AN ORDINANCE AUTHORIZING THE MAYOR TO EXECUTE CONTRACT
MODIFICATION NO. 3 WITH JJR, LLC FOR PROFESSIONAL ENGINEERING RE -DESIGN
SERVICES FOR THE TRANSIENT BOAT LANDING DOCK, RIVERFRONT DEVELOPMENT PHASE
I PROJECT
WHEREAS, by Ordinance No. 2007-8-7313, the City authorized the execution of an
agreement with JJR, LLC in an amount not to exceed $559,600.00 for professional engineering services for
the design of the Transient Boat Landing Dock, Riverfront Development Phase I Project; and
WHEREAS, by Ordinance No. 2008-8-7453 the City authorized a contract modification in
the amount of $20,240 for a survey required by the United States Fish and Wildlife Services (USFWS) to be
conducted of the Ohio River Bottom within the project area to determine the presence/absence of threatened
or endangered mussels, therefore increasing the total contract amount to $579,840.00; and
WHEREAS, by Ordinance 2009-5-7549, authorized Contract Modification No. 2 for JJR to
complete the Biological Assessment (BA) and a Biological Opinion (BO) in the amount of $76,500.00 and
total design fees for the Marina Building in the amount of $138,400 for a total amount of $214,900,
increasing the total contract amount to $794,740.00; and
and
WHEREAS, the project was halted due to petitioners challenging the relocation of mussels;
WHEREAS, a settlement agreement has been reached which will require the relocation of
the original project in a northerly direction approximately 500 feet, therefore, creating the necessity of
Contract Modification No. 3 with JJR in the amount not to exceed $125,000 for engineering re -design
services for the Transient Boat Landing Dock bringing the total contract price up to $919,740.00.
BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. That the Mayor of the City of Paducah is hereby authorized to execute
Contract Modification No.3 with JJR, LLC in an amount not to exceed $125,000 to provide Engineering Re -
Design Services for the Transient Boat Landing Dock, Riverfront Development Phase I Project, increasing
the total contract amount to $919,740.00.

SECTION 2. This expenditure shall be charged to the RF 2006 HUD Grant, project account
