AN ORDINANCE ACCEPTING THE BID OF JIM SMITH CONTRACTING
COMPANY, LLC FOR THE CITY'S 2007 CALENDAR YEAR STREET RESURFACING
PROGRAM, AND AUTHORIZING THE MAYOR TO EXECUTE A CONTRACT FOR SAME
BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. That the City of Paducah accepts the bid of Jim Smith Contracting
Company, LLC for the City's 2007 calendar year resurfacing program, said bid being in substantial
compliance with the bid specifications and advertisement for bids, and as contained in the bid of Jim
Smith Contracting Company, LLC of July 3, 2007.
SECTION 2. The City of Paducah accepts the bid of Jim Smith Contracting Company,
LLC for roadway excavation and reconstruction at the following hourly rates:

SECTION 3. That the Mayor is hereby authorized to execute a contract with Jim Smith
Contracting Company, LLC for street resurfacing and roadway excavation and construction as set out in
Sections 1 and 2 above, according to the specifications, bid proposal and all contract documents
heretofore approved and incorporated in the bid.
SECTION 4. This expenditure shall be charged to the Street Resurfacing and
Rehabilitation Account.
SECTION 5. Pursuant to KRS 83A.060, the City Commission suspends the requirement
of a second reading and publication of this ordinance. Due to the instabilit�of petroleum prices, and the
City's requirement of a fixed cost, the Cijy delayed the bid process until closer to the construction season
so that neither the City nor the Contractor would be as vulnerable to the fluctuation of the petroleum
prices. As grounds therefore, the City Commission does hereby declare an emergency to exist due to the
construction window of August through November.
SECTION 6. This Ordinance shall become effective upon the first reading of this
Ordinance.
