HomeMy WebLinkAbout2005-4-6967411 ORDINANCE NO. 2005-4-6967 AN ORDINANCE EXTENDING THE BOUNDARY OF THE CITY OF PADUCAH, KENTUCKY, BY FINALIZING THE ANNEXATION OF CERTAIN PROPERTIES LYING ADJACENT TO THE CORPORATE LIMITS OF THE CITY OF PADUCAH, AND DEFINING ACCURATELY THE BOUNDARY OF SAID PROPERTY TO BE INCLUDED WITHIN THE SAID CORPORATE LIMITS WHEREAS, two tracts of property adjacent to the present city limits, located on the south J side of Alben Barkley Drive and east side of Kentucky Highway 1296, is urban in character and suitable �-� for development for urban purposes without unreasonable delay; and WHEREAS, the properties are contiguous to the present corporate limits of the City, and it is desirable and necessary to annex the hereinafter described property; and WHEREAS, said tract of land is not within the boundary of another incorporated city; and WHEREAS, KRS 81A.412 provides that a city may adopt a single ordinance finalizing annexation when each of the owners of record of the land to be annexed gives prior consent; and WHEREAS, Paducah Junior College, Inc., has requested such annexation in writing to the Mayor and Board of Commissioners of the City of Paducah. BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY: SECTION 1. It is the intent of the City of Paducah, Kentucky, to finalize the annexation of the hereinafter described properties be annexed to, and be made a part of the City of Paducah, Kentucky, said real property being more particularly and accurately described as follows: AREA 1 A certain tract of land as surveyed by David H. Dummer, PLS No. 1955 of the firm of Dummer j Surveying & Engineering Services, Inc. of Paducah, Kentucky in October of 2004 and November of 2004, located on the south side of Alben Barkley Drive (U.S. Highway 62) and east side of Kentucky Highway 1296 (North Friendship Road, Relocated) in McCracken County, Kentucky, and being more particularly described as follows: Beginning at a 1/2" diameter rebar and cap (set) 20.00 feet north at right angles from the centerline of Old North Friendship Road and also located 95.00 feet south at right angles from the centerline of U. S. Highway 62 said intersection point being located 251.36 feet north with said centerline from the centerline intersection of Alben Barkley Drive (U.S. Highway 62) and Kentucky Highway 1296 (Relocated), said beginning point being on the current City Limits Line and being the westernmost corner of a tract of land conveyed to the Commonwealth of Kentucky for the use and benefit of the Department of Education recorded in Deed Book 580, Page 557, [all 1/2" diameter rebar and cap (set) are 1/2" diameter x 24" long with a plastic cap stamped "D.H.DUMMER PLS 1955"]; THENCE leaving said tract and crossing Old North Friendship Road South 71 degrees 18 minutes 39 seconds West for a distance of 37.01 feet to a point in the center line of Old North Friendship Road and 90.00 feet east at right angles from U. S. Highway 62; THENCE continuing across Old North Friendship Road and with the East Right of Way line of U.S. Highway 62 South 67 degrees 25 minutes 14 seconds West for a distance of 26.58 to a 1/2" diameter rebar and cap (set) 90.00 feet south at right angles from the centerline of said U.S. Highway 62; THENCE leaving said Old North Friendship Road and running upon the East Right of Way line of U.S. Highway 62 South 67 degrees 25 minutes 14 seconds West for a distance of 125.21 to a 1/2" diameter rebar and cap (set) 90.00 feet south at right angles from the centerline of said road; THENCE South 27 degrees 34 minutes 33 seconds West for a distance of 46.82 feet to a 1/2" diameter rebar and cap (set) 30.00 feet east at right angles from the centerline of Kentucky Highway 1296; THENCE South 20 degrees 56 minutes 44 seconds East for a distance of 328.38 feet with the north right-of-way of Kentucky Highway 1296 (Relocated) to a 1/2" diameter rebar and cap (set) 30.00 feet east at right angles from the centerline of said road; THENCE South 21 degrees 01 minutes 54 seconds East for a distance of 125.00 feet with the north right-of-way of Kentucky Highway 1296 (Relocated) to a 1/2" diameter rebar and cap (set) 30.00 feet east at right angles from the centerline of said road; � .�_�..w._o •-� �a,�rAw-�nce�:Wh�r.��wsslh�o-:men �I���1� .�itr'meau rv�, � � ciPaiv}�n�mdhLh_„n ��dardee��aenk�.dW:i�e'.Nkdlu.6�dw-ky��.uwk.r_u��dn6urc���wYtd.��vm:.x�w�nce�L��smw��nwe,w u.�.num:+d��n�aWmo�-,.—. �,w.' �, 412, THENCE South 21 degrees 01 minutes 54 seconds East for a distance of 1164.30 feet with the north right-of-way of Kentucky Highway 1296 (Relocated) to a 1/2" diameter rebar and cap (set) 30.00 feet east at right angles from the centerline of said road; THENCE along a curve to the left having a radius of 1402.39 feet and an arc length of 639.02 feet, being subtended by a chord of South 34 degrees 05 minutes 08 seconds East for a distance of 633.50 feet with the east right-of-way of said road to a 1/2" diameter rebar with cap stamped "HHMA K2105" (found); THENCE North 01 degrees 04 minutes 37 seconds West for a distance of 490.65 feet with the west line of the Victory Assembly Worship Center, Inc. property described in Deed Book 1017, Page 265, Plat Section "G", Page 187, and Plat Section "L", Page 640, Tract 1A to a 4"X4" Concrete Monument (found); THENCE North 02 degrees 21 minutes 26 seconds West for a distance of 430.00 feet with the west line of the Clyde B. and Alma Faye Stevens property described in Deed Book 567, Page 92 and Deed Book 438, Page 253 to a 1/2" diameter rebar and cap (set); THENCE South 82 degrees 36 minutes 27 seconds East for a distance of 397.97 feet with the north line of the Clyde B. and Alma Faye Stevens property to a 1/2" diameter rebar and cap (set) and being located at the southwestern corner of Paducah Annexation Number 67 as described in Paducah City Ordinance No. 81-11-2174, the Current City Limits; THENCE along the current City Limits Line North 02 degrees 08 minutes 33 seconds East for a distance of 850.69 feet with the west line of the Paducah Highland Terrace, LTD. Property described in Deed Book 631, Page 132 and Plat. Section "H", Page 326 and being common with the west line of said Annexation Number 67 to a 1/2" diameter rebar and cap (set) 20.00 feet south at right angles from the centerline of Old North Friendship Road; THENCE crossing Old North Friendship Road North 02 degrees 08 minutes 33 seconds East for a distance of 46.52 feet to a point in the north right-of-way line of said road and on a common line to Tract No. 1 of Annexation Number 55 as described in Ordinance Number 68-6-74 being on the current City Limits Line; THENCE continuing along the current City Limits North 73 degrees 09 minutes 51 seconds West for a distance of 141.65 feet with the north right-of-way line of said road and the south line of said Annexation Number 55 to a 1/2" diameter rebar and cap (set) 25.00 feet north at right angles from the centerline said road; THENCE along a curve to the right having a radius of 5704.58 feet and an arc length of 146.69 feet, being subtended by a chord of North 72 degrees 26 minutes 03 seconds West for a distance of 146.69 feet with the north right-of-way line of said road to a 1/2" diameter rebar and cap (set) 25.00 feet north at right angles from the centerline said road; THENCE North 71 degrees 41 minutes 51 seconds West for a distance of 335.21 feet with the north right-of-way line of said road to a 1/2" diameter rebar and cap (set) 25.00 feet north at right angles from the centerline said road; THENCE South 01 degrees 37 minutes 06 seconds West for a distance of 5.22 feet with the north right-of-way line of said road to a 1/2" diameter rebar and cap (set) 20.00 feet south at right angles from the centerline said road; THENCE North 71 degrees 41 minutes 51 seconds West for a distance of 295.41 feet with the north right-of-way line of said road to a 1/2" diameter rebar and cap (set) 20.00 feet north at right angles from the centerline said road; THENCE along a curve to the right having a radius of 2844.79 feet and an arc length of 284.56 feet, being subtended by a chord of North 68 degrees 49 minutes 55 seconds West for a distance of 284.44 feet with the north right-of-way line of Old North Friendship Road to a 1/2" diameter rebar and cap (set) 20.00 feet south at right angles from the centerline said road to the POINT OF BEGINNING; Said property contains 32.86 acres or 1431462 square feet. The draftsman of this description has made a diligent effort to insure that the boundary as described is in harmony with the record documents, but if conflicts are discovered, it should be noted that it is expressly intended that the above described boundary abut and be contiguous with the south line of Annexation Number 55 (Paducah City Ordinance Number 68-6-74) and to abut and be contiguous with the west line of 10 Annexation Number 67 (Paducah City Ordinance Number 81-11-2174) and that no gaps, gores or overlaps exist between said Annexations. Highway 62 said intersection point being located 251.36 feet north w?*h said centerline from the centerline intersection of Alben Barkley Drive (U.S. Highway 62) and Kentucky Highway 1296 (Relocated), said beginning point being on the current City Limits Line and being the westernmost corner of a tract of land conveyed to the Commonwealth of Kentucky for the use and benefit of the Department of Education said transaction recorded in the McCracken County Clerk's office in Deed Book 580, Page 557, [all 1/2" diameter rebar and cap (set) are 1/2" diameter x 24" long with a plastic cap stamped "D.H.DUMMER PLS 1955"]; thence leaving said U.S. 62 right-of-way and running with the north right-of-way of Old North Friendship Road and along a curve to the left having a radius of 2844.79 feet and an arc length of 284.56 feet, being subtended by a chord of South 68 degrees 49 minutes 55 seconds East for a distance of 284.44 feet to a 1/2" diameter rebar and cap (set) 20.00 feet North at right angles from the centerline said road; thence South 71 degrees 41 minutes 51 seconds East for a distance of 295.41 feet to a 1/2" diameter rebar and cap (set) 20.00 feet north at right angles from the centerline said road; thence North 01 degrees 37 minutes 06 seconds East fora distance of 5.22 feet to a 1/2" diameter rebar and cap (set) 25.00 feet North at right angles from1he centerline said road; thence South 71 degrees 41 minutes 51 seconds East for a distance of 335.21 feet to a 1/2" diameter rebar and cap (set) 25.00 feet north at right angles from the centerline said road; thence along a curve to the left having a radius of 5704.58 feet and an arc length of 146.69 feet, being subtended by a chord of South 72 degrees 26 minutes 03 seconds East for a distance of 146.69 feet to a 1/2" diameter rebar and cap (set) 25.00 feet north at right angles from the centerline said road; thence South 73 degrees 09 minutes 51 seconds East for a distance of 648.42 feet to a point in the north right-of-way line of said road 25 feet north at right angles from centerline and being the TRUE POINT OF BEGINNING of the hereinafter described tract; THENCE crossing Old North Friendship Road and running with the east line of Annexation Number 67 (Paducah City Ordinance Number 81-11-2174), the current City Limits Line, South 02 degrees 08 minutes 33 seconds West for a distance of 813.69 feet to 1/2" diameter rebar and cap (set); THENCE with a new City Limits Line South 82 degrees 36 minutes 27 seconds East for a distance of 350.00 feet with the north line of the Dean W. Boe property [passing through a 6" diameter concrete monument with cap stamped "RLS 113" (found) at 344.29 feet] to a 1/2" diameter rebar and cap (set) in the west right-of-way of Old North Friendship Road; THENCE crossing said road South 87 degrees 53 minutes 50 seconds East for a distance of 45.00 feet to a point in the east right-of-way of Old North Friendship Road being on a common line with Annexation Number 61 (Paducah City Ordinance No. 72-6-665); THENCE North 02 degrees 06 minutes 15 seconds East for a distance of 501.34 feet with the east right-of-way line of Old North Friendship Road and said common line of Annexation No. 61 to a point; THENCE North 87 degrees 53 minutes 46 seconds West for a distance of 5.00 feet with the east right-of-way line of Old North Friendship Road and said common line of Annexation No. 61 to a point; THENCE North 03 degrees 09 minutes 26 seconds East for a distance of 54.33 feet with the east right-of-way line of Old North Friendship Road and said common line of Annexation No. 61 to a point; THENCE North 01 degrees 35 minutes 57 seconds West for a distance of 105.85 feet with the east right-of-way line of Old North Friendship Road and said common line of Annexation No. 61 to a point; THENCE North 14 degrees 34 minutes 56 seconds West for a distance of 52.15 feet with the east right-of-way line of Old North Friendship Road and said common line of Annexation No. 61 to a 1/2" diameter rebar with cap stamped "F&H 2237" (Found); THENCE along a curve to the left having a radius of 120.00 feet and an arc length of 50.01 feet, being subtended by a chord of North 39 degrees 59 minutes 01 seconds West for a distance of 49.65 feet with the east right-of-way line of said road and with said common line to a P.K.
