HomeMy WebLinkAbout12/21/93616 DECEMBER 21, 1993 ROLL CALL At a Regular Meeting of the Board of Commissioners held in the Commission Chambers at City Hall at 7:00 p.m., Tuesday, December 21, 1993, Mayor Montgomery presided, and upon call of the roll the following answered to their names: Commissioners Feezor, Grumley, Hornsby, Taylor and Mayor Montgomery (5). PRESENTATIONS Mayor Montgomery presented the 1993 Distinguished Citizen Award to Harry Ruth and Mary G. Sledd. MINUTES Commissioner Feezor offered motion, seconded by Commissioner Grumley that the reading of the Minutes for December 14, 1993, be waived and that the Minutes of said meeting(s) prepared by the City Clerk be approved as written. Adopted on call of the roll, yeas, Commissioners Feezor, Grumley, Hornsby, Taylor and Mayor Montgomery (5). MOTIONS R & F DOCUMENTS Commissioner Grumley offered motion, seconded by Commissioner Feezor that the following documents be received and filed: 1. Certificate(s) of Insurance: V1 - (a) (a) Wilkins Construction Co. 2. Agreement between J. Patrick Kerr and the City for Architectural Services for Robert C. Cherry Civic Center 3. Agreement between Paducah Area Transit System (PATS) and the City for fleet maintenance services 4. Western Baptist Hospital Development Application ✓ Adopted on call of the roll, yeas, Commissioners Feezor, Grumley, Hornsby, Taylor and Mayor Montgomery (5). R & F PETITIONS Commissioner Hornsby offered motion, seconded by Commissioner Taylor that the following petitions be received and filed: 1. Petition by City employees opposing dress code or ✓ mandatory uniforms. 2. Petition by City employees opposing substitution of New Year's Eve Holiday with Martin Luther King Jr. Day Adopted on call of the roll, yeas, Commissioners Feezor, Grumley, Hornsby, Taylor and Mayor Montgomery (5). MUNICIPAL ORDERS PERSONNEL CHANGES Commissioner Taylor offered motion, seconded by Commissioner Hornsby that upon the recommendation of the City Manager, the Board of Commissioners of the City of Paducah orders that the personnel changes on the attached list be approved: (SEE MUNICIPAL ORDER BOOK) Adopted on call of the roll, yeas, Commissioners Feezor, Grumley, Hornsby, Taylor and Mayor Montgomery (5). 617 TREE CITY USA GRANT APPLICATION Commissioner Feezor, seconded by Commissioner Grumley that a Municipal Order entitled, "A MUNICIPAL ORDER AUTHORIZING THE MAYOR TO EXECUTE A GRANT APPLICATION FOR AN AWARD DESIGNATION AS A TREE CITY USA FOR 1993, AS RECOGNIZED BY THE NATIONAL ARBOR DAY FOUNDATION", be adopted. Adopted on call of the roll, yeas, Commissioners Feezor, Grumley, Hornsby, Taylor and Mayor Montgomery (5). MUNICIPAL ORDER NO. M.O. BK 2; PG (030 APPROVE KEILER LETTER OF CREDIT Commissioner Grumley offered motion, seconded by Commissioner Feezor that a Municipal Order entitled, "ACCEPTING ✓ A LETTER OF CREDIT IN LIEU OF A BOND", be adopted. Adopted on call of the roll, yeas, Commissioners Feezor, Grumley, Hornsby, Tafor and Mayor Montgomery (5). MUNICIPAL ORDER NO. P75 ; M.O. BK 2; PG (031 ORDINANCE - INTRODUCTIONS APPROVE E-911 MAINTENANCE AGREEMENT Commissioner Hornsby offered motion, seconded by Commissioner Taylor that the Board of Commissioners introduce an ordinance entitled, "AN ORDINANCE AUTHORIZING AND DIRECTING THE MAYOR TO EXECUTE A MAINTENANCE AGREEMENT WITH E911 SERVICE, ACTING BY AND THROUGH THE PADUCAH-McCRACKEN COUNTY EMERGENCY COMMUNICATION SERVICE BOARD". The above title summarizes the contents of this ordinance. APPROVE PINES SUBDIVISION SECTION III Commissioner Taylor, seconded by Commissioner Hornsby that the Board of Commissioners introduce an ordinance entitled, "AN ORDINANCE APPROVING THE FINAL REPORT OF THE PADUCAH PLANNING COMMISSION RESPECTING THE PROPOSED SUBDIVISION OF PROPERTY OF KEILER AND MAY PROPERTIES, LOCATED IN PINES SUBDIVISION -SECTION ✓ III, LOCATED WEST OF -DEER PATH LANE, WEST OF WHITNEY DRIVE, AND EAST OF I-24, ACCEPTING THE DEDICATION OF PUBLIC RIGHTS-OF-WAY AND EASEMENTS AND ACCEPTING A LETTER OF CREDIT". This ordinance is summarized as follows: Approving the final report of the Paducah Planning Commission respecting the proposed subdivision of property of Keiler and May, located in Pines Subdivision -Section III, accepting the dedication of public rights-of-way and easements, and accepting a letter of credit in the amount of $18,550. APPROVE SEC. 2-47(A), NONCIVIL SERVICE Commissioner Feezor offered motion, seconded by Commissioner Grumley, that the Board of Commissioners introduce / an ordinance entitled, "AN ORDINANCE AMENDING SECTION 2-47(A), d NONCIVIL SERVICE, DEPARTMENT OF COMMUNITY PLANNING AND DEVELOPMENT, OF THE CODE OF ORDINANCES OF THE CITY OF PADUCAH, KENTUCKY". This ordinance is summarized as follows: Increasing the pay grade and salary of the City Planner. PROHIBITING OCCUPANCY OF UNINHABITABLE BUILDINGS Commissioner Grumley offered motion, seconded by Commissioner Feezor that the Board of Commissioners introduce an ordinance entitled, "AN ORDINANCE PROHIBITING OCCUPANCY OF r/ UNINHABITABLE BUILDINGS AND AUTHORIZING TERMINATION OF UTILITY SERVICE TO SAME". This ordinance is summarized as follows: Establishing guidelines to prohibit occupancy of uninhabitable buildings, setting penalties for unlawful occupancy, and authorizing termination of utility service to uninhabitable buildings. ORDINANCE - ADOPTION CONDEMN PROPERTY FOR BARKLEY AIRPORT Commissioner Grumley offered motion, seconded by Commissioner Feezor that the Board of Commissioners introduce ./ an ordinance entitled, �XXO�XX��X��?StXl MINUMIT EX LDMSX fXWUO=XNO(XM1MMAZ XM*X)UT=TT XMYWKXTX)(XSfXWX. This ordinance is summarized as follows: D.ECEMUR 213 1993 C "AN ORDINANCE DEEMING IT NECESSARY TO CONDEMN AND ACQUIRE FOR PUBLIC PURPOSES CERTAIN REAL ESTATE LOCATED IN MCCRACKEN COUNTY, KENTUCKY, FOR FURTHER AVIATION DEVELOPMENT OF BARKLEY REGIONAL AIRPORT". Condemning certain real estate for the development of aviation facilities at Barkley Regional Airport, and authorizing and directing the Corporation Counsel to institute condemnation proceedings in McCracken Circuit Court for condemnation of same.
