Water line Commissioner Jacobs offered motion that the petition of William B. Cothran and Oaks Road ✓ wife, Mary Pauline Cothran, residing on Oaks Road in WdCracken County, outside the cor- porate limits of Paducah, Kentucky, for authority to lay and construct a water line for the purpose of providing water service to the building located on the property d peti- tioners be received and filed and that the request in said petition be granted in accordance with the terms set forth therein. It is understood, however, in granting the privilege sought in said petition i neither the City of Paducah nor the Commissioners of Plater Works shall be obligated to buy said pipe line or any part thereof, and no such obligation shall be contained or be implied hereafter should the territory to be served by the rater line to be laid under the authority herein requested be taken into or made a part of the City of Paducah. It is further understood that the petitioners will subscribe for water service i at the rates now or hereafter prescribed for water service to consumers outside the city limits of Paducah and subject in all respects to the rules and regulations of the City ofl Paducah or its Commissioners of ^later Works which may be now in force or hereinafter en- I acted. Vance, dated March 1, 1950, the city was further notified that said franchise holder had selected as a site for the disposal of garbage and rubbish the two tracts of land referred to in said letter, one being the sam property conveyed to Charlie Hopkins and Hollis Hopkins by L. A. Albritton by dead dated April 17, 1916 and recorded in Deed Book 112, page 15 in said Clerk's office; and also the selection of another sire, being that tract of land conveyed by Mayme K. Wheeler and Charles K. 'Sheeler to A. W. 'lets, Horace Mills and Tam A. Mills by deed dated May 11, 19i , and recorded in Deed Book 63, page 221 in said Clerk's office; and WHEREAS, under date of March 7, 1950, the Board of Commissioners authorized the mayor to notify the said R.A.Bridgwater that none of said sites so selected would be approved; and WHEREAS, in his letter of march 20, 1950, the said Roy N. Vance has explained why the use of a dumping site within the city would be impractical if not altogether impossi- ble for use by reason of the lack of available dirt for covering garbage and rubbish, an it appears that the selection of a site beyond the corporate limits should be approved for this reason; I therefore move that the Board of Commissioners rescind the action taken at the meeting of March 7 when the Mayor was directed to notify the franchise holder that the above mentioned sites were not approved, and that all of said sites referred to in the aforesaid two letters written by thesaid Roy N. Vance be approved as sites for use by th said R. A. Bridgwater in the dumping of garbage and rubbish collected by him pursuant to the provisions of the franchise ordinance. Daylight ✓ Commissioner Shomas offered motion that the letter of the Paducah Kiwanis Club Zaving time letters approving daylight saving time and the letter of the International Association of Machinists opposing the change in the time, be received and filed. Bridgwater, the holder of the garbage and comply with agreements rubbish franchise in the City of Paducah, a letter which shall read as follows: "REGISTERED May 16, 1950 Mr. R.A. Bridgwater R.A.Bridgwater Sanitary Garbage Disposal Company 7th and Kentucky Avenue Paducah, Kentucky Dear Mr. Bridgwater: - Tie acknowledge reooipt of your notice of May 2nd, 1950 in which you advise that you will cease operations on June 25th, 1950, under your franchise for the collection of garbage and rubbish in the City of Paducah. Pursuant to a motion adopted by the Board of Commissioners at its meeting tonight I am authorized to inform you that you now have and have always had all of the rights and privileges granted to you under the provisions of the franchise ordinance. You will also take notice that you are expected to strictly comply vil th each and every provision, condition and agreement contained in the ordinance under which the fran- chise was created and if you should cease to operate under the franchise on and after June 25th, 1950, the City of Paducah will institute a suit against you and your surety, the United States Fidelity and Guaranty Company, for recovery of liquidated damages in tt sum of ;20,000.00 as provided in Section 28 of the franchise ordinance: which reads: "SECTION 28.
