At a Regular Meeting of the Board of Commissioners held in the Commission Chamber
at the City Hall, Paducah, Kentucky, at 7:30 P.M. on February 20, 1951, Mayor sohnston
prided and upon call of the Roll the following answered to their names: Commissioners

Water line Commissioner Hannin offered motion that the petition of Charles A. Payne and wife,
Hinkleville
Road { Ruby Payne, residing on Hinkleville Road in McCracken County, Kentucky, partly cutside the
corporate limits of Paducah, Kentucky, for authority to lay and construct a water line
I!for the purpose of providing water service to the building located on the property of
petitioners be received and filed and that the request in said petition be granted in
accordance with the terms set forth therein.
It is understood, howeber, in granting the privileges sought in said petition neit

the City of Paducah nor the Commissioners of Water Works shall be obligated to buy
said pipe line or any part thereof, and no such obligation shall be contained or be
implied hereafter should the territory to be served by the water line to be laid und3r
the authority herein requested be taken into or made a part of the City of Paducah.
It is further understood that the petitioners will subscribe for water service at
rates now or hereafter prescribed for water service to consumers outside the city limits
of Paducah and subject in all respects to the rules and regulations of the City of Paduc
or its Commissioners of Water Works which may be now in force or hereinafter enacted.
Nothing in the granting of this petition shall obligate the City of Paducah or its
Commissioners of Water Works to guarantee pressure or service, and said water service
may be dis continued through said pipe line at any time when in the judgment of its
Commissioners of Water Works the furnishing of water to the petitioners or their
successors in ownership of the property owned may interfere in anywise with the adequate
supply and distribution of water inside the corporate limits of the City of Paducah.

contained in said petition be considered as an agreement on the part of the City of
Paducah to pay the firs hydrant and water main rental, as provided in the franchise,
or the pine line and connection referred to in the petition, said rentals to begin
when said water main has been laid and water provided for on said section of Monroe
Street from North 28th street to 29th street, a distance of approximately 500 feet.

v` William V. Eaton, owner of property located on Clay Street between 25th street and 28th
Street, files with the Mayor and Board of Commissioners a petition representing that he
is the owner of the property referred to in said petition; and said William V. Eaton
petitions the Mayor and Board of Commissioners for the extension of a 6" water main
along Clay Street from 28th Street to west line of 25th street (extended) a total
14' distance of approximately 1400 feet.
p The above referred to property consksts of vacant lots and petitioner, William
V. Eaton, has paid to the Paducah Water Works $336.00 plus the Utility Tax of $10.08,
being the minimum charge for 14 lots for a period of two years from the completion of the
fraying of the above mentioned water main.
It appears from the endorsement by the Board of Commissioners of the Paducah
Water Works that said request and petition comply with the franchise provisions and re-
quirements.
I therefore move that the petition of William V. Eaton be received and filed
and that the Paducah Water Works, through its Board of Commissioners, be authorized to
extend a 6" water main along Clay Street from 28th street to west line of 25th street
(extended), a total distance of approximately 1400 feet, so as to provide water service
to the above described property on Clay Street.
I further move that the adoption of this resolution and the granting of the
request contained in said petition be considered as an agreement on the part of the City
of Paducah to pay the fire hydrant and water main rental, as provided in the franchise,
on the pipe line and connection referred to in the petition, said rentals to begin when
said water main has been laid and water provided for on said section of Clay street

24, 1946, and Section 5 thereof as amended on October 22, 1946, and Section 3 thereof as

orized to refund to the Paducah Water Works the sum of $29.00 paid by it for said permit.

the restriction placed upon the hospital property known as the "Ewart Purcell Isolation
under the opinion written by Judge Settle in 1927 in the action of Woman's Hospital
p, League and others against the City of Paducah and others, and that a suit be instituted
the City bf Paducah against the surviving members of the WomanTs Hospital League and others whose
interests may be affected for the purpose of obtaining an order of court which will
p permit the City of Paducah Municipal Hospital Commission to use said property for pur-
poses other than as a hospital for the isolation and care of persons afflicted with
