At a Regular Meeting of the Board of Commissioners, held on Tuesday, November 10, 2015, at
5:30 p.m., in the Commission Chambers of City Hall located at 300 South 5th Street, Mayor
Kaler presided, and upon call of the roll by the City Clerk, the following answered to their

ANNOUNCEMENT OF THE DISTINGUICSHED VETERAN
Army Capt. Robert Burgess, Chair of the Veterans Day Parade Committee, thanked the City for
its support of the Veterans Day Parade and announced that Army Command Sergeant Major
Scott Garrett has been chosen as this year's Distinguished Veteran and Parade Marshal. Mayor
Kaler presented a Duke of Paducah award to CSM Garrett.
DUKE OF PADUCAH
Mayor Kaler presented a Duke of Paducah to Kelly and Todd DeRezza for their son, Master -At -
Arms Seaman Tyler W. DeRezza. While home on leave from Naples, Italy, MA DeRezza was
the first to respond in saving the life of a 13 -year old boy that was hurt in a dirt bike accident.
PRESENTATION
EFFORTS OF HUD & VETERANS ADMINISTRATION TO ADDRESS HOMELESS
VETERANS IN THE PADUCAH-McCRACKEN COUNTY AREA
Christopher Taylor, Field Office Director of the U. S. Housing and Urban Development office in
Louisville, made a presentation regarding the efforts to end veteran homelessness. Mr. Taylor
announced that Paducah is the first city in Kentucky to receive the designation of the federal
board to end veteran homelessness. Through Mayor Kaler's initiative the City joined the
"Mayors Challenge to End Veteran Homelessness". Representatives from several agencies
which are partnering with the City to help end veteran homelessness attended the meeting. The
agencies are as follows: Paducah Cooperative Ministry, Marion VA Center, Housing Authority
of Paducah, Merryman House, Centerstone Supportive Services for Veteran Families Program,
Kentucky Department of Veteran Affairs and City of Paducah Section S Housing Program. At
the end of the presentation, Mayor Kaler presented a proclamation to Mr.Taylor proclaiming
November 11, 2015; as "Homeless Veterans Support Day".
MINUTES
Commissioner Abraham offered motion, seconded by Commissioner Gault, that the reading of
the Minutes for the November 3, 2015, City Commission meeting be waived and the Minutes of
said meeting prepared by the City Clerk be approved as written.

Mayor Kaler made the following appointment: "WHEREAS, upon the approval of the Board of
Commissioners, I hereby appoint Albert Parker as a member of the Municipal Housing
Commission, to fulfill the unexpired term of the late Ronald Rudolph. This term will expire July
22, 2016."

Commissioners approve the action of Mayor Kaler in appointing Albert Parker as a member of
the Municipal Housing Commission.

ORDINANCE — ADOPTION
ACCEPT RENAISSANCE ON MAIN GRANT AWARD
Commissioner Gault offered motion, seconded by Commissioner Abraham, that the
Board of Commissioners adopt an ordinance entitled, "AN ORDINANCE
AUTHORIZING THE MAYOR TO EXECUTE ALL DOCUMENTS NECESSARY TO
ACCEPT FUNDS FOR A RENAISSANCE ON MAIN GRANT FOR THE CITY OF
PADUCAWS ARTFUL BIKE RACKS PROJECT." This ordinance is summarized as
follows: The City of Paducah hereby authorizes the Mayor to execute all documents
necessary with the Kentucky Department for Local Government for a Renaissance On
Main Grant in the amount of $5,000 for the ARTful Bike Racks Project located in the
downtown historic district.

AMEND ZONING REGULATIONS FOR HOMELESS SHELTERS
Commissioner Rhodes offered motion, seconded by Commissioner Wilson, that the Board of
Commissioners introduce an ordinance entitled, "AN ORDINANCE AMENDING CHAPTER
126-72, "HOMELESS SHELTERS" OF THE CODE OF ORDINANCES OF THE CITY OF
PADUCAH, KENTUCKY." This ordinance is summarized as follows: This Ordinance amends
Chapter 126, Sec. 72, "Homeless Shelters," of the Code of Ordinances of the City of Paducah,
Kentucky, so as to bring this Ordinance into compliance with th-- mandates imposed by KRS 65.

Commissioner Wilson offered motion, seconded by Commissioner Rhodes, that the
Board of Commissioners introduce an ordinance entitled, "AN ORDINANCE OF THE
CITY OF PADUCAH, KENTUCKY, APPROVING AN AGREEMENT FOR
PROFESSIONAL ENGINEERING CONSTRUCTION ADMINISTRATION AND
RESIDENT INSPECTION SERVICES ASSOCIATED WITH THE RIVERFRONT
NOVEMBER 10, 2015
REDEVELOPMENT PROJECT PHASE 1-B, AND AUTHORIZING THE MAYOR TO
EXECUTE SAID AGREEMENT." This ordinance is summarized as follows: The City
hereby approves an Agreement for professional engineering construction administration
and resident inspection services with Bacon Farmer Workman Engineering & Testing,
Inc. (BFW) associated with the Riverfront Redevelopment Project Phase 1-B in an
amount not to exceed $126,380.00. Further, the Mayor of the City is hereby authorized
to execute the Agreement.
CITY MANAGER REPORT
• City Engineer Rick Murphy informed the public that P & L Railroad will be working on
its at -grade railroad crossing improvement on Olivet Church Road next week. The road
will be closed to thru traffic Monday through Friday, November 16`h through 20'h
Traffic on Olivet Church Road coming from U.S. 60 will be able to access the mall area
from James Sanders Boulevard. Traffic on Olivet Church Road coming from Cairo Road
will NOT be able to access the mall area.
City Manager Pederson reported that he along with Mayor Kaler and Steve Doolittle
would be attending the Paducah -McCracken Convention Center Corporation meeting
tomorrow to request the Corporation consider taking ownership of the pavilion and
finance the relocation of it by using 2% of the 6% transient room tax. If the Corporation
agrees, the next step would be for them to make the recommendation to the McCracken
County Fiscal Court. The Fiscal Court is the legislative body that would approve
legislation allowing the 2% transient room tax to be used.

Background Information:
On November 2, 2015; the Paducah Planning Commission held a public hearing and made a
positive recommendation to the Paducah City Commission on text changes to Section 126-72
Homeless Shelter. This text amendment originated with the City Commission pursuant to 1CRS
100.211 (2), This Section of the Zoning Ordinance is proposedl to be amended to comply with
KRS 65.870, which states that no city can infringe upon State and Federal laws regarding firearm
possession. Redundant language was also stricken. Following aro the substantial text changes:
See. 126-72. Homeless Shelters
The purpose of this section is to establish regulations for the location of homeless shelters in the
R-3, R-4, til -1, M-2 and 114-3 Zones, Objectives include minimizing land use conflicts and
ensuring that there are adequate services for homeless individuals within the vicinity of the
shelter.
1. "Shelter for the homeless" shall mean housing that is limited to occupancy of three -
hundred sixty-five (365) days or less by a homeless person.
2. Conditional Use Permit required. Homeless shelters shall only be permitted in the zones
listed herein upon receipt of a Conditional Use Permit. The operation of all shelters for
the homeless within the City of Paducah shall be contingent upon a Conditional Use
Permit from the Board of Adjustment in accordance with Section 126-68 of the Code of
Ordinances of the City of Paducah.
3. Each shelter for the homeless shall comply with the following conditions:
a. A shelter for the homeless shall provide a minimum of two -hundred (200) square feet
of heated building space per resident.
b. Shelters for the homeless may not be located within 1000 feet of any other shelter for
the homeless or any other use which could be classified as a shelter for the homeless.
c. Operation.
1. Shelters for the homeless shall be fully contained within a building owned and/or
operated by a government agency or non-profit organization.
2. The operation of a shelter for the homeless shall provide continuous, on-site
supervision by an employee and/or volunteer during all hours of operation.
3. No retail sales shall take place on the property ofany shelter for the homeless.
4. T'==r OeGupane-y- A shelter for the homeless may house no more than 50
residents.
5. All homeless shelters shall create and adopt a Code of Conduct that shall be
enforced at all times. The Code of Conduct A& include at a minimum the
following language:
i. Possession or use of illegal drugs is not permitted on the premises.
ii. Alcohol is not permitted on the premises.
m. — Weapens- are on the preeises. Federal and State firearm
control laws shall be strictly enforced on !lie premises.
iv. Violence is not permitted on the premises,
V. Fires are not permitted on the premises.
vi. Loitering in the surrounding neighborhood is not permitted.
vii. Littering on the premises or surrounding neighborhood is not permitted.
6. A copy of this said Code of Conduct shall be provided to the Zoning
Administrator of the City of Paducah for review by the Board of Adjustment.
7. Lighting. Adequate external lighting shall be provided for security purposes.
The lighting shall be stationary, directed away from adjacent properties & public
right-of-way and of intensity compatible with the neighborhood.

service adequate for the number of residents.
g r,.nifnen facilities. The development may provide one or more of the following
specific common facilities for the exclusive use of the residents and staff:
i. Central cooking and dining room(s)
ii. Recreation room
iii. Counseling center
iv. Child care facilities
V. Other support services
10. Outdoor aetri i . For the purpose of noise abatement in residential districts;
organized outdoor activities shall only be conducted between the hours of 8 a.m.
and 9 p.m.
It. Staff and services shall be available to assist residents in obtaining permanent
shelter and income.
12. The operator of a shelter for the homeless shall have a written management plan
including, as applicable, provision for staff training, neighborhood outreach;
security, screening of residents to ensure compatibility with services provided at
the facility and for training, counseling and treatrnent programs for the residents.
13. ` t uni den& *y: Homeless shelters located in residential districts, when
not developed in an individual dwelling unit format, shall not be subject to the
underlying zoning district's maximum density standard, but the number of beds
shall be limited to six times the maximum number of dwelling units which would
otherwise be permitted.
14. Shelters for the homeless shall be located within 2500 feet of a public
transportation route.

Background Information:
A Notice of Award has been issued to MAC Construction & Excavating, Inc., for the
construction of the Riverfront Redevelopment Project Phase t -B and work will then begin
soon thereafter. During construction of the Project, certain elements will need Professional
Engineering due to the complexity of the Project. Bacon Farmer Workman Engineering &
Testing, Inc., (BFW) has proposed to provide the necessary professional engineering services
consisting of construction administration and resident inspection services in an amount not to
exceed $126,380.00. The scope of work dated October 16, 2015, summarizes the
anticipated services to be provided by BFW.

AGENCY (FEMA) REIMBURSEMENT FUNDS FOR EXPENDITURES RELATED TO

WHEREAS, the City of Paducah has applied for Federal Emergency
Management Agency funds for reimbursement of expenditures related to the 2015 February
winter storm by resolution adopted on August 4, 2015, by the Board of Commissioners; and
WHEREAS, the City has received notification From the Commonwealth of
Kentucky Office of Emergency Management that it will reimburse the City a portion of its
expenditures,
BE IT ORDAINED BY THE CITY OF PADUCXH, KENTUCKY:
SECTION I. That the City of Paducah hereby accepts Federal Emergency
Management Agency (FEMA) funds through the Commonwealth of Kentucky Office of
Emergency Management in the amount of $26,682.58 for expenditures related to snow removal
efforts associated with the February 2015 winter storm (FEMA DISASTER NO.: FEMA -4216 -
DR -KY).
SECTION 2. This ordinance shall be read on t\vo separate days and will become
effective upon summary publication pursuant to KRS Chapter 424.

BE IT RESOLVED BY THE BOARD OF COMMISSIONERS OF THE CITY OF
PADUCAH,KENTUCKY:
SECTION 1. That Rick Murphy, P,E., City Engineer -Public Works Director is hereby
authorized to execute for and in behalf of the City of Paducah, a public entity established ander the laws
of the Commonwealth of Kentucky, this application and to file it in the appropriate State office for the
purpose of obtaining certain Federal financial assistance under the Disaster Relief Act (Public Law 288,
93rd Congress) or otherwise available from the President's Disaster Relief Fund.
SECTION 2. That the City of Paducah, a public entity established under the Laws of the
Commonwealth of Kentucky, hereby authorizes its agent to provide to the State and to the Federal
Emergency Management Agency (FEMA) for all matters pertaining to such Federal disaster assistance
the assurances and agreements printed on the reverse side hereof.
SECTION 3. That this resolution shall take effect upon adoption as provided by law.
