HomeMy WebLinkAbout2006-7-71443 ORDINANCE NO. 2006-7-7144 AN ORDINANCE APPROVING THE FINAL REPORT OF THE PADUCAH PLANNING COMMISSION ON THE PROPOSED ZONE CHANGE FOR PROPERTIES LOCATED AT THE NORTHEAST INTERSECTION OF FLOURNOY STREET AND NORTH 8TH STREET, AND AMENDING THE PADUCAH ZONING ORDINANCE SO AS TO EFFECT SUCH REZONING BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That a resolution passed by the Paducah Planning Commission on June 5, 2006, and entitled, "A RESOLUTION CONSTITUTING THE FINAL REPORT OF THE PADUCAH PLANNING COMMISSION ON THE PROPOSED ZONING CHANGE FOR 5.783 ACRES OF PROPERTY LOCATED AT THE NORTHEAST INTERSECTION OF FLOURNOY STREET AND NORTH 8TH STREET," be approved as the final report of said Commission respecting the matters therein set forth. SECTION 2. That the zone classification and the map amendment proposed in said resolution be, and the same are hereby, declared to be in agreement with the comprehensive plan of the City of Paducah. SECTION 3. That the zone classification of the following described property be, and it is hereby, changed from M-1, Light Industrial Zone to M-2, Heavy Industrial Zone: ' Being a parcel of land in the city of Paducah. McCracken County Kentucky at the intersection of Flournoy Street and — Street, being a part of Blocks 48 and 49 and being more particularly described as follows: Beginning at an iron pin marked CDG PLS #3219 at the southeast intersection of the rights of way of 8- Street and Flournoy Street, each having a right of way width of 60 feet, said point being 30 feet from the centerline of each road; thence from the point of beginning, along the north right of way of 8th Street, South 62 degrees 04 minutes 59 seconds East a distance of 400.00 feet to an iron pin marked CDG PLS #3219, a corner common to Dale Treece; thence along the east lines of Treece, Central Transport and Jerry Davis, North 31 degrees 53 minutes 01 seconds East a distance of 455.00 feet to an iron pin marked CDG PLS #3219, the center of 7th Street; thence along the property of Saratoga LLC and the south boundary of Wagoner Avenue, North 62 degrees 04 minutes 59 seconds West a distance of 235.00 feet to an iron pin marked CDG PLS #3219; thence along the west boundary of Wagoner Avenue, North 31 degrees 53 minutes 01 seconds East a distance of 340.93 feet to an iron pin marked CDG PLS #3219, a corner to John W. Waters; thence North 62 degrees 04 minutes 59 seconds West a distance of 40.00 feet an iron pin marked CDG PLS #3219; thence North 31 degrees 53 minutes 01 seconds East a distance of 114.08 feet to an iron pin marked CDG PLS #3219 to the south right of way of — Street; thence along the south right of way of 6— Street, North 62 degrees 05 minutes 00 seconds West a distance of 125.00 feet to an existing rail road spike at the intersection of the rights of way of cth Street and Flournoy Street; thence South 31 degrees 53 minutes 01 seconds West a distance of 910.01 feet to the point of beginning. Containing 5.78 acres, more or less. As surveyed by Civil Design Group, inc., A. Clay Robinson, PLS #3219 on May 15, 2006. SECTION 4. That if any section, paragraph or provision of this ordinance shall be found to be inoperative, ineffective or invalid for any cause, the deficiency or invalidity of such 4 section, paragraph or provision shall not affect any other section, paragraph or provision hereof, it being the purpose and intent of this ordinance to make each and every section, paragraph and provision hereof separable from all other sections, paragraphs and provisions. SECTION 5. This ordinance shall be read on two separate days and will become effective upon summary publication pursuant to KRS Chapter 424. ATTEST: Tammara S.
