HomeMy WebLinkAbout2005-4-6947ORDINANCE NO. 2005-4-6947 2005-3-6946 voided Emergency ord. not published w/in 10 days AN ORDINANCE EXTENDING THE BOUNDARY OF THE CITY OF PADUCAH, KENTUCKY, BY FINALIZING THE ANNEXATION CERTAIN PROPERTY LYING ADJACENT TO THE CORPORATE LIMITS OF THE CITY OF PADUCAH, AND DEFINING ACCURATELY THE BOUNDARY OF SAID PROPERTY TO BE INCLUDED WITHIN THE SAID CORPORATE LIMITS WHEREAS, a tract of property adjacent to the present city limits, located on Perkins Creek Drive, is urban in character and suitable for development for urban purposes without unreasonable delay; and WHEREAS, the property is contiguous to the present corporate limits of the City, and it is desirable and necessary to annex the hereinafter described property; and WHEREAS, said tract of land is not within the boundary of another incorporated city; and WHEREAS, KRS 81A.412 provides that a city may adopt a single ordinance finalizing annexation when each of the owners of record of the land to be annexed gives prior consent; and WHEREAS, Falconite-Hipp, LLC, has requested such annexation in writing to the Mayor and Board of Commissioners of the City of Paducah. BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY: SECTION 1. It is the intent of the City of Paducah, Kentucky, to finalize the annexation of the hereinafter described property be annexed to, and be made a part of the City of Paducah, Kentucky, said real property being more particularly and accurately described as follows: A particular tract of land situated in McCracken County, Kentucky and being Lot 11 in the Waiver of Subdivision for Falconite-Hipp, LLC recorded in Plat Book "L" Page 1193 at the McCracken County Court Clerk's office and being more particularly described as follows: Beginning at a point, said point being an existing iron pin with cap marked "F&H" set in the easterly right of way of Perkins Creek Drive, thence leaving said right-of-way South 85 degrees 17 minutes 11 seconds East a distance of 443.96 feet to an existing iron pin with cap marked "F&H"; thence South 4 degrees 34 minutes 32 seconds West a distance of 290.05 feet to an existing iron pin with cap marked "F&H"; thence North 85 degrees 21 minutes 44 seconds West a distance of 161.09 feet to a point; thence North 04 degrees 33 minutes 18 seconds East a distance of 35.20 feet to a point; thence North 85 degrees 16 minutes 28 seconds West a distance of 263.52 feet to a point in the easterly right of way of Perkins Creek Road; thence with said right of way North 04 degrees 43 minutes 34 seconds East a distance of 255.00 feet to the point of beginning, containing 2.7311 acres. SECTION 2. In order to allow the developer to proceed without suffering expenses proposed by delay, an emergency is hereby declared to exist and this ordinance shall become effective immediately with one reading.
