ORDINANCE NO. 2008-4-7406
AN ORDINANCE AMENDING ORDINANCE NO. 97-1-5627,
ENTITLED, "AN ORDINANCE CREATING A BOARD TO BE KNOWN AS THE
BROOKS STADIUM COMMISSION; PROVIDING FOR THE APPOINTMENT AND
TERMS OF MEMBERS; AND ESTABLISHING THE POWERS AND DUTIES OF
SAID BOARD"
BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. ESTABLISHMENT: There is hereby created a board to be
known as Brooks Stadium Commission.
SECTION 2. COMPOSITION: APPOINTMENT OF MEMBERS: The
Brooks Stadium Commission shall consist of ei& nine members who shall be appointed
by the Mayor with the approval of a majority of the members of the Board of
Commissioners. One of the ei& nine members shall be appointed from the Board of
Commissioners of the City of Paducah. In addition, the Director of
Paras and Leisure Parks Services shall serve as an ex officio member of the board, but
shall not have any voting rights.
SECTION 3. TERMS OF MEMBERS; APPOINTMENTS;
VACANCIES; AND COMPENSATION: The terms of the members of the Brooks
Stadium Commission shall be four years, except that the members first appointed shall be
so appointed that the terms of not more than two members will expire in the same year.
Any member of the board may be removed by a majority vote of the members of the
Board of Commissioners. Vacancies shall be filled in the same manner as in the original
appointments and for the unexpired term of the vacancy. Board members shall serve
without compensation.
SECTION 4. POWERS AND RESPONSIBILITIES: The Brooks
Stadium Commission shall promote the full use of the Brooks Stadium facilities and
adjacent properties as it deems in the best interest of the public. The Commission shall
adopt such rules and regulations as it deems advisable for the public use and enjoyment
of the stadium. Subsequent to the appointment of the Board members, the Board shall
convene and elect a president and secretary. It shall establish rules and regulations not
inconsistent with its purpose, including the handling of public funds and budgeting. The
Brooks Stadium Commission shall not have the power or authority to sell, lease,
mortgage, or otherwise encumber any city property, nor shall it have the power or
authority to enter into any agreement requiring the expenditure of city monies. The City
of Paducah hereby retains all of its right, title, and interest in and to the Brooks Stadium
property, including all improvements thereof.

SECTION 5. This ordinance shall be read on two separate days and will
become effective upon summary publication pursuant to KRS Chapter 424.
