AN ORDINANCE AUTHORIZING THE MAYOR TO ENTER INTO
AN ENCROACHMENT AGREEMENT BETWEEN THE CITY OF PADUCAH AND
TRANSMONTAIGNE PRODUCT SERVICES INC., FOR AN ENCROACHMENT
UPON A PORTION OF CITY OF PADUCAH FLOODWALL RIGHT-OF-WAY
/ LOCATED AT 233 ELIZABETH STREET
` WHEREAS, TransMontaigne Product Services, Inc., is the owner of
property located at 233 Elizabeth Street known as TransMontaigne Product Services Inc.
Paducah River Terminal, situated in McCracken County, Paducah, Kentucky; and
WHEREAS, the City of Paducah is the owner of a floodwall right of way
described in Deed Book 200 at page 385 and Deed Book 204 at page 581 that is located
adjacent to the Terminal, situated in McCracken County, Paducah, Kentucky; and
WHEREAS, TransMontaigne is desirous of encroaching upon and
utilizing a portion of the Right of Way; and
WHEREAS, the City is desirous of permitting the aforesaid encroachment
by Grantee; and
WHEREAS, the City of Paducah and TransMontaigne Product Services,
Inc., have now entered into an agreement pertaining to the foregoing and do desire that
same be set forth in writing and be made part of the public records of the City of
Paducah, Kentucky, and recorded in the office of the County Court Clerk of McCracken
County, Kentucky.
BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. That the Mayor is hereby authorized to enter into an
Encroachment Agreement with TransMontaigne Product Services, Inc., for a vapor
combustion unit and a refined petroleum pipeline to be located upon a portion of City of
Paducah floodwall right-of-way located at 233 Elizabeth Street.
SECTION 2. This ordinance shall be read on two separate days and will
become effective upon summary publication pursuant to IRS Chapter 424.
