HomeMy WebLinkAbout2004-8-6855217 ORDINANCE NO. 2004-8-6855 AN ORDINANCE PROVIDING FOR THE NEED FOR ACQUIRING A PORTION OF TWO PROPERTIES BELONGING TO MICHAEL SHELTON TAPSCOTT AND WIFE, LISA TAPSCOTT, AND TO THE ESTATE OF WILIMINA GRAMSE ULLERICH, TO BE USED BY THE CITY OF PADUCAH TO CREATE A PUBLIC GREENWAY NATURE TRAIL, AND AUTHORIZING THE CONDEMNATION OF SAME WHEREAS, the City of Paducah desires to create a public `Greenway Nature Trail' system to connect its Parks system; and WHEREAS, the following described real property is needed by the City of Paducah, Kentucky in furtherance of the public purpose of the City of Paducah to create a public `Greenway Nature Trail'; and WHEREAS, the City of Paducah has been unable to contract or agree with the owners thereof for the acquisition or purchase of the real property sought to be condemned; and WHEREAS, the Board of Commissioners of the City of Paducah, Kentucky, do hereby authorize the condemnation of the herein described real property pursuant to the Kentucky Revised Statutes. NOW, BE IT ORDAINED, by the City of Paducah, Kentucky, as follows: Section 1. That the corporate counsel of the City of Paducah, Kentucky be and is hereby ordered and directed to institute condemnation proceedings in the McCracken Circuit Court in the name of the City of Paducah, Kentucky against Michael Shelton Tapscott and Lisa Tapscott, and against the Estate of Wilimina Gramse Ullerich, and all other parties at interest to acquire the necessary subject property owned by the aforesaid persons. Section 2. The portions of the property to be acquired are in McCracken County, Kentucky, and are more particularly described as being a portion of the property of Michael Shelton Tapscott and Lisa Tapscott as described in deed dated November 8, 2001, in Deed Book 968, Page 536, McCracken County Court Clerk's Office, and a portion of the property of the Estate of Wilimina Gramse Ullerich as described in deed dated August 18, 1949, in Deed Book 282, Page 34, McCracken County Court Clerk's Office, and more particularly being approximately two hundred feet in width running along and with the southerly property lines of those properties, with the legal description of those portions to be determined by survey. Section 3. This Ordinance shall be read on two separate dates and will become effective upon summary publication pursuant to KRS 424.
