HomeMy WebLinkAbout08-26-2019 Joint CalledAugust 26, 2019 At a Joint Called Meeting of the Paducah Board of Commissioners and McCracken County Fiscal Court, held on Monday, August 26, 2019, at 4:30 p.m., in Courtroom "D" of the McCracken County Courthouse, located at 300 Clarence Gaines Street, Mayor Harless and Judge Clymer presided. Upon call of the roll by the City Clerk, the following answered to their names: Commissioners Abraham, McElroy, Wilson and Mayor Harless (4). Commissioner Watkins was absent. Upon call of the roll, by the County Clerk, the following McCracken County Fiscal Court members answered to their names: Commissioners Bartleman, Jones, Parker and Judge Executive Clymer (4). INVOCATION Commissioner Bartleman gave the invocation. PLEDGE OF ALLEGIANCE Judge Clymer led the pledge. McCRACKEN COUNTY FISCAL COURT ORDINANCE ADOPTION 2ND READING OF ORDINANCE NO. 2019-11 Commissioner Bartleman offered motion, seconded by Commissioner Parker, that the McCracken County Fiscal Court adopt the following ordinance: It is hereby Ordered that Pursuant to KRS Chapter 67, the second reading of Ordinance No. 2019 — 10 shall be conducted in summary format as follows: An Ordinance approving the form, content, and legality of the Interlocal Cooperation Agreement by and between the City of Paducah, McCracken County, the Paducah -McCracken County Tourist and convention Commission, The Paducah -McCracken County Convention Center and The McCracken County Sports Tourism Commission, and authorizing the McCracken County Judge Executive to execute the same. Summary: The action effectuated in the present Ordinance is authorized by Kentucky Revised Statutes, Chapter 91A and Sections 65.210 to 65.314. The present Ordinance formalizes the approval of the McCracken County Fiscal Court of an Interlocal Cooperation Agreement entered into by and between McCracken County, the City of Paducah, the Paducah — McCracken County Tourist and Convention Commission, the Paducah — McCracken County Convention Center and the McCracken County Sports Tourism Commission (hereinafter the "Agreement") establishing and memorializing the respective rights and duties of said parties in connection with the tourism, convention and recreation activities to be subsequently conducted within the geographic jurisdictional boundaries of McCracken County. Further, the present Ordinance formalizes the McCracken County Fiscal Court's authorization of the McCracken County Judge Executive to execute the Agreement on behalf of the county. CITY OF PADUCAH ORDINANCE(S) — ADOPTION AUTHORIZE AN INTERLOCAL AGREEMENT WITH MCCRACKEN COUNTY, PADUCAH CONVENTION AND VISITORS BUREAU, JULIAN CARROLL CONVENTION CENTER, AND MCCRACKEN COUNTY TOURISM SPORTS COMMISSION Commissioner Wilson offered motion, seconded by Commissioner McElroy, that the Board of Commissioners adopt an Ordinance entitled, "AN ORDINANCE OF THE CITY OF PADUCAH, KENTUCKY, AUTHORIZING AND APPROVING AN INTERLOCAL AGREEMENT BETWEEN THE CITY OF PADUCAH, KENTUCKY, THE COUNTY OF MCCRACKEN, KENTUCKY, THE PADUCAH- MCCRACKEN COUNTY TOURIST AND CONVENTION COMMISSION, THE PADUCAH-MCCRACKEN COUNTY CONVENTION CENTER CORPORATION, AND THE MCCRACKEN COUNTY SPORTS TOURISM COMMISSION TO ESTABLISH RESPECTIVE RIGHTS AND DUTIES RELATED TO TOURISM, CONVENTION, AND RECREATION ACTIVITIES AND TO MEMORIALIZE ARRANGEMENTS FOR THE ALLOCATION OF THE TRANSIENT ROOM TAXES WITHIN THE CITY OF PADUCAH AND MCCRACKEN COUNTY." This ordinance is summarized as follows: This ordinance authorizes the execution of an Interlocal Agreement between the City, McCracken County, the Paducah- McCracken County Tourist and Convention Commission, the Paducah -McCracken County Convention Center Corporation and the McCracken County Sports Tourism Commission for the purpose of establishing rights and duties August 26, 2019 related to tourism, convention and recreation activities and to memorialize their arrangements for the allocation of the transient room taxes in order to provide for the orderly payment and retirement of existing liabilities and to provide for the orderly payment and allocation of the taxes collected. (ORD 2019-8-8585, BK 35) ACCEPT ASSETS AND APPOINTING AUTHORITY OF THE TOURIST AND CONVENTION COMMISSION AND AMEND CODE OF ORDINANCES SECTIONS 2-441 & 2-445 Commissioner McElroy offered motion, seconded by Commissioner Abraham, that the Board of Commissioners adopt an Ordinance entitled, "AN ORDINANCE ACCEPTING THE ASSETS AND APPOINTING AUTHORITY OF THE PADUCAH-MCCRACKEN COUNTY TOURIST AND CONVENTION COMMISSION AND RENAMING SAME AND AMENDING CHAPTER 2, ARTICLE VI, DIVISION 5 OF THE CITY OF PADUCAH CODE OF ORDINANCES." This ordinance is summarized as follows: This ordinance renames the Paducah McCracken County Convention & Visitors Bureau to be identified as the Paducah Convention and Visitors Bureau ("the Bureau"). The Bureau shall continue to own all of its assets and liabilities without the participation or involvement of McCracken County. This ordinance authorizes the City of Paducah to accept sole appointing authority for the Bureau. All current and existing board members shall remain on the board for the duration of their current terms and thereafter, be appointed pursuant to the applicable section(s) of Kentucky Revised Statutes. The City shall act as the sole governing body for purposes of KRS 91A.350 -91A.392. Further, this ordinance amends Paducah Code of Ordinances Sections 2-441 & 2-445 to reflect aforementioned changes. (ORD 2019-8-8586, BK 35) ESTABLISH THE CITY OF PADUCAH TRANSIENT ROOM TAX Commissioner Abraham offered motion, seconded by Commissioner McElroy, that the Board of Commissioners introduce an ordinance entitled, "AN ORDINANCE ESTABLISHING THE CITY OF PADUCAH TRANSIENT ROOM TAX." This ordinance is summarized as follows: This ordinance establishes the procedures for the collection, use, disbursements, and enforcement of the transient room tax. A tax of 3% will be levied for use by the Paducah Convention and Visitors Bureau, for the purpose of financing the operation of the Bureau. A tax of I% will be levied for use by the Convention Center Corporation for the purpose of financing the operation of the Convention Center. Implementation of this ordinance shall occur only upon the execution of the Interlocal Agreement entered into between the City of Paducah, McCracken County, the Paducah -McCracken County Convention and Visitors Bureau, the McCracken County Sports Tourism Commission, and the Convention Center Corporation. The full text of each section that imposes taxes or fees shall be published in accordance with KRS 83A.060. Adopted on call of the roll, yeas, Abraham, McElroy, Wilson, Mayor Harless (4).
