Proceedings of Board of Commissioners City of Paducah October 3rd, 1944
At a Regular I:eeting of the coard of Commissioners held in the Commissioners'
lyi Chamber at the City Hall, Paducah, Kentucky, at 8:00 o'clock P.M. on October 3, 1944,
G L..ayor Seaton presided and upon call of the Roll the following answered to their names:

Petition St.Commissioner Pulliam offered motion that the Loard of Commissioners receive and

Van D. Eowling to serve as Chairman of a Committee to be known as the dak Recreationsl
Committee of Paducah, Kentucky, said Committee to consist of six additional members
appointed by the Chairman with the approval of the gayer and to function f; Lhe purpo�es
outlined by :'.r. Y.arvin W. Krieger, State Representative of the Federal Security Agencyl

sist of the following members;

of the action instituted by him on October 30th, 1941, against the City of Paducah,
Kentucky, the L;ayor and the members of the Board of Commissioners then serving, the
Y.ayor and the members of the Board of Commissioners who served du,•ing prior adminis-
trations, together with the Surety of the several officials who were joined as

City ranaZer have the richt to interfere with tho administration of the affairs of the
judicial department of the city; and,

:X EREAS, said attorney having also advised the Board of Commiasionora that the
said Virginia Cornelison Sanderson and Joan Cornelison Ford while serving as Clorks
of the police court, wdro employees of the City Judge and were not answerable to any
other official for the proper discharge of their duties; and,
it :HEREAS, after the City of fadacah and the various officials who were joined as

defendants filed an answer stating the above facts and that they were not in any way
responsible if the police judge, an elective officer; failed to property perform the
duties of his office, the said Elmer L. Brown did not file a Response to their answer
anu failed to take any further steps to prosecute the action instituted by him; 1
Now therefore, I move that the Board of Commissioners decline to prosecute
said action in which they were joined as defendants for the reason that it does not
have the legal right to proceed against an official elected by the people, and that the
coard further aoprove the dismissal of this suit against all of the defendants who are

joined in the action provided it is dismissed at the cost of the plaintiff. Adopted
