ORDINANCE NO. 2007-8-7321
AN ORDINANCE APPROVING A SUPPLEMENTAL AGREEMENT WITH
CIVIL DESIGN GROUP, INC., FOR PROFESSIONAL ENGINEERING SERVICES FOR THE
OLIVET CHURCH ROAD IMPROVEMENT PROJECT AND AUTHORIZING THE MAYOR
TO EXECUTE SAME
WHEREAS, by Ordinance No. 2006-4-7111, the City authorized the execution of
an Agreement in an amount not to exceed $186,000.00 with Civil Design Group, Inc. for
professional engineering services for the design of the Olivet Church Road Improvement Project;
WHEREAS, the City of Paducah has begun right of way negotiations and
determined that a redesign of 17% of the project is reasonable in lieu of acquisition by eminent
domain and, will not cause the project to suffer degradation and that this redesign will better
position the City for good -faith negotiations, and
WHEREAS, it is the intent of all parties that this modification be deemed an
integral part of said agreement.
BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. That the City of Paducah hereby approves a Supplemental
Agreement for the redesign of a portion of the plans for the Olivet Church Road Improvement
1 Project with Civil Design Group, Inc., in the amount of $32,500, therefore, increasing the total
contract amount to $218,500.00.
SECTION 2. That the City of Paducah hereby authorizes the Mayor to execute the
aforementioned contract modification approved in Section 1 above.
SECTION 3. Funding for the contract modification approved in Section 1 above
will be charged to Project Account ST0027.
SECTION 4. This ordinance shall be read on two separate days and will become
effective upon summary publication pursuant to KRS Chapter 424.
