HomeMy WebLinkAbout2001-6-636376 ORDINANCE NO. 2001-6- 603 63 AN ORDINANCE APPROVING THE FINAL REPORT OF THE PADUCAH PLANNING COMMISSION ON THE PROPOSED ZONE CHANGE FOR PROPERTIES LOCATED AT 2701 AND 2731 WASHINGTON STREET AND 2735 KENTUCKY AVENUE, AND AMENDING THE PADUCAH ZONING ORDINANCE SO AS TO EFFECT SUCH REZONING BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That a resolution passed by the Paducah Planning Commission on May 21, 2001, and entitled, "A RESOLUTION CONSTITUTING THE FINAL REPORT OF THE PADUCAH PLANNING COMMISSION ON THE PROPOSED ZONING CHANGE FOR PROPERTIES LOCATED AT 2701 AND 2731 WASHINGTON STREET AND 2735 KENTUCKY AVENUE," be approved as the final report of said Commission respecting the matters therein set forth. SECTION 2. That the zone classification and the map amendment proposed in said resolution be, and the same are hereby, declared to be in agreement with the comprehensive plan of the City of Paducah. SECTION 3. That the zone classification of 2701 and 2731 Washington Street be, and it is hereby, changed from R-2 (Low & Medium Density Residential Zone), to H -M, (Hospital Medical Zone) and 2735 Kentucky Avenue be, and it is hereby changed from R-4, (High Density Residential Zone) to H -M (Hospital Medical Zone): PARCEL NO. 3 — 2701 Washington Street BEGINNING WHERE THE CENTER LINE OF WASHINGTON STREET INTERSECTS THE CENTER LINE OF SOUTH 27TH STREET; THENCE IN A SOUTHWESTERLY DIRECTION ALONG AND WITH SAID CENTER LINE OF WASHINGTON STREET; 105.00 FEET TO THE PROJECTED NORTHEASTERLY LINE OF ANOTHER PARCEL OF LAND PRESENTLY OWNED BY BAPTIST HEALTHCARE SYSTEMS, INC., AS INDICATED BY DOCUMENT OF RECORD IN DEED BOOK 876, PAGE 567 OF THE MCCRACKEN COUNTY COURT CLERK'S OFFICE; THENCE LEAVING SAID CENTER LINE AND IN A NORTHWESTERLY DIRECTION PROCEED ALONG THE AFORESAID PROJECTED NORTHEASTERLY LINE 206.25 FEET TO THE INTERSECTION WITH THE CENTER LINE OF A 24 FOOT WIDE PUBLIC ALLEY; THENCE IN A NORTHEASTERLY DIRECTION ALONG AND WITH THE CENTER LINE OF SAID ALLEY, 105.00 FEET TO THE INTERSECTION WITH THE CENTER LINE OF SOUTH 27TH STREET; THENCE IN A SOUTHWESTERLY DIRECTION ALONG AND WITH THE CENTER LINE OF SAID STREET, 206.25 FEET TO THE POINT OF BEGINNING AND CONTAINING 21,656 SQUARE FEET OR 0.497 ACRES. PARCEL NO.2 — 2731 Washington Street BEGINNING WHERE THE SOUTHWESTERLY LINE OF THE HEREIN DESCRIBED PROPERTY INTERSECTS THE CENTER LINE OF WASHINGTON STREET, SAID POINT BEING LOCATED 80.00 FEET NORTHEAST OF THE POINT OF INTERSECTION OF THE CENTER LINE OF WASHINGTON STREET WITH THE CENTER LINE OF SOUTH 28TH STREET; THENCE FROM SAID POINT OF BEGINNING, LEAVING SAID CENTER LINE OF WASHINGTON STREET AND PROCEEDING ALONG AND WITH THE PROJECTED NORTHEASTERLY LINE OF A PARCEL OF LAND PRESENTLY OWNED BY BAPTIST HEALTHCARE SYSTEMS, INC., AS INDICATED BY DOCUMENT OF RECORD IN DEED BOOK 787, PAGE 547 OF THE MCCRACKEN COUNTY COURT CLERK'S OFFICE, 206.25 FEET TO THE CENTER LINE OF A 24 FOOT WIDE PUBLIC ALLEY; THENCE IN A NORTHWESTERLY DIRECTION ALONG AND WITH SAID CENTER LINE OF ALLEY, 50.00 FEET TO THE INTERSECTION WITH THE PROJECTED SOUTHWESTERLY LINE OF ANOTHER TRACT OF LAND PRESENTLY OWNED BY BAPTIST 77 HEALTHCARE SYSTEMS, INC., AS INDICATED BY DOCUMENT OF RECORD IN DEED BOOK 882, PAGE 261 OF THE AFORESAID CLERK'S OFFICE; THENCE IN SOUTHEASTERLY DIRECTION ALONG AND WITH SAID SOUTHWESTERLY LINE AND A PROJECTION THEREOF, 206.25 FEET TO THE CENTER LINE OF WASHINGTON STREET; THENCE INA SOUTHWESTERLY DIRECTION ALONG AND WITH SAID CENTER LINE OF SAID STREET, 50.00 FEET TO THE POINT OF BEGINNING AND CONTAD41NG 10,312.5 SQUARE FEET OR 0.237 ACRES. PARCEL NO. 1 - 2735 Kentucky Avenue BEGINNING WHERE THE CENTER LINE OF SOUTH 28TH STREET INTERSECTS THE CENTER LINE OF KENTUCKY AVENUE; THENCE IN A NORTHWESTERLY DIRECTION ALONG AND WITH THE CENTER LINE OF SAID SOUTH 28TH STREET 206.25 FEET TO THE INTERSECTION WITH THE CENTER LINE OF A 24 FOOT WIDE PUBLIC ALLEY; THENCE IN A NORTHEASTERLY DIRECTION ALONG AND WITH SAID CENTER LINE OF A 24 FOOT WIDE PUBLIC ALLEY; THENCE IN A NORTHEASTERLY DIRECTION ALONG AND WITH SAID CENTER LINE OF ALLEY, 130.00 FEET TO THE INTERSECTION WITH THE SOUTHWESTERLY LINE OF A PARCEL OF LAND PRESENTLY OWNED BY BAPTIST HEALTHCARE SYSTEMS, INC., D.B.A. WESTERN BAPTIST HOSPITAL, IF SAID SOUTHWESTERLY LINE WERE PROJECTED IN A NORTHWESTERLY DIRECTION, SAID PARCEL OF LAND BEING DESCRIBED UNDER TRACT NO. 1 OF THE DOCUMENT OF RECORD IN DEED BOOK 895, PAGE 767 OF THE MCCRACKEN COUNTY COURT CLERK'S OFFICE; THENCE IN A SOUTHEASTERLY DIRECTION ALONG AND WITH SAID SOUTHWESTERLY LINE AND A PROJECTION THEREOF, 2-06.25 FEET TO THE CENTER LINE OF KENTUCKY AVENUE THENCE IN A SOUTHWESTERLY DIRECTION ALONG AND WITH SAID CENTER LINE OF SAID KENTUCKY AVENUE, 130.00 FEET TO THE POINT OF BEGINNING AND CONTAINING 26,812.5 SQUARE FEET OF 0.616 ACRES. SECTION 4. That if any section, paragraph or provision of this ordinance shall be found to be inoperative, ineffective or invalid for any cause, the deficiency or invalidity of such section, paragraph or provision shall not affect any other section, paragraph or provision hereof, it being the purpose and intent of this ordinance to make each and every section, paragraph and provision hereof separable from all other sections, paragraphs and provisions. SECTION 5. This ordinance shall be read on two separate days and will become effective upon summary publication pursuant to KRS Chanter 424.
