AN ORDINANCE AUTHORIZING THE TRANSFER OF FUNDS FOR
THE CONSTRUCTION AND INSTALLATION OF A SKATEPARK IN NOBLE
PARK FOR THE CITY OF PADUCAH, KENTUCKY; AUTHORIZING THE
FINANCE DIRECTOR MAKE PAYMENT FOR SAID SKATEPARK, AND
AUTHORIZING THE MAYOR TO EXECUTE A CONTRACT FOR SAME
WHEREAS, a written determination has been made by the City Manager
that the concrete modular unit with bowls is the approved skatepark unit recommended
by the Skatepark Committee and the only designated agent is Skate Concepts; therefore
making this a sole source purchase pursuant to Sec. 2-659 of the Code of Ordinances of
the City of Paducah, Kentucky.
BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. That the Finance Director is authorized to pay an amount
not to exceed $277,000 to Skate Concepts for the purchase and installation of a concrete
modular unit with bowls for a skatepark to be located in Noble Park in the City of
Paducah, in compliance with Sec. 2-659, Noncompetitive Negotiations, of the Code of
Ordinances of the City of Paducah, Kentucky.
SECTION 2. The Mayor is hereby authorized to execute a contract with
Skate Concepts, for the purchase and installation of the skatepark authorized in Section 1
above.
SECTION 3. The Finance Director is hereby authorized to transfer
$29,000 from the Investment Fund account and the expenditure shall be charged to
Project Account PA0044.
SECTION 4. Pursuant to KRS 83A.060, the City Commission suspends the
requirement of a second reading and publication of this Ordinance. As grounds therefore, the
City Commission does hereby declare an emergency to exist as to the execution of this
Agreement. Specifically, due to completion of the skatepark in a timely manner this
construction season and for the provision of seasonal recreational activities.
SECTION 5. This Ordinance shall become effective upon the first reading
of this Ordinance.
