R. i streets and sidewalks so far as practicabbe, and shall be kept and maintained in good repair by said railroad company. Sec. 4. Said proposed track of raillway from within the city of Paducah, McCracken county, Kentucky, to or near East Cairo, Ballard county, Kentucky, is to be constructed by the Chicago, St. Louis and New Orleans Railroad company, its successors or assigns, and trains operated thereon, with- „ in two (2) years from the final passage of this ordinance, un- less 'prevented by unavoidable casualties; otherwise this ordi- nance is to be null and void and the grants therein made of no effect. An ordinance to amend an ordinance, entitled, "An ordi- nance granting the Paducah, Cairo and Northwestern Rail- road company, the right of way upon and across certain streets in the city of Paducah. Be it ordained by the general council of the city of Pa- ducah, Kentucky: Sec. 1. That the ordinance adopted on the 15th day of November, 1901, and approved by the mayor on the 26th of November, 19o1, which ordinance is entitled, "An ordinanc% granting the Paducah, Cairo ; and Northwestern Railroad r V r I i Right of Way C. & N. W. R. R. i company the right of way upon and across certain streets in the city of Paducah," be amended. by striking out of the sec- I ond section of said ordinance, the following words to -wit: "For a failure to commence in good faith the construction of ,10 . r the said railway for w hich tihis franchise is given, within the Jperiod of one year fro.n the date of the granting of the same," and inserting in lieu thereof the following words, to - wit: For a failure to commence in good faith the construc- tion of the said railway for which this franchise is given, within the period of two years from the date of the granting of the same. r ' And the same section be amended also by striking out of same the following words, to -wit: "And for failure to com- plete the said line within three years," and by inserting in lieu thereof the following words, to -wit: "And for failure to complete the said line within four years," so that when do amended the said section two of said ordinance shall read as follows, to -wit: "The franchise herein referred to is granted upon the ex- press conditions of the railway company maintaining the streets over which the said line of railway runs and extends; and it is also understood that said company shall keep in re- pair the sidewalks already constructed that may in any man- ner intersect the said line of railway. It is also understood that the franchise granted shall not in any manner be sold or transferred before the construction of the same, for a failure to commence in good faith the construction of the said rail- way for which this franchise is given within the period of two b years from the date of the granting of the same the said franchise shall be forfeited and be null and void. And for the failure to complete the line within four years from the date of the granting of the same, this franchise shall be null and void. Spur Tracks, Ninth Street, An ordinance grar Jug to the Illinois Central Railroad Company, its successors or assigns the right to coustruct spur tracks or sidingson Ninth street and over and across' same and the sidewalks thereon and operate trains there- over, from its railroad track or extension thereof on Ninth street, between Trimble and Burnett streets, into warehouse; manufacturing or mercantile establishments �s now located or that nay hereafter be located abutting upon said street between Trimble and Burnett streets. Be it ordained by the Common 'Council of the city of Paducah. Section t. The right is hereby granted to the Illinois Central Railroad Company, its successors or assigns, to build and construct spur tracks or sidings on Ninth street, and over and across same, and the sidewalks thereon, and operate trains thereover, from its railroad track, or exten- sion thereof, on Ninth street, between Trimble and Bur- nett streets, in the city of Paducah, its warehouses, manu- facturing or mercantile establishments now located, or that may hereafter be located abutting upon said street, between Trimble and Burnett streets. Sec, s. Said company shall not unnecessarily, in the _ construction of said spur tracks or sidings, obstruct the free use and passage,over said street or sidewalks, or per- sons or vehicles; or the free flow 'of water along any gut- ter, sewer or culvert thereon; and where it is necessary to 1 4 t". r
