HomeMy WebLinkAbout2002-8-6554340 ORDINANCE NO. 2002-8-16S � AN ORDINANCE PROVIDING FOR THE CLOSING OF A PORTION OF POPLAR STREET LOCATED BETWEEN LONE OAK ROAD AND A 20' RvTROVED ALLEY BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That the City of Paducah does hereby authorize the closing of a portion of Poplar Street, and being more particularly described as follows: A 40 foot unimproved road (Popular Street) located between Block Number 23 and Block Number 20 L.D. Sanders Arcadia Subdivision, Paducah, McCracken county, Kentucky and being more particularly described as follows: Beginning at a 2" iron pipe (fad) at the northeastly corner of Lot 1, Block Number 23, L.D. Sanders Arcadia Subdivision of record in Plat Book A, Pages 218 & 219 McCracken county court clerk's office, said iron pipe being located North 34°06'42" West, 78.70 feet; North 55'53'18" East, 220.00 feet; south 34°06'42" East, 10.00 feet; North 55°53'18" East, 120.00 feet from a city street monument (fad) in Birch Street; thence with a line being an extension of the southerly right- of-way margin of a 20 foot public alley (improved) North 55'53'18" East 40.00 feet to a 5/8" x 24" iron rebar w/cap (set) PLS #3117 at the northeasterly corner of Lot 8, Block Number 20, L.D. Sanders Arcadia Subdivision of record in Plat Book A, Pages 218 & 219 McCracken county court clerk's office; thence with the westerly line of Lot 8, South 34°06'42" East, 150.00 feet to a 5/8" x 24" iron rebar w/cap (set) PLS #3117 in the northerly right-of-way margin of U.S. Hwy 45 (A.K.A. Lone Oak Road) said iron rebar being located 45 feet from centerline and being the southwesterly corner of lot 8; thence with the right-of-way margin of U.S. Hwy 45 (A.K.A. Lone Oak Road) South 55'53'18" West, 40.00 feet to a 5/8" x 24" iron rebar w/cap (set) PLS #3117, said iron rebar being the southeasterly corner of Lot 1; thence with the easterly line of Lot 1 North 34°06'42" West, 150.00 feet to the point of beginning, containing 0.1377 acres or 6,000 square feet. Subject property being the unimproved portion of Poplar Street generally bounded on the north by a 20 foot public alley (improved) and on the south by U.S. Hwy 45 (A.K.A. Lone Oak Road). Subject property being the same Poplar Street as shown on L.D. Sanders Arcadia Subdivision of record in Plat Book A, pages 218 & 219, McCracken county court clerk's office. 1 Subject property being the same property as shown on plat of street closing as determined by SCI Surveyors, Inc. PLS #3117 Dated April 11, 2002. SECTION 2. In support of its decision to close the aforesaid public way, the Board of Commissioners hereby makes the following findings of fact: A. Donna Chu, Mark Crawford, Melvin Englert, Mary Englert and James Melvin Englert are the owners of property abutting the public way which the Board of Commissioners has authorized to be closed as is evidenced by the application for street and/or alley closing which is attached hereto and made part hereof. B. On the 15th day of Julyl, 2002, the Paducah Planning Commission of the City of Paducah adopted a resolution recommending to the Mayor and Board of Commissioners of the City of Paducah closure of the aforesaid public way. 341 C. Written notice of the proposed closing was given to all property owners in or abutting the public way or the portion thereof being closed as is evidenced by the application for street and/or alley closing which is attached hereto and made a part hereof. D. All property owners in or abutting the public way or the portion thereof being closed have given their written notarized consent to the closing as is evidenced by the application for street and/or alley closing which is attached hereto and made a part hereof. SECTION 3. All requirements of KRS 82.405(1) and (2) having been met, the Board of Commissioners of the City of Paducah hereby concludes that the aforesaid public way, as described above, should be closed in accordance with the provisions of KRS 82.405. SECTION 4. The Mayor is hereby authorized, empowered, and directed to execute a quitclaim deed from the City of Paducah to each of the property owners in or abutting the public way to be closed with each to acquire title to that portion of the public way contiguous to the property now owned by said property owners up to centerline of the said public way. Provided, however, that the City shall reserve such easements upon the above described real property as it deems necessary. Said deed shall provide the reservation by the City of Paducah any easements affecting the herein described real property as described in Section 1 above. SECTION 5. The Mayor is further authorized to sign the plat of survey of the proposed street closing. SECTION 6. This ordinance shall be read on two separate days and will become effective upon summary publication pursuant to KR ATTEST: Tammara S. Brock, Asst.
