HomeMy WebLinkAbout2006-9-716736 ORDINANCE NO. 2006-9-7167 AN ORDINANCE ESTABLISHING REGULATIONS FOR THE SALE OF MERCHANDISE OUTDOORS WITHIN THE CITY OF PADUCAH BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That Section 1, Purpose, is hereby created and ordained to ' hereinafter read as follows: "Purpose. The purpose of this ordinance is to license and regulate outdoor sales within the City of Paducah. SECTION 2. That Section 2, Definitions, is hereby created and ordained to hereinafter read as follows: "Definitions." Outdoor Sales — This shall apply to any person, business, organization, firm or corporation engaged in the sale of goods outdoors. Outdoors applies to, but not limited to lawns, parking lots, or any open area on private property. SECTION 3. That Section 3, Restrictions, is hereby created and ordained to hereinafter read as follows: " Restrictions." 1) On any one lot in the city, a person shall be allowed to acquire an Outdoor Sales License up to 10 days out of the year. 2) Outdoor sales shall only be permitted in those Zoning Districts that permit retail sales and churches and schools. 3) On site commercial establishments may sell outdoors for profit when selling goods from the principal use. A current Business License is required. 4) Outdoor sales not associated with principal use may only be for non-profit. Nonprofit status documentation shall be produced at the time of license application. 5) All merchandise, tents, and displays shall not in anyway obstruct the public right-of-way. 6) Any structure used in conjunction with a sales event or activity shall be subject to all Building and Fire Department requirements. 7) Signage shall meet the standards of the Sign Ordinance for temporary signs. 8) All exterior lighting utilized in conjunction with a temporary sales event or activity shall conform to all applicable local and state regulations. 9) All noise generated from the sales event or activity shall conform to the noise -level limits of the affected zone(s). 10) No sales and activities shall be conducted between the hours of 10:00 p.m. and 7:00 a.m. 11) Outdoor sales shall only be permitted on those lots that have a business with a current Certificate of Occupancy. 12) An outdoor sales license must be on-site at all times. SECTION 4. Severability. If any section, paragraph, sentence, clause, word or phrase of this Ordinance is for any reason held to be invalid or unenforceable by any court of competent jurisdiction, such decision shall not affect the validity of the remaining provisions of this Ordinance. 37 SECTION 5. This ordinance shall be read on two separate days and will become effective upon summary publication pursuant to KRS Chapter 424. ATTEST: Tammara S.
