but in such a manner as to allow wagons to pass under same at a10 street crossings, or it may fill said right of way, bridging the street crossings and said company shall under the supervision of the city engineer dig down the embankment on the west side of Second street, between Clark and Adams streets, to the established grade of Second street, so as to make said street its es- tablished width to the curb on that side of the street, the dirt dug and excavated from said embankment. to belong to said company. Sec. q. The Common Council of said city shall have and retain the power and right to prescribe from time to time such rules and regulations as it may consider just and reasonable to regulate the running of the trains through said city over and along said right of way, and to prevent the unnecessary obstruction of streets, alleys and crossings by reason thereof, and enforce the observance of same on the part of the officers, agents and employes of said company by the infliction of proper penalties. Said city hereby expressly .reserves all and singular the nights and powers provided for and directed to be reserved by it, by sub -section thirty-five (35) of section twenty-nine (29) of the charter for cities of the third class; being sub- section thirty-four (3 q) of section twenty nine (29) as 0 t 1 t 77 - .. Sec. g.—That the said company shall' at all times keep in good repair the gr4,el portions of said streets, alleys and crossings occupied by its track or switches, It is further agreed that said railroad company shall furnish gravel along the right of way herein grant- ed, from Jefferson to Tennessee streets, and unload same from its cars to keep the gravel, part of said streets in re- pair free of charge to the city, the gravel to be furnished at such time and in such quantities as may be required or 1 asked for by the city, the gravel to be of the character { used for such repairs by the city; the city to distribute said gravel upon said streets. Sec, 6. Said company shall indemnify and save harm- !` less the said city of Paducah against all damages which { may be legally. recovered against said city by any person or corporation on account of said grant of right of way or by reason of the construction or operation of said railroad through said city. Sec. 7, That said company shall permit the main tracks of any railroad or railroads that may hereafter be constructed to or through the city of Paducah, or that or now constructed to or through any portion of the city of I Paducah to be laid acr oss and at the grade of the tracks of said company within the limits of the right of way granted under this ordinance without exacting any compensation - from the owner of such railroad or railroads for this privi- lege; provided'. however, that the said owners shall at their ! own expense construct such crossings in a thorough and substantial manner and so maintain them,, and shall lay them at such points only as crossings may become actual- ' ly necessary for the bona fide extension and operation of their line, and in such a manner as to cause the least pos- i 182 REVISED ORDINANCES OF PADUCAH. 1 C. Franchisc River Front. sible obstruction to the traffic of said company consistently with the aforesaid extension and operation of new lines of railroad. r Sec. 8. That said Illinois Central Railroad Company its successors or assign, shall at all reasonable times de- liver to any point or points along said right of way herein granted and take from all said point's loaded cars and deliv- er same in its yards to any carrier or connecting line of railway or at the connecting point of such Dine of railway with its said right of way in the city of Paducah, at a maximum charge of two dollars per car, except that no ` charge shall be made upon 'cars handled for the transpor- tation of freight over its own line by said company, and shall deliver or remove empty cars from which the com- pany has or may receive revenue from all points of said right of way free of as charge speedily g P Y and Promptly as possible, 'having reference alone to the generab traffic on said line. No discrimination shall be made in favor of or against any one receiving or shipping loaded cars nor shall said company discriminate in favor of or against any car - Her receiving or delivering cars to said company to be handled over said line of right of way. Sec. , q. Said company shall construct their road bed and track and operate their trains thereover within eighteen months from the final -passage of this ordinance, unless prevented from doing so by high water, strikes, the act of God, or other unavoidable casualty, otherwise this grant • shall determine. Sec. to. Franchise River Front. slope off to a feather edge the upper side of the upper curve roadway and the lower side of the lower curve road- way in ,such a manner as to be safe and convenient for the approach of vehicles from the wharf onto them; that F1 these curve roadways are to meet the straight roadway of Jefferson street. to the river at or near ordinary low water mark on the river and are to be in main width forty feet, sloping off at the edges as aforesaid, the same to be prop- erly graded, together with the middle road and graveled and the two small semi -circles between roads are to be fill- , ed and 'graveled in such a way as not to be dangerous to teams and vehicles. Also said company herceby agreea that First street, from intersection of First and Jefferson sts, shall be raised from curb to curb by it in the diretcion of Broadway at the same grade as the railroad track. i ' Sec. it.
