AN ORDINANCE RATIFYING AND APPROVING THE MAYOR'S
EXECUTION OF AN ACKNOWLEDGMENT AND GUARANTY AGREEMENT BETWEEN
THE CITY OF PADUCAH, KENTUCKY, KENTUCKY OAKS MALL COMPANY AND
MCCRACKEN COUNTY, KENTUCKY FOR SANITARY SEWER MAINS ASSOCIATED
STRICTLY WITH THE KENTUCKY OAKS MALL COMPLEX
BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. That the City of Paducah hereby ratifies and approves the Mayor's
execution of an Acknowledgment and Guaranty Agreement between the City of Paducah,
Kentucky, Kentucky Oaks Mall Company and McCracken County, Kentucky, for assurance that
the Mall's sewer mains will not experience any diminished capacities nor will the City restrict
future mall development with respect to the existing sanitary sewer facilities.
SECTION 2. Pursuant to KRS 83A.060, the City Commission suspends the
requirement of a second reading and publication of this Ordinance. As grounds therefore, the
City Commission does hereby declare an emergency to exist as to the execution of this
Agreement. Specifically, to assist the Paducah McCracken County Joint Sewer Agency with the
expeditious execution and recording of an Amendment to Reformation of Easement Agreement.
SECTION 3. This Ordinance shall become effective upon the first reading of this
Ordinance.
