Side Track. wide on the outside of both rails; that the rails and planks shall be smooth as practicable, and level with the grade of said street, and the same shall ever be kept and maintained in like good order, so that the same shall not be any material obstruction to the passage along or across said crack by ve- hicles. And further provided, that if in the exigencies oA the fu- ture and in the judgment of the city council they shall deem it reasonably necessary that said wooden plank shall not be sufficient protection for the convenient passage of vehicles along said track, then, and in that cese, they may require said railroad company to lay stone in lieu of the planking hereinbefore provided. An ordinance granting to the Paducah, Tennessee & Ala- bama Railroad company the right to make and operate a side tray., near its depot, across Fifth and Sixth streets. Be it ordained by the council of the city of Paducah. That there is hereby granted to the Paducah, Tennessee & Alabama Railroad company the right to build and operate a side track on the south side of the depot, across Fifth and Sixth streets, said side ;rack connecting at both ends with the main track, as shown by the engineer's survey and plat of same now filed with the council .clerk and made part and ex- planatory hereof. That the grant hereby made to so cross Fifth and Sixth streets with side track is subject to the burde•i which is hereby imposed upon said company, to conform its paid crossings with the grade of said streets thereat, and lay l i58 REVISED ORDINANCES OF PADUCAH. Water Works Franchise. two-inch oak plank inside and one foot wide on the outside of its tracks at said crossings, and so maintain the same thereafter, and in no event prevent the free flow of water a'.ong the gutters at said crossings, and besides, said com- pany shall at all times hereafter be subject to requirements of the city council hereafter to keep said crossings in good condition, with the use of such material, wood, gravel or ,tone, in manner and form as the council may hereinafter prescribe. And said company, in rhe acceptance, hereby waives and relinquishes any and all rights that they may have to alter or change their tracks across Third street at Norton street under any ordinance of the city of Paducah granting a right 'to cross said Third street. And said Paducah, Tennes- see & Alabama Railroad company shall, in ten days after the passage of this ordinance, signify their acceptance of same in writing, filed with the clerk of the council. An ordinance to provide for the supply of clear filtered Ohio river water to the city cf Paducah and its inhabitants; authorizing J. A. Jones of the ci.y of St. LoLis, Mo., his as- sociates, successors or assigns, to construct, operate and mq:ntain a system of water works, contracting with said. Jones, his associates, etc., for a supply of v,ater for public and domestic use, and giving said city an option to purchase s^id water works. ' Be it ordained by the mayor and counci, of the city of P-, ducah
