HomeMy WebLinkAbout2006-3-7094657 ORDINANCE NO. 2006-3-7094 AN ORDINANCE APPROVING THE FINAL REPORT OF THE PADUCAH PLANNING COMMISSION RESPECTING THE PROPOSED FINAL SUBDIVISION OF PROPERTY OF HIGDON DEVELOPMENT & COLEMAN ROAD DEVELOPMENT LOCATED AT 3245-3345 COLEMAN ROAD, ACCEPTING THE DEDICATION OF RIGHT- OF-WAY AND PUBLIC EASEMENTS WHEREAS, the Paducah Planning Commission, at a meeting held on December 19, 2005, adopted as a preliminary report a plat of the proposed subdivision of property of Higdon Development & Coleman Road Development for property located at 3245 – 3345 Coleman Road, and by Resolution dated March 6, 2006, recommended to the Board of Commissioners of the City of Paducah, Kentucky, the adoption of an ordinance approving the final plat of said subdivision reflected thereon, and accepting the dedication of right-of-way and public easements shown thereon; and WHEREAS, the City Engineer has recommended an escrow agreement in the amount of $380,000 for completion of Coleman Crossing Circle, Storm drainage improvements, and all other designated public improvements within the subdivision. BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That a resolution adopted by the Paducah Planning Commission on March 6, 2006, entitled, "A RESOLUTION CONSTITUTING THE FINAL REPORT OF THE PADUCAH PLANNING COMMISSION ON THE PROPOSED SUBDIVISION OF HIGHDON DEVELOPMENT & COLEMAN ROAD DEVELOPMENT FOR PROPERTY LOCATED AT 3245-3345 COLEMAN ROAD", be approved as the final report of said Commission respecting the matters set forth therein. SECTION 2. That the subdivision of said property shall be, and it is hereby, approved as shown on the plat referred to in said subdivision, which plat is entitled, "Final Subdivision Plat—Coleman Crossing Circle—Coleman Crossing", and said property is hereby declared to be subdivided as shown on said plat. SECTION 3. That the dedication of the public right-of-way and public utility easements shown on said plat shall be, and they are hereby, accepted. The Mayor is hereby authorized to subscribe a certificate of approval on the plat. SECTION 4. That the Board of Commissioners approves the recommendation of the City Engineer to accept an escrow agreement in the amount of $380,000 for completion of the public roadway, and all other public improvements, utilities and infrastructure, including but not limited to grading, drainage, and paving and authorizes the Mayor to execute said agreement. SECTION 5. That if any section, paragraph or provision of this ordinance shall be found to be inoperative, ineffective or invalid for any cause, the deficiency or invalidity of such section, paragraph or provision hereof, it being the purpose and intent of this ordinance to make each and every section, paragraph and provision hereof separable from all other sections, paragraphs and provisions. r,,.. .. ...«� ..i ,.,■ E,.::���.xe...�xr �u,�.:wa-�. �,i vd—L—., m.
