HomeMy WebLinkAbout2004-3-677245 ORDINANCE NO. 2004-3-6772 AN ORDINANCE APPROVING THE FINAL REPORT OF THE PADUCAH PLANNING COMMISSION RESPECTING THE PROPOSED SUBDIVISION OF PROPERTY OF THE PADUCAH/MCCRACKEN COUNTY INDUSTRIAL DEVELOPMENT AUTHORITY FOR PROPERTY LOCATED ADJACENT TO COMMERCE DRIVE, AND DEDICATION OF PUBLIC RIGHT OF WAY, STREETS AND PUBLIC EASEMENTS WHEREAS, by Resolution dated February 16, 2004, the Paducah Planning Commission, adopted a plat of the proposed subdivision of property of the Paducah/McCracken County Industrial Development Authority located adjacent to Commerce Drive, and recommended to the Board of Commissioners of the City of Paducah, Kentucky, the adoption of an ordinance approving the final plat of said subdivision reflected thereon, and accepting the dedication of public right of way, streets and public easements shown thereon; and WHEREAS, the City Engineer by letter dated February 23, 2004, stated that all requirements had been completed in accordance with the subdivision plan and the City's specifications and hereby recommends the acceptance of the aforesaid subdivision plat. BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That a resolution adopted by the Paducah Planning Commission on February 16, 2004, entitled, "A RESOLUTION CONSTITUTING THE FINAL REPORT OF THE PADUCAH PLANNING COMMISSION ON THE PROPOSED SUBDIVISION OF INDUSTRIAL PARK AUTHORITY FOR PROPERTY LOCATED ADJACENT TO COMMERCE DRIVE", be approved as the final report of said Commission respecting the matters set forth therein. SECTION 2. That the subdivision of said property shall be, and it is hereby, approved as shown on the plat referred to in said subdivision, which plat is entitled, "Industrial Park West Phase 11 ROW Dedication & Final Subdivision", and said property is hereby declared to be subdivided as shown on said plat. SECTION 3. That the dedication of the public right-of-way, streets, and public easements shown on said plat shall be, and they are hereby, accepted and shall be maintained by the City of Paducah. The Mayor is hereby authorized to subscribe a certificate of approval on the plat. SECTION 4. That if any section, paragraph or provision of this ordinance shall be found to be inoperative, ineffective or invalid for any cause, the deficiency or invalidity of such section, paragraph or provision hereof, it being the purpose and intent of this ordinance to make each and every section, paragraph or provision hereof, it being the purpose and intent of this ordinance to make each and every section, paragraph and provision hereof separable from all other sections, paragraphs and provisions. SECTION 5. This ordinance shall be read on two separate days and will become effective upon summary publication according to KRS Chapter 424. ATTEST: J`.r - Tammara S.
