ORDINANCE NO. 2005-12-7056
AN ORDINANCE AUTHORIZING AND DIRECTING THE MAYOR TO EXECUTE
AN AGREEMENT FOR PROFESSIONAL LEGAL SERVICES ASSOCIATED WITH THE
REBANDING OF THE 800MHz RADIO SYSTEM
WHEREAS, the FCC has mandated a nationwide 800 MHz rebanding project for the
purpose of separating the public safety radio frequencies from the private cellular radio frequencies; and
WHEREAS, all expenses associated with the FCC mandated rebanding will be covered
by Nextel Communications, Inc. and/or the FCC appointed Transition Administrator; and
WHEREAS, expenses for professional legal services that may be required outside the
covered scope of legal expenses necessary for the FCC mandate will be the responsibility of the City; and
WHEREAS, Shulman, Rogers, Gandal, Pordy, & Ecker, P.A., has in its employ persons
experienced in this area of expertise.
BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. That the Mayor of the City of Paducah is hereby authorized and directed to
execute an Attorney -Client Agreement with Shulman, Rogers, Gandal, Pordy & Ecker, P.A. for
professional legal services related to the re -banding of the City's 800 MHz radio system that are outside
the responsibility of Nextel Communications, Inc. and/or the FCC appointed Transition Administrator.
SECTION 2. Shulman, Rogers, Gandal, Pordy & Ecker, P.A. will notify the City in
writing if legal work will be outside of the scope of legal expenses to be performed for approval to
proceed with the requested work. If agreed, the legal fees will be charged at an hourly rate ranging from
$180.00 to $415.00.
SECTION 3. This expenditure shall be charged to the Radio Depreciation Fund.
SECTION 4. This ordinance shall be read on two separate days and will become
effective upon summary publication pursuant to KRS Chapter 424.
