An. ordinance pL-rm;tting the Paducah Water Company to place at the terminus of :ts suction pipe a Falcon patent rotary strainer. Be it ordained by the council of the city of Paducah. That the Paducah Water' Company be and it is hereby permitted to use a Falcon patent rotary strainer at the end of its suction pipe in vi!c ,fiver instead of a crib, as was originally received by the city ,of Paducah, through which it is to furnish filtered Ohio river water to the city of Padu- cah. And this ordinance ;hall take effect from its passage and upon the written acceptance of thiF ordinance by the water company, to be riled with the clerk within ten days. Adopted, Aug. 24. 1892. W. Right of Way Cairo Branch. trains,and locomotives thereover, from the east side of Rur- . nett street, where it intersects Ninch street, across Burnett street and along Ninth street,if exhend,ed,9jo the northwestern limits of the city of Paducah, and across and over any streets . intersecting, or that may hereafter intersect Ninth street, and over and across any property not owned by the city as a street which may be acquired by said railroad company ad- jacent to or abutting Ninth street, or beyond Ninth street where it is not extended.. Be it enacted by the general council of the city of Padu- cah, Ky. 7 Sec. 1. That, whereas, the Chicago, St. Louis and New Orleans Railroad company proposes to construct, as a branch or extension of the Chesapeake, Ohio and Southwestern rail- road, owned by it, a railroad from the city of Paducah, in McCracken county, state of Kentucky, to a physical connec- tion with its railroad at or near East Cairo, Ballard county, l state of Kentucky, and to operate said railroad from; within the city of Paducah to said railroad connection at or near East Cairo; and, whereas, by •virtue of an ordinance passed by the council of the city of Paducah, entitled., "An ordi- nance granting the right of way to the Chesapeake, Ohio and Southwestern Railroad company over parts of Trimble and Ninth stlre;ets in the city of Paducah, "approved March 31, 1888, which ordinance was amended by -an ordinance approv- ed Sept. 15, 1897, the Chicago, St. Louis and New 10rieans Railroad company proposes to construct an extension or branch of the said Chesapeake, Ohio and Southwestern rail- road from a point at or near the intersection of the east side of Boyd street with the present track of the Chesapeake, • Ohio and Southwestern railroad now belonging to the Chica- go, St. Louis and New Orleans Railroad company, in Ninth street westwardly along Ninth street to the east side of Bur- nett street, the rights granted under and by virtue of said or- dinance and the amendments thereto, are hereby confirmed, and the right is hereby granted by the general council of the 1 r PE ,.., ,.,. Fight of Way, Cairo Branch. city of Paducah to the said Chicago, St. Louis and New Or- leans Railroad company, its successors and assigns, to build, construct and maintain a railroad track of standard gauge b and operate trains thereover, from the east side of Burnett street in the city of Paducah-, where it int'ersect's and criosses Ninth street in said city, over and across Burnett street, .;,rd over and along Ninth tsreet, if extended, to Flournoy street, where said Flournoy street intersects Ninth street, and over and across Flournoy street, and along and over Ninth street, if extended, to Terrell street, and over and across Terrell street and along and over Ninth street, if 1 extended, and over and across any other intersection streets that now cross,or may diereaftelr cross- Ninth street, and along and over Mintli street from the east side of Burnett street, as herein above specified, to the north- western limits of the city of Paducah, so far as the city has the power and right to grant such rights; and also over and across any property not owned by the city which may be ac- quired by the said railroad company adjacent to or abut- ting on Ninth street or beyond Ninth street, where said street is not extended, for the purpose of the construction of said railroad track, It is hereby distinctly understood that the said grant is .' to extend along and over the north side of Ninth street, if extended, from the east side of Burnett street to a point near the division line between block qt and Si. Sec. Z• Said railroad company shall not, in the construe - tion of said track, unnecessarily obstruct the free use of passage of persons or vehic!es over the streetst or sidewalks aforesaid, or, the free flow of water along my gutter, sewer or culaert thereon, and where it is n2ca.- sary so to do, said railroad company shall construct , proper culverts under said track, for the free passage or flow of water. Sec, 3. Said' track shall conform to the grade of the 174, REVISED ORDINANCES OF PADUCAH. Right of Way, Cairo Branch. Right of Way C. & N. W. R. R. streets and sidewalks so far as practicabbe, and shall be kept and maintained in good repair by said railroad company. Sec. 4. Said proposed track of raillway from within the city of Paducah, McCracken county, Kentucky, to or near East Cairo, Ballard county, Kentucky, is to be constructed by the Chicago, St. Louis and New Orleans Railroad company, its successors or assigns, and trains operated thereon, with- in two (2) years from the final passage of this ordinance, un- less 'prevented by unavoidable casualties; otherwise this ordi- nance is to be null and void and the grants therein made of no effect.
