HomeMy WebLinkAbout2005-11-7039570 72311 ORDINANCE NO. 2005-11-7039 AN ORDINANCE AUTHORIZING THE CITY OF PADUCAH TO ENTER INTO AN AGREEMENT WITH INGRAM BARGE COMPANY WHEREAS, Ingram Barge Company ("Ingram") has agreed to significantly expand and relocate its current barge operation facility by constructing a new multi -story operations center ("Project")within the corporate limits of the City of Paducah ("City"), Kentucky; and WHEREAS, as a condition precedent to the construction of the Project, Ingram has requested the commitment of the City to make and/or reimburse Ingram for certain necessary renovation, construction, and improvements to facilities and properties relating to the municipal interests of the City, including improvements to road accesses and sidewalks, the riverfront and relocation of floodwall facilities ("Related Facilities"); and WHEREAS, as part of this commitment, Ingram has also requested that the City resolve a dispute which has arisen between the parties with regard to Ingram's responsibility for employee withholdings under Article IV, Section 106.81, et seq., and to define any amount due and owing by Ingram to the City for same, and to clarify such responsibility for future employee withholdings; and WHEREAS, it is the general consensus of the City Commission that the construction of Ingram's Project will promote the economic welfare of Paducah, and will help relieve unemployment and also provide a stimulus to future commercial and industrial activity in Paducah, and that the terms as negotiated between the Mayor and Ingram with regard to the City's commitment to Ingram are in the public interest of the City and accomplishes the (21, immediate construction of Ingram's Project. NOW, THEREFORE, BE IT ORDAINED AS FOLLOWS: Section 1. The Board of Commissioners does hereby approve the terms proposed by the Mayor which define the City's commitment to fund $300,000.00 for the renovation, construction, and improvements of the Related Facilities, and does hereby reaffirm same. In accordance with such approval, the Mayor of the City is hereby authorized and directed to enter into an agreement with Ingram which sets forth the terms of the City's commitment with regard to renovation, construction, and improvements of the Related Facilities, and the resolution of the dispute with regard to employee withholdings. Section 2. This ordinance shall be read on two separate dates and will become effective upon summary publication pursuant to KRS Chapter 424. ATTEST: �C Tamara S.
