ORDINANCE NO. 2002-5-6516 AN ORDINANCE AMENDING SECTION 14-7, OF THE CODE OF ORDINANCES OF THE CITY OF PADUCAH WHEREAS, the Board of Commissioners finds it necessary to enact an ordinance relating to the abandonment and maintenance of animals within the City for the public health, safety, and peace; and WHEREAS, the Board of Commissioners believes this ordinance is necessary to ensure that the City is capable of addressing the problems created by abandonment and inadequate maintenance of animals by their owners; and WHEREAS, the Board of Commissioners finds that an emergency exists with respect to the current law as it pertains to the abandonment and maintenance of animals within the City of Paducah. KENTUCKY: NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF PADUCAH, SECTION 1. That Section 14-7 is hereby amended to read as follows: Sec. 14-7. Cruelty to animals; authority to impound; and redemption of impounded animals. La) No person shall unnecessarily or cruelly beat, torture, abuse, or otherwise mistreat any horse or other animal, whether his own or that of another. (b) No person shall abandon any animal. Abandonment shall consist of leaving such animal for a period in excess of twenty-four (24) hours without providing food and water, as well as someone to monitor the animal's condition and well-being. Abandonment shall also include leaving an animal on either public or private property whether occupied or unoccupied without the property owner's consent. (c) Any animal found to have been cruelly beaten, tortured, abused, abandoned, or otherwise mistreated shall be subject to seizure and impoundment by the city. (d) Redemption of animals impounded pursuant to this Section shall be _governed by the provisions of Section 14-38. SECTION 2. Pursuant to KRS 83A.060, the City Commission suspends the requirement of a second reading of this ordinance. As grounds therefor, the City Commission does hereby declare an emergency to exist as to the current status of animal abandonment and maintenance within the City.
