This stook 0 seams to me has boon wiped out by the foreclosure sale through whish the property was cold for the payment of the bonded debt of the company. . The Pdduosh, Tonnonsee h Alabama Railroad Company, In order to raise funds to oon- struot Its rood, issued a caries of bonds secured by s mortgage on Its railroad property, franchises, oto. Default was made In the payment of the Sntreet.on these bonds and thn St. Louie Trust Company as Trustee, in I89� filed a bill In the Circuit Court of thr United States for the District of Kentucky at Paducah. A decree of foreclosure was rendered July I0th•I895 and this property was sold., the purchaser being J.R•Phil).ipa• The special motors appointed by the Court exooutdd a dead to Phillipe, which Is registorad In McCracken County, Kentucky, In Book 50, pago 542. It was also registered In Graves, Marshall end Calloway Counties. She Reosivare of the company also executed s deed to Phillips, which is registered in Rook 506 page553, McCracken County, I ' J•W.Phillipo, the purchaser under the foreclosure proceedings, sold the road to the 'Louisville h Nashville Railroad Comp". and the latter executed a lease to the Nashville Chattanooga h St. Louis Railway. Undor all of the facts, I am of the opinion that the stock of the Old P•T.h A•Railroad was wiped out by the foreclosure proceedings, and in of no value. The Nashville, Chattanooga h St. Lodle Railway does not own the property, but is oporst'ng It under the lease an ntnted above from the I,ouieville h Nashville Railroad Company.
