ORDINANCE NO. 2012-2-7904
AN ORDINANCE AUTHORIZING THE MAYOR TO ENTER INTO AN
ENCROACHMENT AGREEMENT BETWEEN THE CITY OF PADUCAH AND NEIL C. AND
RONNA T. WARD, FOR ENCROACHMENT AND UTILIZATION UPON A PORTION OF CITY OF
PADUCAH PROPERTY
WHEREAS, Neil C. and Ronna T. Ward are the owners of property located at 2429
Bridge Street, Paducah, Kentucky; and
WHEREAS, the City of Paducah is the owner in fee simple of a 25' alley right of way
located south of and adjacent to 2429 Bridge Street, being situated in Paducah, Kentucky; and
WHEREAS, Mr. and Mrs. Ward are desirous of encroaching upon and utilizing a small
portion of the 25' alley right of way for a portion of an existing covered parking/awning structure which
was unintentionally built over and across the City's and Ward's common property line; and
WHEREAS, the City and the Wards' have now entered into an agreement pertaining to
the foregoing and do desire that same be set forth in writing and be made part of the public records of the
City of Paducah, Kentucky, and recorded in the office of the County Court Clerk of McCracken County,
Kentucky.
BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. That the City of Paducah hereby approves the Encroachment Agreement
with Neil C. and Ronna T. Ward for encroaching upon and utilizing a small portion of a 25' alley right of
way located south and adjacent to the Ward's property located at 2429 Bridge Street, Paducah, Kentucky.
Said "Encroachment Area" shall be approximately 5' W x 31' L.
SECTION 2. That the Mayor is hereby authorized to execute the Encroachment
Agreement with Neil C. and Ronna T. Ward, as approved in Section 1 above.
SECTION 3. This ordinance shall be read on two separate days and will become
effective upon summary publication pursuant to KRS Chapter 424.
