HomeMy WebLinkAbout2007-4-7268256 ORDINANCE NO. 2007-4-7268 AN ORDINANCE APPROVING THE FINAL REPORT OF THE PADUCAH PLANNING COMMISSION ON THE PROPOSED ZONE REVERSION FOR PROPERTY LOCATED AT 1179 LONE OAK ROAD, 110 SYCAMORE STREET AND 114 SYCAMORE STREET, FROM B- 1, CONVENIENCE AND SERVICE ZONE TO R-2, LOW/MEDIUM DENSITY RESIDENTIAL ZONE, AND AMENDING THE PADUCAH ZONING ORDINANCE SO AS TO EFFECT SUCH REZONING BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That a resolution passed by the Paducah Planning Commission on March 5, 2007, and entitled, "A RESOLUTION CONSTITUTING THE FINAL REPORT OF THE PADUCAH PLANNING COMMISSION ON THE ZONING REVERSION FOR PROPERTY LOCATED AT 1179 LONE OAK ROAD AND 110 & 114 SYCAMORE STREET," be approved as the final report of said Commission respecting the matters therein set forth. SECTION 2. That the zone classification and the map amendment proposed in said resolution be, and the same are hereby, declared to be in agreement with the comprehensive plan of the City of Paducah. SECTION 3. That the zone classification of the following described property be, and it is hereby, changed from B-1, Convenience and Service Zone to R-2, Low/Medium Density Residential Zone: A certain tract of land as surveyed by Ricky A. Tosh, PLS No. 2900 of the firm of Dummer Surveying & Engineering Services, Inc. of Paducah, Kentucky on October 27, 2004, located on the north side of U.S. Highway 45 (Lone Oak Road) and the east side of Sycamore Street in Paducah, McCracken County, Kentucky, and being more particularly described as follows; and Beginning at the centerline intersection of U.S. Highway 45 and Sycamore Street; THENCE North 53 degrees 19 minutes 03 seconds East for a distance of 477.99 feet with the centerline of U.S. Highway 45 to a point in the centerline of said road; and THENCE North 36 degrees 40 minutes 57 seconds West for a distance of 45.50 feet to a 1/2" diameter rebar with cap (set)[all 1/2" diameter rebar with cap (set) are 1/2" diameter x 24" long rebar with plastic cap stamped "D.H. Dummer PLS 1955" (set) unless otherwise noted] on the north right-of-way line of U.S. Highway 45; and THENCE North 36 degrees 41 minutes 52 seconds West for a distance of 160.00 feet with the west line of the E. Chaffin and Elaine Moorefield property described in deed book 408, page 387 to a 1/2" diameter rebar with cap (set) in the south side of an undeveloped alley; and THENCE North 36 degrees 41 minutes 52 seconds West for a distance of 30.00 feet, crossing said alley to a 3"x6" concrete monument (found) on the north side of said alley; and THENCE North 36 degrees 41 minutes 52 seconds West for a distance of 172.10 feet with the west line of the E. Chaffin and Elaine Moorefield property described in deed book 408, page 387 to a 1/2" diameter rebar with cap (set) on the south side of Sanders Avenue (unimproved); and THENCE South 53 degrees 18 minutes 08 seconds West for a distance of 40.00 feet with the south side of Sanders Avenue to a 1/2" diameter iron pipe (found) on the west side of an undeveloped alley; and THENCE North 36 degrees 41 minutes 52 seconds West for a distance of 137.90 feet with the west line of said alley to a 1/2" diameter rebar with cap (set) on the south side of an undeveloped alley; and 257 THENCE South 53 degrees 18 minutes 08 seconds West for a distance of 253.00 feet with the south side of said alley to 1/2" diameter rebar with cap (set) on the east side of an undeveloped alley; and THENCE South 36 degrees 41 minutes 52 seconds East for a distance of 220.00 feet with the east side of said alley to a point; and THENCE South 53 degrees 18 minutes 08 seconds West for a distance of 15.00 feet, crossing said alley to a 1/2" diameter rebar with cap (set); and THENCE South 53 degrees 18 minutes 08 seconds West for a distance of 150.00 feet with the south side of the Jackie P. and Virgie M. Wiley property described in deed book 930, page 166 to a 1/2" diameter rebar with cap (set) on the east right -of -line of Sycamore Street; and THENCE South 53 degrees 18 minutes 08 seconds West for a distance of 20.00 feet to a point in the centerline of said street; and THENCE South 36 degrees 41 minutes 52 seconds East for a distance of 325.37 feet with the centerline of said street to the point of beginning. Said property contains 4.9243 acres more or less. SECTION 4. That if any section, paragraph or provision of this ordinance shall be found to be inoperative, ineffective or invalid for any cause, the deficiency or invalidity of such section, paragraph or provision shall not affect any other section, paragraph or provision hereof, it being the purpose and intent of this ordinance to make each and every section, paragraph and provision hereof separable from all other sections, paragraphs and provisions. SECTION 5. This ordinance shall be read on two separate days and will become effective upon summary publication pursuant to KRS Chapter 424. ATTEST: a/lC1 j4/ ko(lc Tammara S.
