HomeMy WebLinkAbout2007-5-7281279 89479 ORDINANCE NO.2007-5-7281 AN ORDINANCE AUTHORIZING SALE OF MUNICIPALLY OWNED REAL PROPERTY HELD FOR THE USE AND BENEFIT OF THE 1 PADUCAH WATER WORKS WHEREAS, the City of Paducah owns certain real property in the community of Lone Oak generally known as Lots 1, 2, and 3 in Block C of the Smithson Subdivision, which property is owned by the City for the use and benefit of the Paducah Water Works; and WHEREAS, the subject property is located in McCracken County, Kentucky and is more particularly described on Exhibit "A," which is attached hereto (the "Property"); and WHEREAS, the Commissioners of the Paducah Water Works has determined that the subject property is no longer necessary, appropriate, or in the best interests of the operations of the Paducah Water Works and that the Property should be sold as surplus real estate, all as reflected in a resolution passed by the Commissioners of the Paducah Water Works on April 25, 2007; and WHEREAS, Joe Grill and wife, Ann Gill, (collectively, `Buyers") are desirous of purchasing the Property for the price of One Thousand Dollars ($1,000.00); and WHEREAS, the Board of Commissioners of the City of Paducah concurs with the Commissioners of Paducah Water Works and finds that the sale of the Property for the price of One Thousand Dollars ($1,000.00) is in the best interest of the City and the Paducah Water Works. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1. Recitals and Authorizations. The Board of Commissioners hereby declares the Property to be surplus property and the sale of the Property to Buyers is hereby approved and authorized. SECTION 2. Recitals and Authorizations. That the Mayor of the City of Paducah, Kentucky, be and he is hereby authorized to execute and deliver a quitclaim deed of conveyance of the Property to Buyers for the purchase price of One Thousand ($1,000.00), along with all other documentation necessary to effectuate the sale of the Property. SECTION 3. Distribution of Proceeds. All monies realized from the sale of the Property, including without limitation, the purchase price paid by Buyers, shall be received by the City for the benefit of the Paducah Water Works and shall be remitted to the Paducah Water Works following receipt of same. 1 W11 SECTION 4. Severability. If any section, paragraph or provision of this Ordinance shall be held to be invalid or unenforceable for any reason, the invalidity or unenforceability of such section, paragraph or provision shall not affect any of the remaining provisions of this Ordinance. SECTION 5. Compliance With Open Meetings Laws. The City Commission hereby finds and determines that all formal actions relative to the adoption of this Ordinance were taken in an open meeting of the City Commission, and that all deliberations of this City Commission and of its committees, if any, which resulted in formal action, were in meetings open to the public, in full compliance with applicable legal requirements. SECTION 6. Conflicts. All ordinances, resolutions, orders or parts thereof in conflict with the provisions of this Ordinance are, to the extent of such conflict, hereby repealed and the provisions of this Ordinance shall prevail and be given effect. SECTION 7. Effective Date. This Ordinance shall be read on two separate days and will become effective upon summary publication pursuant to KRS Chapter 424. Y ST: -/ 44 Tammara S. Published by The Paducah Sun, May 28, 2007 Ord\pww-sale of property off lone oak rd 2 J EXHIBIT A LEGAL DESCRIPTION OF THE PROPERTY Beginning at a point in the north line of Williams Street 150 feet north 54 degrees east from the northeast corner of the intersection of Williams Street and Sanderson Street, as shown by a plat of the Smithson Subdivision, of record in Plat Book B, page 11, in the office of the (17 Clerk of the McCracken County Court, which said point also marks the southwest corner of Lot 3 in the Block C of said Subdivision; thence north 54 degrees east and along the north line of Williams Street 177 feet to a point in said line; thence north 35 degrees west 58 feet to a point; thence north 75 degrees west 150 feet to a point; thence south 54 degrees west 80 feet to a point, the northwest corner of said Lot 3 in a Block C; thence south 36 degrees east 170 feet to the point of beginning, being Lots 1, 2 and 3 in Block C in said Smithson Subdivision, as shown by said plat. Being part of the same property conveyed to the Lone Oak Water District by deed dated February 4, 1959, of record in Deed Book 403, page 31, in the McCracken County Clerk's office. 3 281
