T.,& A. R.• R. Co. — Be it ordained by the council of the city of Paducah, z. That there is hereby granted to the Paducah, Ten- nessee & Alabama Rai:road company the right to change the present location' of its tracks over Third street ands to cross Third street at the end of Norton street into the grounds of the Paducah Iron company as indicated by sur- v.ey and plat of said proposed new track made by the railroad engineer, with this material 4,• .qualification, however, to -wit: ,That said proposed new track and the south rail thereof shall not be laid nearer than fifteen feet and eight inches of the corner of curbing of Norton and Third streets, and said rail- road company shall have the right to operate its cars upon said new track subjectto the• general ordinances of the city ` heretofore passed or that may hereafter be { Y passed by the city council regulating the crossings of railroads mover the ,streets of Paducah, and provided further '.j that this grant is trade, upon the express condition drat when the said new track shall be so laid that said com- pany will take up and remove its present old track on Nor- ton street near and across Third street at said place, and will repair the street andlace P gravel on it and make the same ' in as good order as it was before the present old track was laid, and the right, therefore, granted to the company to have ' ar.d maintain a track and operate the same at said place shall cease upon the new track being made ready for use, the \ clear intention being that the new track, when laid, is to en- tirely supersede the old one at said place of change, ' z.. Side Track. wide on the outside of both rails; that the rails and planks shall be smooth as practicable, and level with the grade of said street, and the same shall ever be kept and maintained in like good order, so that the same shall not be any material ` obstruction to the passage along or across said track by ve- hicles. And f urther provided, that if in the exigencies' oA the fu- ture and in the judgment of the city council they shall deem it reasonably necessary that said wooden plank shall not be sufficient protection for the convenient passage of vehicles along said track, then, and in that case, they may require said railroad company to lay stone in lieu of the planking hereinbefore provided. An orAtnance granting to the Paducah, Tennessee & Ala- bama Railroad company the right to make and operate a side tract.. near its depot,. across Fifth and Sixth streets. Be it ordained by the council of the city of Paducah. That 'there is hereby granted to the Paducah, Tennessee & Alabama Railroad company the right to build and operate a side track on the south side of the depot, across Fifth and Sixth streets, said side track connecting at both ends with the main track, as shown by the engineer's survey and p'.at of same now filed with the council -clerk and made part and ex- planatory hereof.
