HomeMy WebLinkAboutMinutes Book 24, Page 60, July 17, 195960 Proceedings of July 17, 1959 City of Paducah Board of Commissioners At a Called Meeting of the Board of Commissioners held in the Commission Chamber of the City Hall, Paducah, Kentucky, at 4:00 o'clock P.M. on July 17, 1959, Mayor Jacobs presided and upon call of the Roll the following answered to their names: Commissioners Fairhurst, Fendley, Gholson, Hook and Mayor Jacobs (5). The meeting was for the purpose of hearing charges preferred by Rulie Elliott against Johnny Herbert. Commissioner Gholson offered motion that the return of Captain Robert Holt, sh w- ing the copy of charges preferred against Johnny Herbert by Rulie Elliott, Chief of notice of hearing �! the Police Force of Paducah, and a copy of the Notice of the hearing set for trial served on J Herbert on July 17th, 1959 at 4:00 o'clock P.M., be received and filed. Adopted on call of the roll, Yeas, Commissioners Fairhurst, Fendley, Gholson, Hook and Mayor Jacobs (5). I Commissioner Gholson offered the following motion: Judgment I move that the Board of Commissioners adopt the following and attached findings of fact and judgment upon charges preferred by Rulie Elliott, Chief of Police against Johnny Herbert: "The Mayor and Board of Commissioners having heard the evidence upon charges i preferred against the defendant, Johnny Herbert, by Rulie Elliott, Chief of Police, and being sufficiently advised that the defendant has been guilty of violating Rules 17 and 21 of an ordinance adopted by the Board of Commissioners on January 7, 1947, which rules read as follows: 1117. Being tardy or absent from any roll call or loitering unnecessarily at police headquarters. 1121. Being absent from duty without proper permission. Police officers shall have permits from the Chief of Police or their superior officer temporarily on duty for any absence from their regular post or assign- ment, and no officer shall be off duty without permission property granted to him, and any officer who shall absent himself from duty tirithout such permission shall forfeit his pay during the period of such absence and be dismissed from service. "It is therefore the judgment of the Board of Commissioners that the defendant Johnny Herbert, be, and he is hereby demoted from the rank of Sergeant in the Police Department of the City of Paducah, Kentucky to that of a patrolman, effective immed- iately, and that he is hereby suspended from duty in such police department for a period of 90 days, said suspension to be without pay and effective immediately.
