HomeMy WebLinkAbout2012-9-7970151549 ORDINANCE NO. 2012-9-7970 AN ORDINANCE AUTHORIZING AND APPROVING THE TRANSFER OF OWNERSHIP OF THE REAL PROPERTIES LOCATED AT 427 N. 6TH STREET; 421 N. 5TH STREET; 625 N. 6TH STREET; 717 HARRISON; 517 N. 7TH STREET; 511-517 N. 5TH STREET AND 533 MADISON � STREET, ALL LOCATED WITHIN THE CITY OF PADUCAH, KENTUCKY, FROM FRIENDS OF MAIN STREET, INC., TO THE CITY OF PADUCAH, KENTUCKY, FOR THE USE AND BENEFIT OF THE MAIN STREET DEPARTMENT OF THE CITY OF PADUCAH WHEREAS, the Board of Commissioners of the City of Paducah has determined that it is necessary, appropriate, or in the best interest of the City to approve the transfer of ownership of the real properties located at 427 N. 6th Street; 421 N. 5th Street; 625 N. 6th Street; 717 Harrison; 517 N. 7th Street; 511-517 N. 5th Street and 533 Madison Street, all located in, Paducah, McCracken County, Kentucky which are more particularly described on Exhibit "A," attached hereto (collectively the "Property"), from Friends of Main Street, Inc. BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY: SECTION 1. The Board of Commissioners of the City of Paducah hereby approves and consents to the transfer of ownership of the Property from Friends of Main Street, Inc., to the City of Paducah, Kentucky for the use and benefit of the Main Street Department of the City of Paducah (the "City) for nominal consideration. The Board of Commissioners further acknowledges the request of the Board of Directors of Friends of Main Street, Inc., and the Paducah Renaissance Alliance Advisory Board that the City of Paducah use its best efforts to sell and convey the Property to qualified candidates under the Artist Relocation Recruitment Program. Qualifying emphasizes successful art business model. The artist must be able to demonstrate that their business produces sufficient sales and clients to support the artist while living/working in Paducah. Special consideration will be granted to galleries and businesses that are "open to the public" and maintain a minimum number of "open" hours. SECTION 2. Corporate Counsel is authorized to prepare the general warranty deed and any other documents necessary to accomplish and consummate the transfer of the Property from Friends of Main Street, Inc., to the City in accordance with this Ordinance. It is further determined that the Mayor, on behalf of the City of Paducah, Kentucky, is hereby authorized to execute the general warranty deed and any other documents necessary to accept the fee ownership of the Property in accordance with this Ordinance. SECTION 3. If any section, paragraph or provision of this Ordinance shall be held to be invalid or unenforceable for any reason, the invalidity or unenforceability of such section, paragraph or provision shall not affect any of the remaining provisions of this Ordinance. SECTION 4. All ordinances, resolutions, orders or parts thereof in conflict with the provisions of this Ordinance are, to the extent of such conflict, hereby repealed and the provisions of this Ordinance shall prevail and be given effect.
