Spar Tracks, Ninth Street. An ordinance gran jng to the Illunois Central Railroad Company, it, successors or assigns the right to construct spur ,tracks or sidingson Ninth street and over and across' same and the sidewalks thereon and operate trains there- over, from its railroad track or extension thereof on Ninth street, between Trimble and Burnett streets, into warehouse; manufactu:mg or mercantile establishments ¢ now located or that nay hereafter be located abutting upon said street between Trimble and Burnett streets. Be it ordained by the Common 'Council of the city of Paducah. Section r. The right is hereby granted to the Illinois Central Railroad Company, its successors or assigns, to build and construct spur tracks or sidings on Ninth street, and over and across same, and the sidewalks thereon, and operate trains thereover, from its railroad track, or exten- sion thereof, on Ninth street, between. Trimble and Bur- nett streets, in the city of Paducah, its warehouses, manu- facturing or mercantile establishments now located, or that may hereafter be located abutting upon said street, between Trimble and Burnett streets. Sec. 2. Said company shall not unnecessarily, in the ' construction -of said spur tracks or sidings, obstruct the free use and passage,over said street or sidewalks, or per- sons or vehicles; or the free flow 'of water along any gut- ter, sewer or culvert thereon; and where it is necessary to r t _ � 4 ' r REVISED ORDINANCES OF PADUCAH, 177 11. C. Spur Track, Ninth Street. I. C. Franchise River Front do so it shall construct proper culverts under 'said spur tracks or sidings for the free passage and 'flow of,watar. Sec. 3. Said spur tracks or sidings shall conform.to ; the grade of said street and sidewalks where it crosses' so far same As practicable and shall be kept and maintain- . ed in good repair by said company. Sec, 4. The said city of Paducah expressly reserves all and singular, the rights and powers provided for and di rected to be reserved by it by sub -section 3g 'of section 29 of the charter for cities of ' the third class, being sub -sec- tion 34 of section 29 as now printed in the present printed charter of the city of Paducah, and sub -section 35 of 3290 of the Kentucky Statutes.
