HomeMy WebLinkAbout08/15/95AUGUST 15, 1995 ROLL CALL At a Regular Meeting of the Board of Commissioners held in the Commission Chambers at City Hall at 7:00 p.m., Tuesday, August 15, 1995, Mayor Montgomery presided, and upon call of the roll by the City Clerk, the following answered to their names: Commissioners Coleman, Grumley, Hornsby, Renfro and Mayor Montgomery (5). MINUTES Commissioner Coleman offered motion, seconded by Commissioner Grumley, that the reading of the Minutes for August 8, 1995, be waived and that the Minutes of said meeting prepared by the City Clerk be approved as written. MUNICIPAL ORDERS PERSONNEL CHANGES Commissioner Hornsby offered motion, seconded by Commissioner Renfro, that upon the recommendation of the City Manager, the Board of Commissioners of the City of Paducah orders that the personnel changes on the attached list be approved. ORDINANCES - EMERGENCY CONDEMNATION PROCEEDINGS FOR SEWER EASEMENT ACROSS LINEBERRY PROPERTY Commissioner Renfro offered motion, seconded by Commissioner Hornsby, that the Board of Commissioners introduce and adopt an ordinance entitled, "that the Board of Commissioners introduce and adopt an ordinance entitled, "AN ORDINANCE PROVIDING FOR r THE NEED FOR ACQUIRING A PERMANENT SANITARY SEWER EASEMENT AND A TEMPORARY CONSTRUCTION EASEMENT ACROSS A PARCEL OF REAL PROPERTY BELONGING TO MARK D. Z�14[ ORDINANCES - ADOPTION PURCHASE REAL ESTATE ON SOUTH 4TH STREET Commissioner Coleman offered motion, seconded by Commissioner Grumley, that the Board of Commissioners adopt an ordinance entitled, "AN ORDINANCE AUTHORIZING THE MAYOR TO EXECUTE A DEED FOR THE PURCHASE OF REAL PROPERTY BY THE CITY OF PADUCAH FROM �I IRENE WYNN FOR THE SUM OF $4,500, LOCATED AT 1201 SOUTH 4TH STREET IN THE CITY OF PADUCAH, McCRACKEN COUNTY, KENTUCKY, WHICH PROPERTY WILL BE USED FOR THE COMBINED SEWER OPERATION PLAN FOR THE HUSBANDS STREET LIFT STATION". ORDINANCE NO. 95-8-5340, BOOK 26, P. 296 ADD WASTEWATER TREATMENT ACCOUNT TO EQUIPMENT RENTAL CONTRACT Commissioner Grumley offered motion, seconded by Commissioner Coleman, that the Board of Commissioners adopt an ordinance entitled, "AN ORDINANCE AMENDING ORDINANCE NO. 95-7-5313 AUTHORIZING AND DIRECTING THE MAYOR TO EXECUTE A CONTRACT WITH CENTRAL PAVING CO. OF PADUCAH INC. FOR RENTAL OF VARIOUS EQUIPMENT FOR THE 1995-96 FISCAL YEAR". This ordinance is summarized as follows: Authorizing an additional budgetary account number for the rental of various equipment. ORDINANCE NO. 95-8-5341, BOOK 26, P. 47r/ ADOPT ALL FUTURE EDITIONS OF BOCA NATIONAL PROPERTY MAINTENANCE CODE UPON ISSUANCE OF SAME Commissioner Hornsby offered motion, seconded by Commissioner Renfro, that the Board of Commissioners adopt an ordinance entitled, "AN ORDINANCE ADOPTING ALL FUTURE EDITIONS OF THE BOCA NATIONAL PROPERTY MAINTENANCE CODE UPON ISSUANCE OF SAME, ✓ AND AMENDING SECTION PM -110.1 OF THE EXISTING CODE". This ordinance is summarized as follows: Adopting all future editions of the BOCA National Property Maintenance Code upon issuance of same, and amending Sec. PM -110.1 (Property Maintenance) as relating to the upgrade or repair of existing structures. ORDINANCE NO. 95-8-5342, BOOK 26, P. 02.17 6 AMEND SEC. 15-4 & 15-5 AND CREATE SEC. 15-7 OF CHAPTER 15, HEALTH Commissioner Renfro offered motion, seconded by Commissioner Hornsby, that the Board of Commissioners adopt an ordinance entitled, "AN ORDINANCE AMENDING SECTION 15-4 AND 15-5 AND CREATING SECTION 15-7 OF CHAPTER 15, HEALTH, OF THE CODE OF ORDINANCES OF THE CITY OF PADUCAH, KENTUCKY". This ordinance is summarized as follows: Amending Sec. 15-4, "Accumulation of rubbish or excessive growth of grass or weeds -declared unlawful", by increasing the fine for violation of same, amending provisions of Sec. 15-5, "Notice to remedy situation, action by city upon noncompliance by owner", and creating Sec. 15-7, which establishes a citation policy and a fine for violation of this policy. AMEND CHAPTER 7, BUILDINGS & BUILDING REGULATIONS Commissioner Coleman offered motion, seconded by Commissioner Grumley, that the Board of Commissioners adopt an ordinance entitled, "AN ORDINANCE CREATING A NEW SECTION UNDER ARTICLE I., CHAPTER 7, BUILDINGS AND BUILDING REGULATIONS, OF THE CODE 378 AUGUST 15, 1995 OF ORDINANCES OF THE CITY OF PADUCAH, KENTUCKY". This ordinance is summarized as follows: Establishing requirements and regulations for registration of residential rental property v' with the City of Paducah Department of Planning and Building. ORDINANCE NO. 95-8-5344, BOOK 26, P. 002 AMEND CHAPTER 17 1/2, LITTER Commissioner Grumley offered motion, seconded by Commissioner ( Coleman, that the Board of Commissioners adopt an ordinance Y entitled, "AN ORDINANCE AMENDING SECTION 17 1/2-21 AND CREATING SECTION 17 1/2-23 OF CHAPTER 17 1/2, LITTER, OF THE CODE OF ORDINANCES OF THE CITY OF PADUCAH, KENTUCKY". This ordinance is summarized as follows: Amending Sec. 17 1/2-21, "Clearing of litter from open private property by city", and creating Sec. 17 1/2-23, which establishes a citation policy and a fine v for violation of this policy. ORDINANCE NO. 95-8-5345, BOOK 26, P. ?!J AMEND SEC. 19-4 OF CHAPTER 19, MISCELLANEOUS OFFENSES AND PROVISIONS Commissioner Hornsby offered motion, seconded by Commissioner Renfro, that the Board of Commissioners adopt an ordinance entitled, "AN ORDINANCE AMENDING SECTION 19-4 OF CHAPTER 19, MISCELLANEOUS OFFENSES AND PROVISIONS, OF THE CODE OF ORDINANCES OF THE CITY OF PADUCAH, KENTUCKY". This ordinance was read in full. (This section is entitled, "Advertisements on utility poles or trees on or along streets, sidewalks, etc.". ORDINANCE NO. 95-8-5346, BOOK 26, P. 5P 19, MISCELLANEOUS OFFENSES AND PROVISIONS Commissioner Renfro offered motion, seconded by Commissioner Hornsby, that the Board of Commissioners adopt an ordinance entitled, "AN ORDINANCE AMENDING SECTION 19-106 AND CREATING SECTION 19-114 OF CHAPTER 19, MISCELLANEOUS OFFENSES AND PROVISIONS, OF THE CODE OF ORDINANCES OF THE CITY OF PADUCAH, KENTUCKY". This ordinance is summarized as follows: Amending Sec. 19-106 by decreasing the number of days allowed for a property owner to abate a public nuisance before said nuisance is removed and abated by the city, and creating Sec. 19-114, which establishes a citation policy and a fine for violation of this policy. ORDINANCE NO. 95-8-5347, BOOK 26, P. 3* - REZONE PROPERTY AT 3100 JACKSON STREET Commissioner Coleman offered motion, seconded by Commissioner Grumley, that the Board of Commissioners adopt an ordinance entitled, "AN ORDINANCE APPROVING THE FINAL REPORT OF THE PADUCAH PLANNING COMMISSION ON THE PROPOSED ZONE CHANGE AND PRELIMINARY DEVELOPMENT PLAN FOR RESA DANESH LOCATED AT THE CORNER OF JACKSON & LONE OAK RD; 3100 JACKSON, FROM R-4, HIGH DENSITY RESIDENTIAL ZONE, TO B-1, CONVENIENCE AND SERVICE ZONE, AND AMENDING THE PADUCAH ZONING ORDINANCE SO AS TO EFFECT SUCH REZONING". This ordinance is summarized as follows: Changing the zone at 3100 Jackson Street from R-4, High Density Residential, to B-1, Service and Convenience Zone, and amending the Paducah Zoning Ordinance so as to effect such rezoning. X34$, BOOK 26, P . q5- 153y8, REZONE 2703 TENNESSEE STREET Commissioner Grumley offered motion, seconded by Commissioner Coleman, that the Board of Commissioners adopt an ordinance entitled, "AN ORDINANCE APPROVING THE FINAL REPORT OF THE PADUCAH PLANNING COMMISSION ON THE PROPOSED ZONE CHANGE AND PRELIMINARY DEVELOPMENT PLAN FOR PADUCAH SERVICE COMPANY 379 AUGUST 15, 1995 LOCATED AT 2703 TENNESSEE STREET FROM R-2, LOW AND MEDIUM DENSITY RESIDENTIAL ZONE, TO B-3, GENERAL BUSINESS ZONE, AND AMENDING THE PADUCAH ZONING ORDINANCE SO AS TO EFFECT SUCH REZONING". This ordinance is summarized as follows: Changing the zone at 2703 Tennessee Street from R-2, Low and Medium Density Residential, to B-3, General Business Zone, and amending the Paducah Zoning Ordinance so as to effect such rezoning. ANNEX PROPERTY ON BLANDVILLE ROAD Commissioner Hornsby offered motion, seconded by Commissioner Renfro, that the Board of Commissioners adopt an ordinance entitled, "AN ORDINANCE FINALIZING THE ANNEXATION OF CERTAIN PROPERTY LYING ADJACENT TO THE CORPORATE LIMITS OF THE CITY OF PADUCAH, AND DEFINING ACCURATELY THE BOUNDARY OF SAID PROPERTY ✓ TO BE INCLUDED WITHIN THE SAID CORPORATE LIMITS". This ordinance is summarized as follows: Annexing property into the City of Paducah adjacent to the present city limits along Blandville Road. ORDINANCE - INTRODUCTION ADOPT JULY, 1995, REVISIONS OF HOME PLAN DOCUMENTS (2) Commissioner Renfro offered motion, seconded by Commissioner Hornsby, that the Board of Commissioners introduce an ordinance entitled, "AN ORDINANCE APPROVING AND ADOPTING THE REVISED CITY OF PADUCAH HOME RESIDENTIAL ANTIDISPLACEMENT AND RELOCATION ASSISTANCE PLAN AND THE REVISED HOME REHABILITATION PLAN, AND AUTHORIZING THE MAYOR TO EXECUTE SAME". This ordinance is summarized as follows: Adopting the July, 1995, revisions of the Paducah Home Residential Antidisplacement and Relocation Assistance Plan and the Home Rehabilitation Plan, as recommended by the Kentucky Housing Corporation and the Urban Renewal & Community Development Agency. DISCUSSIONS 1. Bob Cherry, Jr. discussed his concern about the intent of various ordinances adopted above relating to code enforcement concerning weeds, junk vehicles, dilapidated structures and other nuisances. 2. Ray McLennan discussed his concern about the landlord ordinance adopted above. He asked the Commission if there was a hidden motive in an ordinance requiring landlords to register their property and said he thinks this more regulation and overkill to solve a problem. Mayor Montgomery and City Manager the only reason for this ordinance rental property is located, who ow each contains. City officials hav people when there is a question ov code violations. MAYOR MONTGOMERY: Hoover told Mr. McLennan that is to help identify where ns it, and how many units e said they will work with er who is responsible for 1. Announced the City has received an Award of Excellence in Annual Financial Reporting for the fourth year. 2. Discussed City's schedule for paving of city streets and city residents' participation for parking on the streets during scheduled street improvements. 3. .Announced new hours for Noble Park pool. 4. Announced that the Paducah Public Library will be closed August 25 for in-service. r' AUGUST 15, 1995 5. Read a letter from Joseph L. Pavone, P.E., of Louisville, concerning his recent tour of Paducah's compost and sludge facilities and his complimentary remarks concerning same. 6. Announced that she was interviewed by the "McNeil -Lehrer Report", about the positive impact of the Tennessee Valley Authority on Paducah and Western Kentucky, which be televised on a future "McNeil -Lehrer Report" news special. 7. Offered congratulations to Police Chief McGinty for his recent appointment by Governor Jones to the Kentucky Law Enforcement Council. EXECUTIVE SESSION Commissioner Coleman offered motion, seconded by Commissioner Grumley, that the Board go into closed session for discussion of matters pertaining to the following topics: 1. Future sale or acquisition of a specific parcel(s) of real estate, as permitted by KRS 61.810(1)(b) 2. Proposed or pending litigation, as permitted by KRS 61.810(1)(c) 3. Collective bargaining with public employees, as permitted by KRS 61.810(1)(e) 4. Issues which might lead to the appointment, dismissal, or disciplining of an employee, as permitted by KRS 61.810(1)(f). 5. A specific proposal by a business entity where public discussion of the subject matter would jeopardize the location, retention, expansion or upgrading of a business entity, as permitted by KRS 61.810(1)(g).
