HomeMy WebLinkAbout2007-12-7372507 96716 ORDINANCE NO. 2007-12-7372 AN ORDINANCE AMENDING ORDINANCE NO. 2007-11-7363 TO PROVIDE A DEFERRED EFFECTIVE DATE OF THE APPLICATION AND ENFORCEMENT OF THE PROVISIONS AS STATED UNDER SAID ORDINANCE WHEREAS, on November 27, 2007, the City Commission had a second reading of, and thereafter enacted, Ordinance No. 2007-11-7363 styled "An Ordinance Amending and Restating Paducah's "Gross Receipts License Tax" Ordinances and Paducah's "License Fee for Employees" Ordinances Under Articles III and IV in Chapter 106 of the Paducah Code of Ordinances"; and WHEREAS, pursuant to KRS 83A.060, an ordinance becomes effective when published pursuant to KRS Chapter 424; and WHEREAS, since the filings and payments made under the City's "Gross Receipts License Tax" and "License Fee for Employees" under Chapter 106 of the Paducah Code of Ordinances are based on a calendar year basis, it is the consensus of the City Commission to defer the application and enforcement of the provisions which are enacted under Ordinance No. 2007-11-7363 to January 1, 2008. NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1. Section 106-196 of Ordinance No. 2007-11-7363 is hereby amended to state as follows: Section 106-196. Effective Date. The effective date of this Ordinance shall be the date of publication, provided however, that the application and enforcement of the provisions under this Ordinance be deferred until January 1 2008, at which time all provisions under the Ordinance shall be in full force and legal effect SECTION 2. Pursuant to KRS 83A.060, the City Commission suspends the requirement of a second reading of this Ordinance. As grounds therefore, the City Commission hereby declares an emergency to exist. Specifically, it is the consensus of the City Commission that the application and enforcement of the provisions under Ordinance No. 2007-1-7363 should be deferred to the first day of the next calendar year. Since there are no other City Commission meetings scheduled for the remainder of the 2007 calendar year, it is imperative that the Mi provisions of this Ordinance become effective upon one reading which is to be made at the last scheduled Commission meeting of the 2007 calendar year. SECTION 3. Effective Date. This Ordinance shall take effect from and after its passage and publication as provided by law. MAYOR ATTEST: Tammara S.
