HomeMy WebLinkAbout2006-3-7079ORDINANCE NO. 2006-3-7079 AN ORDINANCE CREATING SECTION 126-84, AWNINGS & CANOPIES, OF CHAPTER 126, ZONING, OF THE CODE OF ORDINANCES OF THE CITY OF PADUCAH, KENTUCKY BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That Section 126-84, Awnings & Canopies, of Chapter 126, Zoning, of the Code of Ordinances of the City of Paducah, Kentucky, is hereby created to read as follows: 126-84. Awnings & Canopies. a) Awnin ss/pies shall be permitted in all zoning districts within the City of Paducah subject to the following requirements. b) Awnin s/g Canopies on private property. Awnings/Canopies on private property shall meet the minimum yard quirements of the zone in which the awning is proposed to be located. C) Awnings/Canopies over public areas. Awnings/Canopies overup blic areas in the City shall be arranged without posts and shall provide a clearance of not less than seven feet from sidewalk to the lowest point of the framework, awning cover, including any fringe, apron, skirt, valance or drop. No awnings/canopies above sidewalk shall be closer to the vertical plane of the curb than two feet and in no case shall any awning/canopy project from the face of the building more than eight t feet. Awnin s/g_ Canopies within the B -2-T & B-2 zoning districts shall protrude no further than four feet from the face of the building The Chief Building? Inspector may waive the four feet dimension when sufficient evidence has been submitted that the proposed awnings/canopies will not interfere with the emergency access to underground power sources. d) Application. No awnings/canopies, except as specifically exempted herein, shall be displayed, erected, relocated or altered until a permit has been issued by the Department of Inspection. An application for a permit shall include, but shall not be limited to the following: (1) A completed application form. (2) A site plan and/or building elevations drawn to scale showing the locations of the proposed location of the awnin s/g canopies on the lot and/or building, including setbacks. (3) Detailed awning information includingtape of construction, method of installation and or erecting and other similar information. SECTION 2. That if any section, paragraph or provision of this Ordinance shall be found to be inoperative, ineffective or invalid for any cause, the deficiency or invalidity of such section, paragraph or provision shall not affect any other section, paragraph or provision hereof, it being the purpose and intent of this Ordinance to make each and every section, paragraph, an provision hereof separable from all other sections, paragraphs and provisions. 639 SECTION 3.
