Petition St.Commissioner Pulliam offered motion that the Loard of Commissioners receive and Light-Bothel & Division + file the petition signed by N. R. Lathes, Pastor, and I:. R. Mathes, et al., members r of the Church of Jesus Christ, requesting the installation of a street light at the hcorner near said church, and that the City I;anager be requested to make an lnvestigati i 1and have the light installed if he finds that the present lighting is insufficient ane ! therd are available th.e materials necessary to have the work done. "owlinr v 'layer Seaton offered the following motion: Pursuant to a motion adopted by .iecre tat ional ^halrzlan the board of Commissioners at its meeting on September 26th, 19442 I hereby appoint Van D. Eowling to serve as Chairman of a Committee to be known as the dak Recreationsl Committee of Paducah, Kentucky, said Committee to consist of six additional members appointed by the Chairman with the approval of the gayer and to function f; Lhe purpo�es outlined by :'.r. Y.arvin W. Krieger, State Representative of the Federal Security Agencyl Adopted on call of the Roll, Yeas, Commissioners Johnston, Pierce, Pulliam and payor Seaton (4). Levi Chilton Mayor Seaton made the following a;pointment: appointed y' Board of George Steinhauer having declined to serve as a member of the Board of Adjustment Adjustment, City Planning & Zoninr Commission, after his appointment on August 15, 1941; i; I therefore appoint Levi Chilton to serve as a member of said Board in the place and stead of :,eorge Steinhauer, so that said board as now constituted shall con- sist of the following members; 7,'.J.Pierce, Levi Chilton, 1W. Letter of ✓ Mayor Seaton offered motion that the board of Commissioners receive and file Elmer Frown, the letter of Slmer L. r_rown in which he states that he has no objection to the dismis al of the action instituted by him on October 30th, 1941, against the City of Paducah, Kentucky, the L;ayor and the members of the Board of Commissioners then serving, the Y.ayor and the members of the Board of Commissioners who served du,•ing prior adminis- trations, together with the Surety of the several officials who were joined as defendants. Brown did not file a Response to their answer anu failed to take any further steps to prosecute the action instituted by him; 1 Now therefore, I move that the Board of Commissioners decline to prosecute said action in which they were joined as defendants for the reason that it does not have the legal right to proceed against an official elected by the people, and that the coard further aoprove the dismissal of this suit against all of the defendants who are i joined in the action provided it is dismissed at the cost of the plaintiff.
