ORDINANCE NO. 2006-5-7119 AN ORDINANCE AUTHORIZING AND DIRECTING THE FINANCE DIRECTOR TO PAY THE SUM OF $25,000 TO THE MCCRACKEN CIRCUIT COURT CLERK, TO BE HELD IN ESCROW FOR CONSTRUCTION OF PECAN DRIVEBUCKNER LANE ROADWAY IMRPOVEMENT PROJECT WHEREAS, condemnation action has been initiated by the City of Paducah, Kentucky, against John P. Fales, et al, in McCracken Circuit Court concerning the acquisition of right of way for the Pecan Drive/Buckner Lane Roadway Improvement Project; and WHEREAS, an Interlocutory Decree and Order has been authorized by the court for the City to gain access to the Fales property upon the posting of $25,000 Escrow to be held by the Court. BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That the Finance Director is authorized and directed to pay the sum of $25,000 to the McCracken Circuit Court Clerk, to be held in escrow for construction of the Pecan Drive/Buckner Lane Roadway Improvement Project, pursuant to the Agreed Interlocutory Judgment and Order, entered in McCracken Circuit Court in this case. SECTION 2. This expenditure shall be charged to project account ST0021. -' SECTION 3. Pursuant to KRS 83A.060, the City Commission suspends the requirement of a second reading and publication of this Ordinance. As grounds therefore, the City Commission does hereby declare an emergency to exist due to the necessity to proceed with construction and to minimize disruption to the adjacent residents. SECTION 4. This Ordinance shall become effective upon the first reading of this Ordinance. Mayor ATTEST: Tammara S.
