HomeMy WebLinkAbout11/09/93591 NOVEMBER 9, 1993 NOVEMBER 9, 1993 ROLL CALL At Regular Meeting of the Board of Commissioners held in the Commission Chambers at City Hall at 7:00 p.m., Tuesday, November 9, 1993, Mayor Montgomery presided, and upon call of the roll by the City Clerk, the following answered to their names: Commissioners Feezor, Grumley, Hornsby, Taylor and Mayor Montgomery (5). PUBLIC FORUM Gertrude Schramm talked to the Commission about receiving a notice (letter) which she received from the City Attorneys advising her that she would be fined $5,000 per day for each day she was in violation of paying her sewer tap -on fee. She showed the Commission a copy of the letter. After lengthy discussion, it was determined that she paid her tap -on fee after receipt of the letter. Gene A. Bryant, telephone 444-6118, discussed the City's sidewalk repair policy in front Mt. Moriah Missionary Baptist Church at 1201 South 8th Street. He still contends that the City should pay all the costs for repairing sidewalks. Mayor Montgomery thanked him for again presenting his point of view on this subject. Monroe A. Sloan asked the Commission if they had reached a decision to comply with a Resolution passed in 1971 concerning doing something to honor his late father, Sam S. Sloan, Sr. The Commission was in unanimous agreement that something be done to honor Mr. Sloan and praised him for all that he did during his lifetime for the betterment of the City of Paducah. Commissioner Hornsby offered motion, seconded by Commissioner Feezor, that the Board of Commissioners make an inquiry into the costs for a bust and base in honor of Sam S. Sloan, Sr., deceased, and that public contributions and donations be considered for this project. Commissioner Feezor offered motion, seconded by Commissioner Hornsby, that the motion for a bust for Sam S. Sloan, Sr., be amended to read that the Board of Commissioners will finalize its decision on the method by which this project will be handled by the end of the 1993 calendar year. Adopted on call of the roll, yeas, Commissioners Feezor, Grumley, Hornsby, Taylor and Mayor Montgomery (5). A vote was then taken on the above motion as amended. RETIREMENT PLAQUE PRESENTATION TO LEON CONWAY Mayor Montgomery presented a retirement plaque to Lt. Leon Conway for 19 years service with the Paducah Fire Department. (disability retirement) RETIREMENT LETTERS The Board affixed their signatures on retirement letters for \14 Ronald McClure and George Raymond (disability retirement). MINUTES Commissioner Feezor offered motion, seconded by Commissioner Grumley, that the reading of the minutes for October 26, 1993, be waived that the minutes of said meetings prepared by the City Clerk be approved as written. MUNICIPAL ORDERS PERSONNEL CHANGES Commissioner Hornsby offered motion, seconded by Commissioner Taylor, that upon the recommendation of the City Manager, the Board of Commissioners of the City of Paducah orders that the personnel changes on the attached list be approved. Adopted on call of the roll, yeas,'Commissioners Feezor, Grumley, Hornsby, Taylor and Mayor Montgomery (5). � RECORDS GRANT APPLICATION FOR CITY CLERK'S OFFICE Commissioner Taylor offered motion, seconded by Commissioner Hornsby, that a Municipal order entitled, "A MUNICIPAL ORDER AUTHORIZING AND DIRECTING THE MAYOR AND CITY CLERK TO EXECUTE A LOCAL RECORDS GRANT PROGRAM APPLICATION WITH THE KENTUCKY DEPARTMENT FOR LIBRARIES AND ARCHIVES, AND ANY AND ALL DOCUMENTS RELATING TO SAME", be adopted. Adopted on call of the roll, yeas, Commissioners Feezor, Grumley, Hornsby, Taylor and Mayor Montgomery (5). Municipal Order No. 671, M.O. Book 2, page 622 � GRANT APPLICATION FOR ORAL HISTORY (RIVER) PROJECT Commissioner Feezor offered motion, seconded by Commissioner Grumley, that a Municipal Order entitled, "A MUNICIPAL ORDER AUTHORIZING THE MAYOR TO EXECUTE A GRANT AGREEMENT AND ALL DOCUMENTS NECESSARY TO OBTAIN FUNDING THROUGH THE KENTUCKY ORAL HISTORY COMMISSION FOR PARTICIPATION IN A KENTUCKY ORAL HISTORY PROJECT ENTITLED, 'THE EFFECTS OF THE RIVERS ON LIFE IN WESTERN KENTUCKY"', be adopted. Adopted on call of the roll, yeas, Commissioners Feezor, Grumley, Hornsby, Taylor and Mayor Montgomery (5). Municipal Order No. 672, M.O. Book 2, page 623 \ ORDINANCE - EMERGENCY GRANT FOR HISTORIC CITY MAP RESTORATION Commissioner Grumley offered motion, seconded by Commissioner Feezor, that the Board of Commissioners introduce and adopt an ordinance entitled, "AN ORDINANCE AUTHORIZING AND DIRECTING THE MAYOR TO EXECUTE AN AGREEMENT WITH THE KENTUCKY DEPARTMENT FOR LIBRARIES AND ARCHIVES FOR A GRANT IN THE AMOUNT OF $3,000 TO RESTORE TWO HISTORIC CITY OF PADUCAH MAPS FOR THE DEPARTMENT OF ENVIRONMENTAL AND ENGINEERING SERVICES". Ordinance No. 93-11-5029; Ord. Book 25, p. 297 593 NOVEMBER 9, 1993 ORDINANCES - INTRODUCTION CHANGE ORDER NO. 1 - NOBLE PARK NATURE TRAIL Commissioner Hornsby offered motion, seconded by Commissioner Taylor, that the Board of Commissioners introduce an ordinance entitled, "AN ORDINANCE AUTHORIZING AND DIRECTING THE MAYOR TO EXECUTE CHANGE ORDER NO. 1 IN THE AMOUNT OF $3,200.00 WITH WILKINS CONSTRUCTION COMPANY FOR THE NOBLE PARK DISABILITY NATURE TRAIL". This ordinance is summarized as follows: Authorizing the Mayor to Execute Change Order No. 1 in the amount of $3,200.00 with Wilkins Construction Company for the erection of a stone base for a sign marking the Nature Trail. SECTION 8 ANNUAL CONTRIBUTIONS CONTRACT FOR FAMILY SELF-SUFFICIENCY PROGRAM Commissioner Taylor offered motion, seconded by Commissioner V Hornsby, that the Board of Commissioners introduce an ordinance entitled, "AN ORDINANCE AUTHORIZING EXECUTION OF SECTION 8 ANNUAL CONTRIBUTIONS CONTRACT NO. A -2877-V, AND AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE ALL DOCUMENTS RELATING TO SAME". This ordinance is summarized as follows: Authorizing the Mayor and City Clerk to execute all documents necessary to implement funding for the Family Self -Sufficiency Program. PAYROLL ORDINANCES (ALL ORDINANCES) Commissioner Feezor offered motion, seconded by Commissioner Grumley, that the Board of Commissioners introduce the following payroll ordinances: V 1. An ordinance abolishing Sec. 2-47 and recreating Sec. 2-47, Noncivil Service; v 2. An ordinance amending Sec. 2-52, Alcoholic Beverage Administrator; 3. An ordinance amending Sec. 25-1, Police Department; ""4. An ordinance amending Sec. 12-19, Fire Department; ",15. An ordinance amending Sections in Chapter 10, Article III, Civil Service. These ordinances are summarized as follows: Amending salaries in the above-mentioned Chapters and Sections of the Paducah Code of Ordinances. NOTE: At the request of the Commission Pat Flowers, Payroll Clerk, explained the effective retroactive dates contained in these ordinances. CITY MANAGER SALARY INCREASE Commissioner Grumley offered motion, seconded by Commissioner Feezor, that the Board of Commissioners introduce an ordinance entitled, "AN ORDINANCE AMENDING SECTION 2-49, 'CITY MANAGER -GENERALLY', OF THE CODE OF ORDINANCES OF THE CITY OF PADUCAH, KENTUCKY". This ordinance is summarized as follows: Increasing the salary of the City Manager retroactive to June 14, 1993. ORDINANCE ADOPTIONS CLOSE ALLEY ON JEFFERSON STREET Commissioner Hornsby offered motion, seconded by Commissioner Taylor, that the Board of Commissioners adopt an ordinance entitled, "AN ORDINANCE PROVIDING FOR THE CLOSING OF AN ALLEY ON JEFFERSON STREET BETWEEN 13TH AND 14TH STREETS". This ordinance is summarized as follows: Closing an alley on Jefferson Street between 13th and 14th Streets and authorizing and directing the Corporation Counsel to institute and prosecute an action in McCracken Circuit Court for a judgment to close same. Bk. 25, p. 298 CABLE TV ORDINANCE AMENDMENTS Commissioner Taylor offered motion, seconded by Commissioner v Hornsby, that the Board of Commissioners adopt an ordinance 594 NOVEMBER 9, 1993 entitled, "AN ORDINANCE ABOLISHING AND RECREATING SECTION 7 AND AMENDING SECTION 10 OF CHAPTER 7 1/2, CABLE COMMUNICATIONS, OF THE CODE OF ORDINANCES OF THE CITY OF PADUCAH, KENTUCKY". This ordinance is summarized as follows: Declaring the City's intent to regulate basic cable rates in compliance with the Cable Television Consumer Protection and Competition Act of 1992 and the rules of the Federal Communications Commission, and delegating certain regulatory functions to the Paducah Cable Communications Authority. Adopted on call of the roll, yeas, Commissioners Feezor, Grumley, Hornsby, Taylor and Mayor Montgomery (5). Ordinance No. 93-11-5031, Ord. Bk. 25, p. 299 CHANGE ORDER NO. 2, WEST VALE SUBDIVISION Commissioner Feezor offered motion, seconded by Commissioner Grumley, that the Board of Commissioners adopt an ordinance entitled, "AN ORDINANCE AUTHORIZING AND DIRECTING THE MAYOR TO EXECUTE CHANGE ORDER NO. 2 IN THE AMOUNT OF $400.00 WITH ASPHALT PAVING, INC. FOR WEST VALE SEWER EXTENSION". This ordinance is summarized as follows: Authorizing the Mayor to execute Change Order No. 2 in the amount of $400.00 with Asphalt Paving Inc. for placement of rip rap on an exposed lateral in a creek in the West Vale sanitary sewer extension project. Adopted on call of the roll, yeas, Commissioners Feezor, Grumley, Hornsby, Taylor and Mayor Montgomery (5). Ordinance No. 93-11-5032, Ord. Bk. 25, p. 303 DISCUSSIONS MAYOR: �^ 1. Christmas Parade on November 20. Instructed Commissioners who plan to ride in parade to call Pat Earles & make appropriate arrangements. 2. Hall of Fame Luncheon in Louisville on November 17 for Kentucky Chamber of Commerce. Inquired if any j Commissioners would like to attend. 3. A new Paducah Community Band Concert at Symphony Hall on Veterans Day, November 11 4. Thank you note from Bea Castro, who won the painting award 5. Festival of Lights on November 27 - various events during this festival in downtown Paducah COMMISSIONER HORNSBY: Stated that the Mayor's office received an anonymous telephone call on this date and someone stated that the City's leaf machine was vacuuming leaves at his residence. He stated the call was in error and that his leaves were bagged yesterday and that this situation did not occur at his residence. He did state that his neighbor's leaves were being vacuumed by the City. COMMISSIONER FEEZOR: Stated that he thinks the $5,000 per day delinquent penalty imposed on Ms. Schramm for not tapping onto the city sewer is excessive. The Board instructed Roger Colburn, City Engineer, to verify �1J this amount, which he did. Mayor Montgomery asked Roger for a list of people who were sent the same penalty letter as Ms. Schramm. EXECUTIVE SESSION Commissioner Grumley offered motion, seconded by Commissioner Feezor, that the Board go into closed session for discussion of matters pertaining to the following topics: NOVEMBER 91 1993 1. Proposed or pending litigation y 2. At the conclusion of the Executive Session the Board reconvened in Open Session, whereupon the Mayor announced there was no further business. Upon motion the meeting adjourned.
