ORDINANCE 2008-1-7383
AN ORDINANCE AUTHORIZING AND DIRECTING THE MAYOR TO
EXECUTE CHANGE ORDER 91 WITH ATLAS ROOFING CONTRACTORS, INC., FOR
REPLACEMENT OF THE ROOF ON THE COLUBIA THEATER
WHEREAS, the City approved Ordinance No. 2006-10-7182 to enter into a
contract with Atlas Roofing Contractors, Inc., in the amount of $228,000 for the replacement
of the roof for the Columbia & Arcade Theaters; and
WHEREAS, before the roofing project was completed the ownership of the
Arcade Theater was transferred to G & L Enterprises; therefore, only the Columbia Theater
side of the roof was replaced; and
WHEREAS, Change Order No. 1 is required due to the change in the scope of
work decreasing the original contract amount by $132,823.00 (roofing only the Columbia
Theater) and an increase in the amount of $10,683.00 for required tuck pointing, electrical,
scupper and downspouts, therefore, reducing the total contract amount to $105,860.00.
BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. The Mayor is hereby authorized and directed to execute Change
Order No. 1 for the replacement of the roof for the Columbia Theater in the deduction
amount of $122,140.00 with Atlas Roofing Contractors, Inc., therefore, decreasing the
original contract amount of $228,000 to $105,860.00.
SECTION 2. This expenditure shall be charged to project account DT0013.
SECTION 3. Pursuant to KRS 83A.060, the City Commission suspends the
requirement of a second reading and publication of this Ordinance. As grounds therefore, the
City Commission does hereby declare an emergency to exist due to the contract terms and
conditions and it being necessary for payment to be made to the contractor by February 9,
2008.
SECTION 4. This Ordinance shall become effective upon the first reading of
this Ordinance.
