HomeMy WebLinkAbout10/13/92OCTOBER 13, 1992 (Regular Meeting Called Early) ROLL CALL At Regular Meeting of the Board of Commissioners held in the Commission Chambers at City Hall at 5:30 p.m., Tuesday, October 13, 1992, Mayor Montgomery presided, and upon call of the roll by the City Clerk, the following answered to their names: Commissioners Feezor, Grumley, Taylor and Mayor Montgomery (4). R & F CALLED MEETING NOTICES Commissioner Feezor offered motion, seconded by Commissioner Grumley, that the executed copies of the Notice of Called Meeting to be held at 5:30 p.m., Tuesday, October 13, 1992, be received and filed. Adopted on call of the roll, yeas, Commissioners Feezor, Grumley, Taylor and Mayor Montgomery (5)• \, EXECUTIVE SESSION Commissioner Grumley offered motion, seconded by Commissioner Feezor, that the Board go into closed session to discuss issues which might lead to the appointment, dismissal, or disciplining of an employee; as permitted by KRS 61.810(1)(f). Adopted on call of the roll, yeas, Commissioners Feezor, Grumley, Taylor and Mayor Montgomery (4). At the conclusion of the Executive Session the Board re- convened in Open Session, whereupon the Mayor called the meeting back to order. PRESENTATION OF GLADMAN HUMBLES' RETIREMENT PLAQUE Mayor Montgomery presented Gladman Humbles a retirement plaque in appreciation for his 29 years of service with the City in the Fire Department. TAX RATE HEARING A Hearing was held on the 1992-93 tax rate. Jonathan Perkins, Finance Director, explained the 1992-93 tax rate and handed out a chart of various tax levies history for FY 1982 through FY 1993. MINUTES Commissioner Taylor offered motion, seconded by Commissioner Grumley, that the reading of the minutes for September 22 and 29, and October 6, 1992, be waived that the minutes of said meetings prepared by the City Clerk be approved as written. Adopted on call of the roll, yeas, Commissioners Feezor, Grumley, Taylor and Mayor Montgomery (4). \ PUBLIC FORUM Sally Cope, a representative of the "Parenting and Life Skills Program", asked the City for funds to help keep their program operating. She gave a report and statistics on this program and handed out information to the Board. Individuals speaking in support of the program were: Rhonda Palmer, Lula Brown, Phil Hubbard, Olivia Burr and Larry Tucker. Mayor Montgomery asked Ms. Cope for their operating budget and an estimate of the amount of money needed from the City. Ms. Cope will provide the Mayor with a copy of the budget. Mayor Montgomery told her the request for funds will be considered. R & F BIDS Commissioner Feezor offered motion, seconded by Commissioner Grumley, that the following bids for rear loading refuse truck for the Public Works Department/Solid Waste Division, be received and filed: 1. Sunbelt Truck Center Adopted on call of the roll, yeas, Commissioners Feezor, Grumley, Hornsby, and Mayor Montgomery (4). \\' CEMETERY LOTS Commissioner Taylor offered motion, seconded by Commissioner Grumley, that the Board of Commissioners approve the sale of the following cemetery lot(s) and that the City Clerk be authorized to execute a Deed of Conveyance for said cemetery grave(s): 1. Georgia Jamerson, Rushing Addition to Oak Grove Cemetery, Sec. 6, Lot 169 SW, in the amount of $225.00 (Receipt No. 78895) Adopted on call of the roll, yeas, Commissioners Feezor, Grumley, Taylor and Mayor Montgomery (4). MUNICIPAL ORDERS PERSONNEL CHANGES Commissioner Feezor offered motion, seconded by Commissioner Grumley, that upon the recommendation of the City Manager, the Board of Commissioners orders the following personnel changes: (SEE MUNICIPAL ORDER BOOK) Adopted on call of the roll, yeas, Commissioners Feezor, Grumley, Hornsby, and Mayor Montgomery (4). ORDINANCES - INTRODUCTION REZONE PROPERTY ON JACKSON STREET Mayor Montgomery disqualified herself from this issue and Mayor Protem Feezor presided. Commissioner Grumley offered motion, seconded by Commissioner Taylor, that the Board of Commissioners introduce an ordinance entitled, "AN ORDINANCE APPROVING THE FINAL REPORT OF THE PADUCAH PLANNING COMMISSION RESPECTING THE REZONING OF PROPERTY LOCATED ON JACKSON STREET, AND AMENDING THE PADUCAH ZONING ORDINANCE SO AS TO EFFECT SUCH REZONING". This 369 ordinance is summarized as follows: Rezoning property located on Jackson Street, and directing an amendment to the Paducah Zoning Ordinance, and rezoning this property from R-4, High Density Residential Zone, to B-1, Service and Convenience Zone. Dan Key, Assistant Corporation Counsel,addressed the Board on this issue and explained the Board's options for handling the issue. After discussion, the Board unanimously decided to table the issue until iivA&I the next Commission Meeting on October 20, 1992. Commissioner Grumley offered motion, seconded by Commissioner Taylor, that the motion to rezone property on Jackson Street be tabled until October 20, 1992. Adopted on call of the roll, yeas, Commissioners Feezor, Grumley and Taylor (3). APPROVE RIVER HERITAGE CENTER PHASE 1B Commissioner Taylor offered motion, seconded by Commissioner Grumley, that the Board of Commissioners introduce an ordinance entitled, "AN ORDINANCE APPROVING PHASE 1B OF A CONTRACT WITH W.R. COLES AND ASSOCIATES TO PROVIDE ARCHITECTURAL/ENGINEERING SERVICES TO THE CITY OF PADUCAH FOR THE DEVELOPMENT OF THE RIVER HERITAGE CENTER, AND AUTHORIZING THE MAYOR TO EXECUTE A CONTRACT FOR SAME". The foregoing title summarizes the contents of this ordinance. SET 1992-93 TAX RATE Commissioner Feezor offered motion, seconded by Commissioner Grumley, that the Board of Commissioners adopt an ordinance entitled, "AN ORDINANCE FIXING THE LEVIES AND RATES OF TAXATION ON ALL PROPERTY IN THE CITY OF PADUCAH, KENTUCKY, SUBJECT TO TAXATION FOR MUNICIPAL PURPOSES AND FOR SCHOOL PURPOSES FOR THE PERIOD FROM JULY 1, 1992, THROUGH JUNE 30, 1993, WITH THE PURPOSES OF SAID TAXES THEREUNDER DEFINED". The Second half payment shall be due on April 1, 1993, and shall be payable without penalty and interest until April 30, 1993. 1V ADOPT NEW CHAPTER 27 - SOLID WASTE ORDINANCE Commissioner Grumley offered motion, seconded by Commissioner Feezor, that the Board of Commissioners introduce an ordinance entitled, 'AN ORDINANCE ABOLISHING CHAPTER 27, REFUSE, AND CREATING CHAPTER 27, SOLID WASTE, OF THE CODE OF ORDINANCES OF THE CITY OF PADUCAH, KENTUCKY". This ordinance is summarized as follows: Abolishing Chapter 27, Refuse, and creating Chapter 27, Solid Waste, of the Code of Ordinances of the city of Paducah, providing for solid waste collection and pick-up. Sec. 8 creates penalties which could result in fines or imprisonment. Sec. 9 creates sewer charges, rates and fees as may be established by Municipal Order. PURCHASE REAR LOADING TRUCK FOR REFUSE DEPT. Commissioner Taylor offered motion, seconded by Commissioner Grumley, that the Board of Commissioners introduce an ordinance entitled, "AN ORDINANCE ACCEPTING THE BID OF McBRIDE MACK SALES INC., IN THE AMOUNT OF $93,821.00 FOR PURCHASE OF ONE NEW HEIL FORMULA 5000 REAR LOADER, FOR USE BY THE PUBLIC WORKS DEPARTMENT, SOLID WASTE DIVISION, AND AUTHORIZING THE MAYOR TO EXECUTE A CONTRACT FOR SAME". The foregoing title summarizes the contents of this ordinance. �y PURCHASE 9,000 ROLLOUT REFUSE CONTAINERS Commissioner Feezor offered motion, seconded by Commissioner Grumley, that the Board of Commissioners introduce an ordinance entitled, "AN ORDINANCE ACCEPTING THE BID OF AMERI-KART CORPORATION/STRINGFELLOW INC. IN THE AMOUNT OF $383,940.00 FOR SALE TO THE CITY OF PADUCAH OF 9,000 96 -GALLON ROLLOUT TRASH CONTAINERS, FOR USE BY THE PUBLIC WORKS DEPARTMENT/SOLID WASTE DIVISION, AND AUTHORIZING THE MAYOR TO EXECUTE A CONTRACT FOR SAME". The fore- going title summarizes the contents of this ordinance. ORDINANCES - ADOPTION AMEND CITY COMMISSION MEETING SCHEDULE Commissioner Grumley offered motion, seconded by Commissioner Feezor, that the Board of Commissioners adopt an ordinance entitled, "AN ORDINANCE AMENDING SECTION 2-87, 'TIME OF REGULAR MEETINGS', SECTION 2-88, 'SPECIAL OR CALLED MEETINGS', AND SECTION 2-89, 'CLOSING, PREPARATION, DISTRIBUTION, ETC., OF AGENDA', OF CHAPTER 2 OF THE CODE OF ORDINANCES OF THE CITY OF PADUCAH." AMEND NONCIVIL SERVICE SEC. 2-47 Commissioner Taylor offered motion, seconded by Commissioner Grumley, that the Board of Commissioners adopt an ordinance entitled, "AN ORDINANCE AMENDING SUBSECTION (A) OF SECTION 2-47, NONCIVIL SERVICE GENERALLY, OF THE CODE OF ORDINANCES OF THE CITY OF PADUCAH, KENTUCKY". This ordinance is summarized as follows: Amending titles and positions in the noncivil service ordinance. Adopted on call of the roll, yeas, Commissioners Feezor, Grumley, Taylor and Mayor Montgomery (4). AMEND CIVIL SERVICE SECTIONS 10-49, 10-59 & 10-64 Commissioner Feezor offered motion, seconded by Commissioner Grumley, that the Board of Commissioners adopt an ordinance entitled, "AN ORDINANCE AMENDING AMENDING SECTIONS 10-49, 10-59 AND 10-64, CIVIL SERVICE, OF THE CODE OF ORDINANCES OF THE CITY OF PADUCAH, KENTUCKY". This ordinance is summarized as follows: Amending positions and designating Community Planning & Development. Department in the Civil Service Ordinance.
