ORDINANCE NO. 2006-8-7165
AN ORDINANCE ACCEPTING THE BID FOR THE PURCHASE OF
BIODEGRADABLE LEAFBAGS FOR FY2006/2007 AND AUTHORIZING THE MAYOR
TO EXECUTE A CONTRACT FOR SAME
WHEREAS, pursuant to Sec. 2-645 of the Code of Ordinances of the City of
Paducah, Kentucky, the Public Works Department received sealed bids on July 24, 2006, for the
purchase of biodegradable leafbags; and
WHEREAS, pursuant to Sec. 2-650(e) of the Code of Ordinances of the City of
Paducah, Kentucky, a written determination has been made by the City Manager that the City
rejected the bids received due to failure to conform to the specifications and that in the best
interest of the city new bids were requested; and
WHEREAS, pursuant to Sec. 2-645, of the Code of Ordinances of the City of
Paducah, Kentucky, the City advertised for new bids and is now ready to proceed with the
acceptance of a qualified bid.
BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. The City of Paducah accepts the bid of BioGroup USA, Inc., for
biodegradable leaf bags in the amount of $114,000 for use in the City of Paducah's Yard Waste
Collection Program for FY2006/2007, said bid being in substantial compliance with the bid
specifications, advertisement for bids, and as contained in the bid of BioGroup USA, Inc., dated
August 7, 2006.
SECTION 2. The Mayor is hereby authorized to execute a contract with
BioGroup USA, Inc., for the purchase of 300,000 leaf bags, according to the specifications, bid
proposal and all contract documents heretofore approved and incorporated in the bid.
SECTION 3. This purchase shall be charged to Bulk Brush & Leaf Collection.
SECTION 4. This ordinance shall be read on two separate days and will become
effective upon summary publication pursuant to KRS Chapter 424.
