At a Regular Meeting of the Board of Commissioners held in the Commission Chambers at City Hall at 7:00 p.m., Tuesday, July 20, 1993, Mayor Montgomery presided, and upon call of the roll the following answered to their names: Commissioners Feezor, Grumley, Hornsby, Taylor and Mayor Montgomery (5). MINUTES Commissioner Feezor offered motion, seconded by Commissioner Grumley that the reading of the Minutes for July 13, 1993, be waived and that the Minutes of said meeting(s) prepared by the City Clerk be approved as written. Adopted on call of the roll, yeas, Commissioners Feezor, Grumley, Hornsby, Taylor and Mayor Montgomery (5). MOTIONS R & F DOCUMENTS Commissioner Grumley offered motion, seconded by Commissioner Feezor that the following documents be received and filed: 1. Certificate(s) of Insurance: (a) Swift & Staley Mechanical Contractors 2. Emergency Shelter Grants Program Agreement v 3. Deed between the City and the Board of Education of the Paducah Independent School District for refinancing of Bonds, and reconveying school properties to°the Paducah Independent School District Finance Corp. \` 4. U.S. 60 Regional Trade Center (Kentucky Oaks Mall Area) Traffic Study submitted by Wilbur Smith Associates 5. Paducah Airport Corporation Audit for Years Ended December 21, 1992 and 1991 Adopted on call of the roll, yeas, Commissioners Feezor, Grumley, Hornsby, Taylor and Mayor Montgomery (5). MUNICIPAL ORDERS PERSONNEL CHANGES Commissioner Hornsby offered motion, seconded y Commissioner Taylor that upon the recommendation of the City Manager, the Board of Commissioners of the City of Paducah orders that the personnel changes on the attached list be approved: (SEE MUNICIPAL ORDER BOOK) Adopted on call of the roll, yeas, Commissioners Feezor, Grumley, Hornsby, Taylor and Mayor Montgomery (5). RESTRICT $100,000.00 OF GENERAL FUND FOR PURCHASE OF FIRE TRUCKS Commissioner Taylor offered motion, seconded by Commissioner Hornsby that a Municipal Order entitled, "A MUNICIPAL ORDER RESTRICTING $100,000.00 OF GENERAL FUND REVENUES AS DEPICTED BY THE BUDGET FOR FISCAL YEAR 1993-94, OF THE CITY OF PADUCAH, KENTUCKY", be adopted. Adopted on call of the roll, yeas, Commissioners Feezor, Grumley, Hornsby, Taylor and Mayor Montgomery (5). 520 JULY 20, 1993 ORDINANCES - INTRODUCTIONS AMEND SECTIONS 10 & 11 OF THE PROTECTION OF TREE ORDINANCE Commissioner Feezor offered motion, seconded by Commissioner Grumley that the Board of Commissioners introduce an ordinance entitled, "AN ORDINANCE AMENDING SECTIONS 10 AND 11 OF ORDINANCE 92-3-4739, AN ORDINANCE RELATING TO PROTECTION OF TREES ON PUBLIC PROPERTY WITHIN THE CITY OF PADUCAH". The foregoing title summaries the contents of this ordinance. `,� APPROVAL OF KLC FINANCING FOR PURCHASE OF FIRE TRUCKS Commissioner Grumley offered motion, seconded by Commissioner Feezor that the Board of Commissioners introduce an ordinance entitled, "AN ORDINANCE ACCEPTING THE PROPOSAL OF KENTUCKY LEAGUE OF CITIES IN THE AMOUNT OF $1,262,581.00 TO FINANCE THE ACQUISITION OF SEVEN FIRE TRUCKS, AND AUTHORIZING THE MAYOR TO EXECUTE A CONTRACT FOR SAME". The foregoing title summarizes the contents of this ordinance. FINAL SUBDIVISION APPROVAL FOR WELLINGTON WOODS Commissioner Taylor offered motion, seconded by Commissioner Hornsby that the Board of Commissioners introduce an ordinance entitled, "AN ORDINANCE APPROVING THE FINAL REPORT OF THE PADUCAH PLANNING COMMISSION RESPECTING THE PROPOSED SUBDIVISION OF PROPERTY OF WELLINGTON WOODS SUBDIVISION LOCATED AT THE INTERSECTION OF RIGGLESBERGER LANE AND OAK STREET". The foregoing title summarizes the contents of this ordinance. CONDEMNATION OF PROPERTY ON COLEMAN ROAD FOR UTILITY EASEMENT Commissioner Feezor offered motion, seconded by Commissioner Grumley that the Board of Commissioners introduce an ordinance entitled, "AN ORDINANCE PROVIDING FOR THE NEED FOR ACQUIRING A PARCEL OF REAL PROPERTY FOR THE PURPOSES OF THE RECONSTRUCTION, ALTERATION, RELOCATION AND IMPROVEMENT OF A PERMANENT PUBLIC ROADWAY KNOWN AS COLEMAN ROAD AND A PERPETUAL PERMANENT UTILITY EASEMENT FOR PURPOSES OF LAYING, MAINTAINING, REPAIRING AND REMOVING PUBLIC UTILITIES ACROSS THE REAL PROPERTY OWNED BY LOYD CHAMPION AND WIFE, LOLA CHAMPION, AND AUTHORIZING THE CONDEMNATION OF SAME". This ordinance is summarized as follows: Instituting condemnation proceedings against Lola Champion and wife, Lola Champion, and all other parties at interest to acquire the necessary real property for right-of-way purposes and a public utility easement for the installation of a sanitary sewage disposal system. APPROVE CONTRACT WITH ANGELS OF MERCY, INC. Commissioner Grumley offered motion, seconded by Commissioner Feezor that the Board of Commissioners introduce an ordinance entitled, "AN ORDINANCE AUTHORIZING THE MAYOR TO EXECUTE A CONTRACT BY AND BETWEEN THE CITY OF PADUCAH, McCRACKEN COUNTY, AND ANGEL OF MERCY, INC., WHEREBY ANGEL OF MERCY WILL RECEIVE A SUM NOT TO EXCEED $125,000.00 FROM THE CITY OF PADUCAH FOR PROVIDING 24-HOUR EMERGENCY AMBULANCE SERVICE TO CITIZENS, SUBJECT TO ADDITIONAL TERMS AND CONDITIONS". The foregoing title summarizes the contents of this ordinance. AMEND SECTION 28-5, "BANNERS PROHIBITED ACROSS OR ALONG STREETS v AND SIDEWALKS --EXCEPTIONS" Commissioner Hornsby offered motion, seconded by Commissioner Taylor that the Board of Commissioners introduce an ordinance entitled, "AN ORDINANCE AMENDING SUB -SECTION 28-5 OF CHAPTER 28, STREETS AND SIDEWALKS, OF THE CODE OF ORDINANCES OF THE CITY OF PADUCAH, KENTUCKY". This ordinance is summarized as follows: Amending Sec. 28-5, "Banners prohibited across or along streets and sidewalks -- Exceptions". The Board discussed the requirements contained in the proposed ordinance for banners. They decided to delay the second reading of this ordinance for one week. 521 JULY 20, 1993 ORDINANCE= ADOPTION APPROVE WEST PARK VILLAGE SUBDIVISION, APT. PARCEL I Commissioner Taylor offered motion, seconded by Commissioner Hornsby that the Board of Commissioners adopt an ordinance entitled, "AN ORDINANCE APPROVING THE FINAL REPORT OF THE PADUCAH PLANNING COMMISSION RESPECTING THE PROPOSED SUBDIVISION OF PROPERTY AND DEVELOPMENT PLAN OF MARY SUE BROOKS LOCATED IN WEST PARK VILLAGE SUBDIVISION, ACCEPTING THE DEDICATION OF PUBLIC RIGHTS-OF-WAY AND EASEMENTS AND SETTING fir\ BOND AMOUNT." This ordinance is summarized as follows: Approving the final report of the Paducah Planning Commission respecting the proposed subdivision of property and development plan of Mary Sue Brooks located in West Park Village Subdivision, accepting the dedication of public rights-of-way and easements and setting bond in the amount of $140,698.00. 7- -V 9 k, z s, P. DISCUSSIONS Mayor's announcements: vl) Mr. James Pennington, City Manager, is acting as Alcoholic Beverage Administrator while Mr. Harris, Alcoholic Beverage Administrator, is on vacation:. 2) The Cltyais participating in the Summer Youth Program. \13) Summer Festival starts Friday, July 23, 1993. This Festival is sponsored by many different people and businesses. 4) Letter of Compliment from Department of Agriculture regarding farmers market area facilities being available for use. 5) The City has been donated bike racks by Bike World. These have been installed in different areas of the City. Commissioner Grumley asked what is the City's status on recycling at this time. He asked the City Manager to see how Mayfield, Kentucky, is handling their recycling programs. Commissioner Hornsby asked that a "Silent Alarm" be explained to the public. He has had phone calls from citizens regarding this type of alarm. Mayor's �Tpdates: 1) Update on the FEMA report "-42) She has received a contract Airport Corporation. Mayor also reported that PATS has sent a Thank You for the City paying for the new bus schedules. EXECUTIVE SESSION Commissioner Feezor offered motion, seconded by Commissioner Grumley'that the Board of Commissioners go into closed session for discussion of matters pertaining to the following topics: 522 JULY 20, 1993 Proposed or pending litigation; as permitted by KRS 61.810(1)(c). Issues which might lead to the appointment, dismissal or disciplining of an employee; as permitted by KRS 61.810(1)(f).
