HomeMy WebLinkAbout2006-5-7114ME ORDINANCE NO. 2006-5-7114 AN ORDINANCE AMENDING CHAPTER 98, STREETS, SIDEWALKS AND OTHER PUBLIC PLACES OF THE CODE OF ORDINANCES OF THE CITY OF PADUCAH, KENTUCKY BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY: C11 SECTION 1. That Sec. 98-189, "Standards for Issuance", of Chapter 98, "Streets, Sidewalks, and Other Public Places," of the Code of Ordinances of the City of Paducah, Kentucky, is hereby amended to read as follows: "Sec. 98-189. Standards for issuance. The City Manager or his designee shall issue a general assembly permit when, from a consideration of the application and from such other information as may be otherwise obtained, he finds that: (1) The conduct of the general assembly will not be inimical to the health, welfare, and safety of the general public which may be affected by the event. (2) The conduct of the general assembly will not present an undue burden upon the provision of municipal services such as police, fire, engineering, inspection, and sanitary services. (3) The conduct of the general assembly will not unreasonably obstruct traffic. (4) The conduct of the general assembly will not unreasonably interfere with the general public's use of the area. (5) The applicant has obtained a business license if required under [chapter] 106 of the Paducah Code of Ordinances. (6) The applicant has provided sufficient indemnity to the city." SECTION 2. That Sec. 98-198, "Exceptions," of Chapter 98, "Streets, Sidewalks, and Other Public Places," of the Code of Ordinances of the City of Paducah, Kentucky, is hereby amended to read as follows: (1) Notwithstanding the provisions of sections 98-186 and 98-187 above, and as an exception thereto, merchants who regularly engage in a business at a business site located within the permit area shall have the right to utilize the sidewalk in front of the merchant's business site in accordance with section 98-6. The merchant shall also have the authority to permit another vendor to display and sell merchandise on the sidewalk in front of the merchant's business site, provided that such vendor displays and sells similar merchandise which is displayed and sold by the merchant, and provided further that the vendor obtain a business license under chapter 106 of the Paducah Code of Ordinances. (2) Notwithstanding the provisions of sections 98-186 and 98-187 above, and as an exception thereto, the owner of any bank or business site which is not in the business of displaying and selling merchandise which is located within the permit area shall have the authority to permit charitable organizations or youth entrepreneurs to utilize the sidewalk in front of such bank or business site for the display and sale of merchandise, provided that the merchandise displayed and sold is not the same merchandise displayed and sold by any merchant which is directly contiguous to the bank or business site. (3) Peddlers and solicitors shall be restricted from all General Assemblies unless allowed by the General Assemblies permit. KII SECTION 3. Pursuant to KRS 83A.060, the City Commission suspends the requirement of a second reading and publication of this Ordinance. As grounds therefore, the City Commission does hereby declare an emergency to exist in order to avoid disruption of the Downtown After Dinner program. SECTION 4.
