HomeMy WebLinkAbout06/11/96JUNE 11, 1996 ROLL CALL At a Regular Meeting of the Board of Commissioners held in the Commission Chambers at City Hall at 6:00 p.m., Tuesday, June 11, 1996, Mayor Jones presided, and upon call of the roll by the City Clerk, the following answered to their names: Commis- sioners Coleman, Grumley, Hornsby, Renfro and Mayor Jones (5). j' VETERANS' MEMORIAL RUBBING PRESENTED TO COMMISSIONER HORNSBY Mayor Jones and Buddy Smith presented a Vietnam Veterans Memorial rubbing to Commissioner Hornsby. This rubbing was signed by Mayor and Mrs. Albert Jones, Buddy Smith, Judge and Mrs. Danny Orazine and Delphine Operle, who obtained the rubbing on a recent trip to the monument in Washington, D.C. The rubbing contained the name of Commissioner Hornsby's son, who was killed in Vietnam. DISPENSE WITH ORDER OF BUSINESS Commissioner Renfro offered motion, seconded by Commissioner Hornsby, that the Board of Commissioners dispense with the Order of Business and place Municipal Orders after Ordinances on the agenda. Adopted on call of the roll, yeas, Commissioners Coleman, Grumley, Hornsby, Renfro and Mayor Jones (5). DISCUSSIONS PADUCAH POWER SYSTEM/JACKSON PURCHASE ECC CONDEMNATION ISSUE (Re the institution of legal proceedings on behalf of the Electric Plant Board of the City of Paducah, d/b/a Paducah Power System, to acquire by condemnation the Electric Plant and facilities of Jackson Purchase Electric Cooperative Corporation lying within the municipal boundaries of the City of Paducah) Ray McLennan, a member of the Electric Plant Board, addressed the Commission on behalf of the Electric Plant Board on this issue. Danny Cope, President of the Jackson Purchase ECC Board, addressed the Commission on behalf of JPECC on this issue. At the request of Mayor Jones, both parties agreed to select a mediator and begin negotiations in an attempt to settle this issue without the costly expense of court proceedings. Danny Cope made note that the mediator's decision will not arbitrary. Mayor Jones recommended that these meetings be held in public as much as possible so everyone concerned can hear the facts of the case. Mayor Jones also suggested that both parties consider the possibility of Paducah Power System purchasing the disputed territory in increments, as JPECC obtains future growth. SUMMER POOL FEES AT BLACKBURN AND KOLB PARKS Mayor Jones announced that there will be no pool fees at Blackburn and Kolb Parks this summer. r ORDINANCES - ADOPTION PADUCAH POWER SYSTEM/JPECC CONDEMNATION ISSUE FOR ACQUISITION BY PPS OF JPECC TERRITORY Commissioner Renfro offered motion, seconded by Commissioner Hornsby, that the Board of Commissioners adopt an ordinance entitled, "AN ORDINANCE AN ORDINANCE AUTHORIZING THE INSTITUTION OF LEGAL PROCEEDINGS ON BEHALF OF THE ELECTRIC PLANT BOARD OF THE CITY OF PADUCAH, D/B/A PADUCAH POWER SYSTEM, TO ACQUIRE BY CONDEMNATION THE ELECTRIC PLANT AND FACILITIES OF JACKSON PURCHASE ELECTRIC COOPERATIVE CORPORATION LYING WITHIN THE MUNICIPAL' BOUNDARIES OF THE CITY OF PADUCAH, KENTUCKY". This ordinance is summarized as follows: An ordinance in response to the request of 74 -75 June 11, 1996 the Electric Plant Board of the City of Paducah for the City's initiation of condemnation proceedings on behalf of the Electric Plant Board to acquire, for the Electric Plant Board, the Electric Plant and facilities of Jackson Purchase Electric Cooperative Corporation lying within the municipal boundaries of the City of Paducah. MINUTES Commissioner Coleman offered motion, seconded by Commissioner Grumley that the reading of the Minutes for May 28 and 30, 1996 waived and that the Minutes of said meetings prepared by the City Clerk be approved as written. Adopted on call of the roll, yeas, Commissioners Coleman, Grumley, Hornsby, Renfro and Mayor Jones (5). APPOINTMENT MUNICIPAL HOUSING COMMISSION Mayor Jones made the following appointment: "WHEREAS, subject to the approval of the Board of Commissioners, I hereby appoint William "Bill" Paxton as a member of the Municipal Housing Commission to fill the unexpired term of Frances Cooper, who has resigned. This term will expire July 11, 1999." Commissioner Coleman offered motion, seconded by commissioner Grumley, that the Board of Commissioners approve the action of Mayor Jones in appointing William "Bill" Paxton as a member of the Municipal Housing Commission. ORDINANCES - ADOPTION AMEND SEC, 97.15, LITTER Commissioner Renfro offered motion, seconded by Commissioner Hornsby, that the Board of Commissioners adopt an ordinance entitled, "AN ORDINANCE AMENDING SECTION 97.15 OF CHAPTER 97, LITTER, OF THE CODE OF ORDINANCES OF THE CITY OF PADUCAH, KENTUCKY, AUTHORIZING THE RECOVERY OF ATTORNEY FEES AND COSTS". This ordinance is summarized as follows: Amending ordinance to authorize the City to recover attorney fees and other associated costs. FOR CODE Commissioner Coleman offered motion, seconded by Commissioner Grumley, that the Board of Commissioners adopt an ordinance v entitled, "AN ORDINANCE AUTHORIZING AND DIRECTING THE MAYOR TO EXECUTE A PROFESSIONAL SERVICES CONTRACT WITH MUNICIPAL CODE CORPORATION FOR SUPPLEMENTING THE CODE OF ORDINANCES FOR THE CITY OF PADUCAH". ORDINANCE NO. 96-6-5502, BOOK 26, P.515 . AMEND CHAPTER 101, STREETS & SIDEWALKS Commissioner Grumley offered motion, seconded by Commissioner Coleman, that the Board of Commissioners adopt an ordinance entitled, "AN ORDINANCE CREATING SECTIONS 101.15 THROUGH 101.21, 101.35 THROUGH 101.36, 101.40 THROUGH 101.441, AND 101.60 THROUGH 101.61 OF CHAPTER 101, STREETS AND SIDEWALKS, OF THE CODE OF ORDINANCES OF THE CITY OF PADUCAH, KENTUCKY". This ordinance is summarized as follows: Defines responsibilities within the City's right-of-way for sidewalks, curbs and gutters, driveway entrances and pipes, establishes bonding and insurance responsibilities for construction within said right-of-way, notice and lien procedures, and authorizes the City Engineer to enforce rules and regulations set forth in said ordinance. ORDINANCE NO. 96-6-5505, BOOK 26, P -15 - ACCEPT BID FOR TREE & BRUSH GRINDING AT COMPOST SITE ($25,000) Commissioner Grumley offered motion, seconded by Commissioner Coleman, that the Board of Commissioners adopt an ordinance entitled, "AN ORDINANCE ACCEPTING THE BID OF ENVIRONMENTAL WOOD RECYCLING IN AN AMOUNT NOT TO EXCEED $25,000, FOR TREE AND BRUSH V/ GRINDING AT THE CITY OF PADUCAH COMPOST SITE, AND AUTHORIZING THE MAYOR TO EXECUTE A CONTRACT FOR SAME". This ordinance is summarized as follows: Increasing the number of positions of Deputy Building Inspector from 3 to 4. ORDINANCE - INTRODUCTION Commissioner Coleman offered motion, seconded by Commissioner Grumley, that the Board of Commissioners introduce an ordinance entitled, "AN ORDINANCE PROVIDING FOR THE NEED FOR ACQUIRING CERTAIN PERMANENT UTILITY EASEMENTS AND TEMPORARY CONSTRUCTION ` EASEMENTS ACROSS A PARCEL OF LAND BELONGING TO MID SOUTH V MAUSOLEUM, INC., TO BE USED BY THE PADUCAH WATER WORKS COMMISSION TO LAY, MAINTAIN AND REPAIR A WATER MAIN, AND PROVIDING AND AUTHORIZING THE CONDEMNATION OF SAME". ORDINANCE - EMERGENCY Commissioner Grumley offered motion, seconded by Commissioner Coleman, that the Board of Commissioners introduce and adopt an ordinance entitled, "AN ORDINANCE AUTHORIZING THE MAYOR TO ENTER INTO A CONTRACT FOR DEED AND ALL OTHER DOCUMENTS RELATING THERETO, WITH LOUIS KIRCHOFF AND MAX BASTANI IN THE AMOUNT OF $58,000 FOR i ✓ SALE BY THE CITY OF VARIOUS REAL PROPERTIES LOCATED ALONG SOUTH SECOND STREET, IN THE CITY OF PADUCAH, McCRACKEN COUNTY, KENTUCKY". Speed study on U.S. 60 in Kentucky Oaks Mall area, west of Friedman Lane to west of Holt Road. Mayor.Jones. discussed.a letter -of - June 7, 1996, which_ he received from John T. Agee of theHighway Department concerning data collected at this location concerning decreasing the speed limit from 45 mph to 35 mph in this area. Mayor Jones instructed Police Chief McGinty to have the speed reduced accordingly in the above area; i.e., from Friedman Lane to the city limits. Mayor Jones also expressed his desire to annex Highway 60 to -the Olivet Church Road if it not already in the city limits. 2. Road construction and property acquisition for same in the Mall area was also discussed. The following property owners are involved in this acquisition: v The Cafaro Company (majority property owner) Service Merchandise Taco Bell Teachers' Retirement System (Sam's) 3. Mayor Jones instructed the Engineering Department to return intersection configurations to their former lane markings at following intersections: 28th & Broadway 28th & Jefferson 21st & Broadway 21st & Jefferson EXECUTIVE SESSION Commissioner Grumley offered motion, seconded by Commissioner Coleman, that the Board go into closed session for discussion of matters pertaining to the following topics: I!J June 11, 1996 1. Future sale or acquisition of a specific parcel(s) of real estate, as permitted by KRS 61.810(1)(b); 2. Collective bargaining with public employees, as permitted by ✓ KRS 61.810(1)(e) 3. Issues which might lead to the appointment, dismissal or disciplining of an employee, as permitted by KRS 61.810(1)(f).
