2. Any title said city may have acquired to said part of
said street by occupaticn or by prescription is hereby re-
leased to the Chesapeake, Ohio & Southwestern Railroad
company or its associates and assigns.
3• It is, however, especially provided that the council
shall have the right to repeal this ordinance unless the
Ghesapeake, Ohio & Southwestern Railroad company or its
assigns shall build or cause to be built on the reserve grounds
betwen Trimble and Campbell streets and Sixth and Nirth
streets, a Union Passet.ger depot of brick or stone or
brick and stone. The work on said depot is to be begun in
good faith within two months from the passage of this or-
dinance, and to he completed within eighteen months there `
after. Said depot shall be constructed so as to afford am-
ple facilities and accommodations in waiting rooms, baggagr
moms and ticket office! for the convenience and co nfnr:
of the traveling public, Said depot to cost not less than
fifteen nhousand dollata, and whenever said ground shall 1
abandoned for a depot or railroad purposes the council
map re-establish said street.
4. All ordinances in conflict with this ordinance are
repealed, and this ordinance shall take effect from its pass
age and publication.

Be it ordained by he council of the city of Paducah:
�s 1. That the right of way is hereby granted to the Ches-
apeake,
herapeake, Ohio ane. Southwestern Railroad company, its asso-
ciates or assigns, to construct its tracks over and along that
part of- Trimble street between Eighth and Ninth streets,
kand over and along that part of Ninth street between the
i west side of Trimble sheet and Burnett street in the city of
Paducah, and to run anti operate its trains of cars over said
street hereinbefore designated.
2. It is, however, provided that the right of way
granted herein over Ninth street shall only authorize the
construction of a single track over Ninth street, below Trim-
He street, and paid track shall be used only for the purpose
of one side of a "Y" for turning trains, and shall not be used
fi-r the purpose of standipg trains, cars or locomotives upon
.or thereon any further or longer than is necessary to make
the turn or change of each train or locomotive.
3. The grants herein contained are made upon the con-
dition that the Chesapeake, Ohio and Southwestern Railroad
company, or its assigns, shall construct a Union Depot upon
what is known as the "reserved grounds" within eighteen
months from this date, o. cause the same to be constructed
so as to conform to the provisions in relation to said depot
contained in an ordinance vacating Seventh street, between
Campbell and Trimble streets, as therein set out; said de-
pot to be erected betwten Sixth street and Ninth street on
said "reserved ground:'
4. All ordinances in conflict with this ordinance are re-
pealed, and this ordinance shall take effect from and after
its passage and publication.

An ordinance to amend an ordinance entitled, "An ordi-
nance granting the right of way to the Chesapeake, Ohio and
Southwestern Railroad Company over parts of Trimble and
Ninth streets in the city of Paducah," adopted March 26th,
1888, and approved March 31st, 1888. '
Be it ordained by the Common Council of the city o1
Paducah:
Sec. r. That an ordinance entitled, "An ordinance grant-
ing the right of way to.the Chesapeake, Ohio and Southwest-
ern Railroad Company, over parts of Trimble and Ninth.
streets, in the city of Paducah." Adopted March 26th, 1888,
and approved March 31st, 1888, be and the same is hereby
amended by striking out therefrom and repealing section 2,
of said ordinance and inserting in lieu thereof the following
as section 2, of said ordinance, namely:
. Sec. 2. It is herein'provided that the right of way grant-
ed herein, over Ninth street, shall only authorize the con-
struction of a single main track over Ninth street below
Tremble street.
Sec. 3. This ordinance shall take effect from and after
its passage and approval.
